JAY ZRAMERMAN Director This letter transmits a Notice of Violation and assessment of civil penalty in the amount of $4,452.66 ($4000.00 civil penalty + $452.66 enforcement costs) against Wayne Farms, LLC. This assessment is based upon the following facts: Approximately 2,000 gallons of wash water was discharged into a stormwater drainage system and Town Creek from the pit and silo cleaning activities performed by the Wayne Fames, LLC personnel at the Renwood Mills facility on August 23 and 24, 2017. Wayne Farms, LLC had not applied for or secured a permit to discharge the pit and silo cleaning wash water from the Division. Based upon the above facts, I conclude as a matter of law that Wayne Farms, LLC violated G.S. 143-215.1(ax1) which states: "Activities for Which Permits Required — No Person shall do any of the following things or carry out any of the following activities unless that person has received a permit from the Commission and has complied with all conditions set forth in that permit. (1) Make any outlet into the waters of the State" Based upon the'above findings of fact and conclusions of law, and in accordance with authority provided by the Secretary of the Department of Environmental Quality and the Director of the Division of Water Resources,1, W. Because a remission request forecloses the option of an administrative hearing, such a request must be accompanied by a waiver of your right to an administrative hearing and a stipulation and agreement that no factual or legal issues are in dispute. Additional conditions for specific industry sectors have been added to the SPPP requirements in some cases. • Sections B, C: Failure to perform analytical stormwater monitoring may result in the Division requiring that the permittee begin a monthly sampling scheme. • Sections B, C: A lower TSS benchmark of 50 mg/I for HQW, ORW, PNA and Tr Waters applies to these more sensitive waters. • Sections B, C. MOORESVILLE REG€O#,, ,i =€ � Mr. Krebs, This letter is in response to a spill we had on 4/4/2012. The spill report came in from a Duke Power employee working on their Right of Way in this area. City crews were on the site within 15 minutes of the call with the Jet Vac and a back hoe, just in case we had any issues with getting in to the site. We found a manhole releasing very little waste, however it was running down hill through the woods that led to a small stream. While cleaning the line we found a solid blockage we believe to be stone debris and removed tree roots and rock in the basket we placed in the invert. This line was last inspected prior the spill on 3/21 /12 while performing Right of Way maintenance and had no flow issues at that time. Past records also indicate no issues in this area of the system and to my knowledge we have had none. City crews returned to the site a week later and re -cleaned the line. There was no blockage at this time but more debris was removed from the line. My Sewer Superintendent has been conducting weekly visual inspections of the man holes at this location since the spill and it appears to be doing well. We have added this area to our quarterly cleaning log and shall continue to give this area closer attention.
