SPECIAL CONDITIONS FOR PERMIT NUMBER 96NERS91
A.
This permit is limited to the recovery of submerged logs and other non-
structural wood. The presence of any cultural material that is encountered
during the course or the project shall be reported to the UndeIWater
Archaeology Unit immediately.
This permit authorizes the Permittee the rildtt to conduct initial remote
sensing survey activities within the area defined as: those portions of the
Northeast Cape Fear River from the Hilton Railroad Bridge upstream to the
head of navigation.
Upon completion of the remote sensing survey, the Permittee shall inform
the UndeIWater Archaeology Unit (UAU) of any areas of the river bottom
containing a sufficient concentration of submerged logs to warrant recovery
operations.
If the UAU determines that recovery of submerged logs from a specific area
will not jeopardize significant cultural resources, the Permittee shall be
given exclusive rights to recover logs from that .area. The Permittee shall
have exclusive recovery ri~ts to no more than six well-defined areas at any
time. If the UAU feels iliat recovery operations in a specific area may
jeopardize si~ficant cultural resources, the Permittee shall not undertake
recovery operations in that area.
The Permittee agrees to notify the office of the UndeIWater Archaeology
Unit, P.O. Box 58, Kure Beac~ North Carolina 28449, phone 910-458-
9042, at least 48 hours prior to inItiating field activities. .
The Permittee shall submit a monthly report detail~g project activities and
listing all artifacts recovered and their status. Monthly report are due by the
10th day of the following month.
All logs and timbers recovered under the conditions of this permit shall
become property of the Permittee.
The period of this permit shall be one year. The permit may be renewed
yearly, subject to any changes in the permit the Department deems
appropriate, providing the Permittee has satIsfactorily met an the terms and
conditions of this permit. .

III. Description of Proposed Project
A. Provide a statement of the purpose or objectives of the project:
The objective of this project will be to recover submerged logs that are
of sufficient quality to be milled into lumber.
The project will be in two stages:
1. Map the N.E. Cape Fear Riwr from north of the shipping
lane (railroad bridge) to as far north as the concentration of
logs or river depth will pennit economic recovery.
2. Once the concentration and location of logs hac; been established,
. the river project will be divided into sections. Each section will be
reviewed by the Underwater Archeology Unit as to location of
shipwrecks or other archeological artifacts that are not to be
disturbed. Once this criterion has been establic;hed, pennission to
proceed in a specific section will be given.

B. Provide a description of the exact nature and scope of the proposed project,
include the methods, techniques, and equipment to be used:
The survey will be done using an Echoscope 1600 by Ornnitech or Kline
System 2000 by Kline Associates or other similar sonar system. These
systems provide a 3D target picture. The target can be positioned, zoomed.
and scaled to length, 3rea, and volume. The sonar unit, in conjunction ""ith
GPS, will give exact locations to be salvaged.
The salvage equipment will consist of a crane of approximately 10 ton
capacity mounted on a barge of approximately 60 feet. The crane will be
fitted with a hydraulic or mechanical grapple. Using the sonar picture, the
grapple can be guided to specific logs for salvage. The logs will be loaded

c. Provide the schedule for the proposed project including beginning and
completion dates of all phases:
The survey will be started in April and take approximately one month. The
salvage operation will begin when sufficient logs have been identified to
warrant salvaging. The entire project could take up to three years.

The purpose is to manufacture the logs into lumber. Whether an
independent sa\vmill operator will be contracted or the machinery will
be purchased will be detennined. The location of this operation will be
detennined by the above decision, and the off-loading site for the barge.
The best off-loading sites will be detennined during the prelirnirw"y survey
according to log concentration.
C. Is the objective of the project the recovery of material for archaeological
research pwposes? NO.
D. Does the applicant wish to obtain possession of the artifacts on a loan basis from
the Department of Cultural resources? NO.

Dear Mr. Dorney:
Enclosed is the application of T. Vance Chamberlin for Department of the
Army authorization and a State Water Quality Certification to remove sunken
logs located on the bottom of the Cape Fear River, for the purpose of lumber
production, near Wilmington, New Hanover County, North Carolina. Your receipt
of this letter verifies your acceptance of a valid request for certification
in accordance with Section 325.2(b) (ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by March 21, 1997, the District Engineer will deem that
waiver has occurred.

Dear Mr. Chamberlin:
The Division of Coastal Management hereby acknowledges receipt of your application for State approval for
development of your property located at various sites within the Northeast Cape Fear River. It was received in its'
final form on December 2, 1996 ,and appears to be adequate for processing at this time. The projected deadline for
making a decision is February 15, 1997. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above,
you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
NCGS I13A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed. you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.
A field repon has been prepared and is in the process of being circulated to the various state and federal review
agencies for their comments. If additional information is required based on this review, the agencies may contact you
directly.

Northeast Cape Fear and possibly other rivers in order to utilize them in a speciality wood product
enterprise.

9. PRClJ'RCT DR'iCRIPTTON - The applicant proposes to recover saw-timber logs that have sunk
to the bottom of the Northeast Cape Fear River in various locations within the river. Most of
these sites are associated with historic saw mill locations which are no longer in operation.
According to the applicant there are several sites where these log resources can be found. The
logs are situated above or slightly imbedded within the bottom substrate. The applicant has
received a permit from the NC Department of Cultural Resources approving the activity. As a
requirement of the permit the applicant must provide infomiation pertaining to the location of
areas containing sufficient quantities of logs to s'upport a recovery operation. The logs will be
located and mapped by means of remote sensing equipment consisting of side scan sonar and GPS
technology. Upon locating the logs will be recovered by means of wrapped chain or by the
utilization of an orange peel grapple mounted on a barge. The logs will be taken to a high ground
site and off loaded and then milled into lumber.
10. ANTICIPATED IMPACTS - The applicant has indicated that ~e initial phase of the proposed
project will consist primarily of the recovery of logs that are now at or above the bottom of the
river. Ultimately the recovery activity may also include logs that are partially or totally covered
by bottom sediment. The mechanical removal of the initial logs appears to be borderline as to
whether it can be dermed as development. We have exercised our authority to consider the
potential aspects of the proposal on coastal resources, in that the action has the possibility of
negative impacts through the elimination of bottom habitat as well as the generation of turbidities
and the release of sediment into the water column. Our experience with other .activities of this
magnitude indicate that any' disturbance will have a short term duration and will cause limited
localized disruptions. We have also advised the applicant that any future expansion of the
proposed recovery method will need to be reviewed prior to initiation of the change in operation.

SPECIAL CONDITIONS FOR PERMIT NUMBER 96NERS91
A.
This permit is limited to the recovery of submerged logs and other non-
structural wood. The j)resence of any cultural material that is encountered
during the course ot the project shall be reported to the Underwater
Archaeology Unit immediately.
This permit authorizes the Permittee the riaht to conduct initial remote
sens~ survey activities within the area defined as: those portions of the
Northeast Cape Fear River from the Hilton Railroad Bridge upstream to the
head of navigation.
U~n completion of the remote sensing ~urvey, the Permittee shall inform
the Underwater Archaeology Unit (uAu) of any areas of the river bottom
containing a sufficient concentration of submerged logs to wmant recovery
operations.
If the UAU determines that recovery of submerged logs from a specific area
will not jeopardize significant cultural resources, the Permittee shall be
given exclUSive rights to recover logs from that ,area. The Permittee shall
nave exclusive recovery riahts to no more than six well-defined areas at any
time. If the UAU feels tTtat recovery o~rations in a ~ecific area ~
jeopardize si~cant cultural resources, the Permittee sh81l not undertake
recovery operations in that area.
The Pennittee agrees to no~ the office of the Underwater Archaeology
Unit, P.O. Box 38, Kure Beach, North Carolina 28449, phone 910-458-
9042, at least 48 hours prior to imtiating field activities. '
The Permittee shall submit a monthly report detaiHng project activities and
listing all artifacts recovered and thelI status. Monthfy report are due by the
10th day of the following month.
All logs and timbers recovered under the conditions of this permit shall
become property of the Permittee.
The period of this permit shall be one year. The permit may be renewed
yearfy, subject to any changes in the permit the Department deems
appropriate, providing the Pennittee has satlsfactorily met ill the terms and
conditions of this pennit.

logs or river depth will permit economic recovery.
2. Once the concentration and location of logs has been established,
. the river project will be divided into sections. Each section will be

B. Provide a description of the exact nature and scope of the proposed project,
include the methods, techniques, and equipment to be used:
The survey will be done using an Echoscope 1600 by Ornnitech or Kline
System 2000 by Kline Associates or other similar sonar system. These
systems provide a 3D target picture. The target can be positioned, zoomed,
and scaled to length, area, and volume. The sonar unit, in conjunction with
GPS, will give exact locations to be salvaged.
The salvage equipment will consist of a crane of approximately 10 ton
capacity mounted on a barge of approximately 60 feet. The crane will be
fitted with a hydraulic or mechanical grapple. Using the sonar picture, the
grapple can be guided to specific logs for salvage. The logs will be loaded
onto the barge, and taken to an appropriate sight to be off-loaded. The logs
will then be tr4r1Sported to a sight to be manufactured into lumber.

The survey will be started in April and take approximately one month. The
salvage operation will begin when sufficient logs have been identified to
warrant salvaging. The entire project could take up to three years.

The pwpose is to manufacture the logs into bunbel'. Whether an
independent sawmill operator will be contracted or the machinery will
be purchased will be determined. The location of this operation will be
deternrined by the above decision, and the off-loading site for the barge.
The best off-loading sites will be detcnnincd during the preliminary survey
according to log concentration.
