On March 21, 2019, a site inspection was conducted for the Elkay Plumbing Products Company facility located at 880
Caton Road in Lumberton, Robeson County, North Carolina. A copy of the Compliance inspection Report is enclosed for
your review. Mr. Rodney Vernon, Environmental Lead, was also present during the inspection and his time and assistance
is greatly appreciated. The site visit and file review revealed that the subject facility is covered by NPDES Stormwater
General Permit NCG030000 under Certificate of Coverage NCG030589. Permit coverage authorizes the discharge of
Stormwater from the facility to receiving waters designated as Raft Swamp, class WS-IV;Sw waters in the Lumber River
Basin.
As a result of the inspection, the facility was found to be in compliance with the conditions of the NCG030000 permit.
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made during the
inspection.
Please be advised that violations of the NPDES Stormwater General Permit are subject to a civil penalty

The General Permit this facility is covered under expires on October 31, 2017. Our records indicate that
your annual fees are up to date; therefore, your coverage will be automatically renewed unless you

The Stormwater Program plans to reissue this General Permit for one year with no changes. This
action has been posted for public comment on our website above (see the table of General Permits) and
published in area newspapers statewide. The public comment period for the reissuance action concludes
on November 1, 2017, and the new General Permit is scheduled to become effective on November 15,
2017. upon issuance of the final General Permit, your coverage will be renewed for the one year
period. Instead of being mailed new Certificates of Coverage (COCs), each permittee should print off
the new General Permit Cover Page from our Stormwater Program website (with revised effective and
expiration dates) after issuance in mid -November.
Although the renewal process is automatic this year, two items require your action:

than November 15, 2017.
(2) You must submit outfall information on-line for this site in preparation for electronic data
monitoring report (eDMR) requirements no later than November 30, ??Z7.

Below is a summary of items discussed during today's site visit.
In regards to the distribution center, our NPDES Stormwater Permitting Program does not apply to facilities that do not
have stormwater discharge outfalls. As observed today while driving around the perimeter of the distribution center,
there are no apparent discharge points/outfalls. Therefore, the distribution center is not required to obtain stormwater
permit coverage or a no exposure certification.
As far as an SIC Code for the distribution center, the only thing I could find on the OSHA SIC Code website that could fit is
SIC 5074-Plumbing and Heating Equipment and Supplies or SIC 5023-Home Furnishings. Both of these SIC Codes refer to
distribution. If you would like to research this further, the website I used is
https://www.osha.govZl2lsZimis/sicsearch.htmi. You could also try http://www.naics.com/.
Regarding sampling/monitoring, the Tier One, Tier Two and Tier Three conditions of the NCG030000 stormwater permit
only apply to exceedances of a benchmark value at the same outfall. For example, if there are two consecutive
exceedances of a benchmark value for the same parameter at outfall 1, but not at outfall 2 then the Tier Two response
(monthly monitoring) only applies to outfall 1.
Also, sampling/monitoring for outfall 2 (stormwater pond) should be conducted if/when the stormwater pond actually
discharges. If the pond has the capacity to hold storm flow from the facility throughout the monitoring period without
discharging, then you would report 'No Flow' or 'No Discharge' on the monitoring report form within 30 days of the end
of the monitoring period. This is assuming the pond is actually a constructed stormwater pond for the facility and on
Elkay property. If the pond was not constructed along with the facility to specifically receive stormwater flow from the
facility and is influenced by other sources such as a stream or another pond, then you would need to collect the
stormwater flow prior to it entering the pond.

permit are triggered by benchmark exceedances on four occasions beginning on the effective date of this
permit and do not count prior exceedances.

This letter is in response to your letter dated March 5, 2012, to the Elkay Southern Corporation plant
located at 880 Caton Road in Lumberton, North Carolina, in regards to a site inspection performed by
Michael Lawyer on March 1, 2012.
We have implemented corrective measures to correct the two deficiencies found during the inspection
and have outlined our improvement actions below.
1) Elkay could not provide any evidence to support that the SPPP plan had been annually
reviewed and updated. Each year we update all of our environmental health and safety
policies and show a revision date. The review of the Storm Water Pollution Plan was
conducted but was noted on a plant policy and not our actual SPPP. This has been corrected
and annual reviews with be documented correctly.
2) Elkay was not performing qualitative monitoring during the quarterly sampling of the
outfalls.
The qualitative monitoring was being conducted and documented when discharges were to
occur. Qualitative monitoring needs for quarterly sampling was misunderstood. It is now
understood and our documented procedures have been updated to ensure that all
qualitative monitoring is conducted in the future.
Recommendations from Michael Lawyer that will help us improve: (Action Plans Provided
Below)
1) The stater_eggired Lead be reported in g/L. Lab results report Lead in mg/L.
We will make sure the forms submitted to North Carolina have had the lead
concentration converted properly to g/L.
2) Check on reporting to state by Microbec, are they using state forms or lust faxing over
the analysis sheet.
Microbec did submit analysis results to the State, but submitted the incorrect form. We
have changed our process so that Microbec submits our analysis results to us and we will
prepare the correct submissions.
3) When sampling the out falls, measure the pH at the time of sampling as the sample is
only viable for 15 minutes for accurate pH reading.

We have established a procedure to conduct the pH testing at the time the sample is
drawn. Mr. Lawyer explained the chain of custody requirements and that has been
included in our written policy.
We appreciate Mr. Lawyer's assistance with understanding the storm water
requirements, as it is our objective to minimize our environmental impact and comply
with the rules.
Additionally, please be advised that our company has changed its name from Elkay
Southern Corporation to Elkay Plumbing Products. This is a change in name only. There
was not change in ownership. Name change forms were submitted to the state last year.

On March 1, 2012, Michael Lawyer, Environmental Specialist from the Fayetteville Regional Office of the Division
of Water Quality, conducted a site inspection at the Elkay Southern Corporation facility located at 880 Caton
Road in Lumberton, Robeson County, North Carolina. A copy of the Compliance Inspection Report is enclosed for
your review. Mr. Chuck Morrison, Maintenance Manager, and Mr, Rodney Vernon, Environmental Lead, were also
present during the inspection and their time and assistance is greatly appreciated. Permit coverage authorizes the
discharge of stormwater from the facility to receiving waters designated as a UT (unnamed tributary) to Raft
Swamp, a Class WS-IV;Sw water in the Lumber River Basin. The site visit and file review revealed that the
subject facility is covered by NPDES Stormwater General Permit-NCG030000, Certificate of Coverage-
NCG030589.
As a result of the site inspection, the following deficiencies are noted:
1) Stormwater Pollution Prevention Plan (SPPP)
A Stormwater Pollution Prevention Plan (SPPP) has been developed and recorded, but there was no
documentation of an annual review/update and semi-annual Qualitative Monitoring as described in the SPPP has
not been implemented.
2) Qualitative Monitoring
Qualitative monitoring has been conducted and recorded for releases of accumulated stormwater from secondary
containment structures, however not for stormwater discharges from the outfalls as required by the NCG030000
General Permit.
Please refer to the enclosed Compliance Inspection Report for additional comments and observations made
during the inspection.
You are asked to respond to this office, in writing, within 30 calendar days from receipt of this notice.
Your written response should include a reasonable explanation as to why the aforementioned
deficiencies have occurred as well as a Plan of Action to prevent them from recurring.
