After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3022. This certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. As discussed previously with John Thomas of the Army Corps of Engineers, the landfill gas pipeline crosses four streams (listing from east to west, the direction of gas flow): an unnamed branch which feeds North Buffalo Creek, Muddy Creek, North Buffalo Creek, and an unnamed branch which drains White Oak Lake into North Buffalo Creek at Cone Mills. The first three crossings will be above grade, the last crossing will be below grade. The White Street Landfill Gas Collection System is a venture to collect landftll gas (primarily methane) from the landtill and pipe it to a Cone Mills boiler for consumption. We are working with the City of Greensboro, NC DOT, and the Corps of Engineers to obtain needed permits and agreements to faciJitate this venture. The proposed pipeline right-of-way from the landfill boundary to Cone Mills was walked by Robert Siler of Duke Engineering to survey for wetlands and state or federal level protected species. Mr. Siler found neither wetlands nor evidence of protected species in the entire alignment (outside the landfill boundaries). The right-of-way is 30 feet wide. Attached to this letter are 12 draft drawings of the proposed alignment of the 3 mile pipeline including plan and profile of the four creek crossings. The 16 inch diameter PE 3408 (polyethylene), SDR 17 pipe wij] be buried with a minimum 3 foot cover when underground, and 16" diameter steel pipe will be used when crossing over the creeks. Concrete piers will be used to support the pipe at or above the steeply incised banks of creeks for the three creek crossings, with no piers in the normal flow streambed. The pipe will be buried with three feet of cover when cro:;sing the unnamed branch below grade. The first (eastern) unnamed creek crossing location has a 100 year flood level of 711.' Our alignment crosses 80' downstream (north) of the centerline of White Street at an invelt elevation of 710'. This stream passes under White Street in a culvert. The Muddy Creek crossing location has a 100 year flood level of 712.' Our alignment crosses 75' downstream (north) of the centerline of White Street at an invert elevation of 711'. The stream also passes under White Street in a culvert. Please note that a 48" diameter sanitary sewer main crosses North Buffalo Creek 125' upstream of our pipeline stream crossing alignment. The sewer main has an invert elevation of 710.75,' the stream has a normal flow elevation of 699.8,' and a 100 year flood elevation of 721' at that location. Our alignment crosses North Buffalo Creek at an invert elevation of 712.5' . The unnamed branch which drains White Oak Lake into North Buffalo Creek at Cone Mills has a 100 year flood elevation of 727' at that location. Our alignment crosses underground 800' downstream (south) of Sixteenth Street on Cone Mills property. The 100 year "floodplain" is 495' wide at that point.
