Dear Ms. Carr:
You have our approval to place fill material in 0.16 acres of wetlands or waters for the purpose of
constructing homes and a driveway at lot 4, Block A. Jackson Drives, as you described in your application
dated 23 May 1996. After reviewing your application, we have decided that this fill is covered by General
Water Quality Certification Numbers 2732 and 2733. These certifications allow you to use Nationwide
Pennit Numbers 14 and 18 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. In addition, you
should get any other federal, state or local pennits before you go ahead with your project
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which confonns to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

with her interest in Lot 1 Section 3 of the Isaac W. O'Neal and
John W. O'Neal Heirs Subdivision. Please find enclosed a copy of
the plat map for your reference.
Mrs. 0' Neal's property is on the edge of the above-referenced
subdivision and you and she share a common property line, Although
the recorded plat maps indicate that Thomas Drive runs across the
front of her property and ends at your property line, this is not
actually true. Thomas Drive dead ends approximately at Mrs.
O'Neal's driveway and does not actually extend to the property
line. Further, your property is not part of the O'Neal Subdivision.
You, therefore, do not have any right to use Thomas Drive for
either residential or commercial purposes. Thomas Drive was created
for the benefit of the residences of O'Neal Subdivision.
This letter is to put you on formal notice that you may not cross
Mrs. O'Neal's property to access your property. I understand that
you have been using Thomas Drive to access your property, you are
hereby notified that you may not use Thomas Drive to access your
property.
Mrs. O'Neal intends to pursue all legal remedies available to her
to protect and preserve her property.
