Based on the information provided in the request as well as observations previously made during the Compliance Evaluation Inspection conducted by Michael Lawyer on May 6, 2010, we are approving this request. In accordance with 40 CFR §122.21(g)(7), you are authorized to sample SDO #1 as a representative outfall. This approval is effective with the next sampling event. Please be reminded that the permit requires Qualitative Monitoring to be performed at all stormwater discharge outfalls, regardless of representative outfall status. Please remember that any actions you initiate in response to benchmark exceedances as directed in the tiered response provisions of your permit must address all drainage areas represented by SDO #1, where appropriate. Please append this letter to your Stormwater Pollution Prevention Plan (SWPPP) to document that representative outfall status has been approved. If changes in drainage areas, structures, processes, storage practices, or other activities occur that significantly alter the basis of this approval, representative outfall status is no longer valid. In such case, you should resume sampling at all SDOs or reapply to this office for representative outfall status based on updated information. The more significant changes in the General Permit since your last Certificate of Coverage include the following: • Part I Section A — A new notation that the No Exposure Exclusion from permitting option may be available to the permittee. • Part I Section A — A new provision that facilities draining to 303(d) listed waters, or in watersheds with an approved TMDL, may not be eligible for renewed coverage under the General Permit. • Part II Section B Table 1 — An increased sampling frequency from once per year to twice per year. • Part II Section B Table 3 — Benchmark concentrations now replace cutoff concentrations; the elimination of the option to avoid sampling based on cutoff concentrations. • Part II Section B — New provisions requiring the permittee to execute Tier One and Tier Two response actions, based on the first benchmark exceedence (Tier One) and the second consecutive benchmark exceedence (Tier Two). Tier Two requires that the permittee institute monthly monitoring instead of twice -per -year monitoring, until three consecutive monitoring events show no benchmark exceedences. • Part II Section B — A new provision that four exceedences of any particular benchmark will trigger increased DWQ involvement in the permittee's stormwater management and control actions. DWQ may direct the permittee to apply for an individual permit, or may direct the implementation or installation of specific stormwater control measures. Some comments resulted in permit modifications, others are. addressed in the response document or Fact Sheet. A few specific requests for clarification are addressed below. 1. What is the deadline for having a revised SPPP that reflects the provisions. of the new General Pen -nit? DWQ will require that the permittee have a revised, complete SPPP no later than six months after the date of issue of that permittee's new Certificate of Coverage. 2. Must analytical results be by a certified lab? What about pH measurements? All analytical results obtained to satisfy NPDES permit requirements must be certified, as directed in North Carolina regulations at 15A NCAC 2H':0800, and as administered by DWQ's Laboratory Section Certification Branch. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of' Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the 11 categories of "storm water discharges associated with industrial activity," (except construction activities). If you feel your facility can certify a condition of "no exposure", i.e. the facilty industrial materials and operations are not exposed to stormwater, you can apply for the no exposure exclusion. This permit expires on August 31, 2002. The Division staff is currently in the process of rewriting this permit and is scheduled to have the permit reissued by late summer of 2002. Once the permit is reissued, your facility would be eligible for continued coverage under the reissued permit. In order to assure your continued coverage under the general permit, you must apply to the Division of Water Quality (DWQ) for renewal of your permit coverage. To make this renewal process easier, we are informing you in advance that your permit will be expiring. Enclosed you will find a General Permit Coverage Renewal Application Form. The application must be completed and returned by March 4, 2002 in order to assure continued coverage under the general permit. Failure to request renewal within this time period may result in a civil assessment of at least $250.00. Larger penalties may be assessed depending on the delinquency of the request. Discharge of stormwater from your facility without coverage under a valid stormwater NPDES permit would constitute a violation of NCGS 143-215.1 and could result in assessments of civil penalties of up to $10,000 per day. Please note that recent federal legislation has extended the "no exposure exclusion" to all operators of industrial facilities in any of the 1 1 categories of "storm water discharges associated with industrial activity," (except construction activities).
