Dear Mr. Love:
Southeastern Packaging Company (SEP) is in receipt of the above referenced Notice of Violation
(NOV) and has contracted with Trigon Engineering Consultants, Inc. (Trigon) too assist them to
resolve this matter.
The NOV alleged violations regarding the maintenance of a Stormwater Pollution Prevention
Plan (SWPPP) and performance of related qualitative monitoring. In order to address these
deficiencies SEP is preparing a SWPPP that reflects current conditions and a plan for completing
qualitative stormwater monitoring during the next significant precipitation event_ These
documents will be completed by December 10, 2007
We feel that these actions will fully address the concerns identified in the NOV; however, should

Enclosed is a copy of the Compliance Evaluation Inspection Report for the inspection
conducted at the subject facility on September 24, 2007 by Mr. Barry Love of this Office.
This report is being issued as a Notice of Violation (NOV) because of violations of the
subject permit as detailed under the Stormwater Pollution Prevention Plan and Qualitative
Monitoring headings. Pursuant to G.S. 143-215.6A, a civil penalty of not more than twenty-five
thousand dollars ($25,000.00) per violation may be assessed against any person who violates
or fails to act in accordance with the terms, conditions, or requirements of any permit issued
pursuant to G.S. 143-215.1. Should this Office make an enforcement recommendation relative
to the violations, you will be advised in writing.
It is requested that a written response be submitted to this Office by November 19,
2007 addressing the violations/deficiencies noted under the Stormwater Pollution
Prevention Plan and Qualitative Monitoring headings of the report. In responding, please
address your comments to the attention of Mr. Barry Love.

date of this Certification. If the construction process for approved activities will overlap the
expiration and renewal date of the corresponding 404 Permit and the Corps allows for
continued use of the 404 Permit, then the General Certification shall also remain in effect
without requiring re -application and re -approval to use this Certification for the specific
impacts already approved.
20. The a licant/ ermittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with §303(d) of the Clean Water Act), and any other appropriate requirements of
State and Federal Law. If the Division determines that.such standards or laws are not being
met including failure to sustain a designated or achieved use, or that State or Federal law is
being violated, or that further conditions are necessary to assure compliance, then the
Division may reevaluate and modify this General Water Quality Certification.
Non-compliance with or violation of the conditions herein set forth by a specific fill project
may result in revocation of this General Certification for the project and may also result in criminal
and/or civil penalties.

conditions set forth in Parts I, II, Ili, IV, V, and VI of General Permit No. NCG050000 as
attached.
This certificate of coverage shall become effective May 1, 2003.
This Certificate of Coverage shall remain in effect for the duration of the General Permit.

Your facility is currently covered for Stormwater discharge under General Permit NCG050000. This permit expires
on March 31. 2003. The Division staff is currently in the process of rewriting this permit and is scheduled to have
the permit reissued by early spring of 2003. Once the permit is reissued, your facility would be eligible for
continued coverage under the reissued permit.
In order to assure your continued coverage under the general permit, you must apply to the Division of Water
Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in
advance that your permit coverage will he expiring. Enclosed you will find a Permit Coverage Renewal 4
Application Form. The application must be completed and returned by October 2, 2002 in order to assure
continued coverage under the general permit. Due to staff and budget constraints, letters confirming our receipt of
the completed application will not be sent.
Failure to request renewal within the time period specified, may result in a civil assessment of at least 5250.00.
Larger penalties may be assessed depending on the delinquency of the request_ Discharge of stormwater from your
facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1
and could result in assessments of civil penalties of up to $10,000 per day.
Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial
facilities in any of the I I categories of "storm water discharges associated with industrial activity," (except
construction activities). If you feel your facility can certify a condition of "no exposure", i_e. the facility industrial
materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. For additional
