Re: City of Hickory NPDES Phase II Permit Post -Construction Ordinance
Dear Mr. Carr:
This letter is to inform the City of Hickory that the Division of Water Quality (DWQ) has reviewed the
Hickory Phase II Post -Construction stormwater ordinance and believes that the ordinance meets the requirements
of the Phase II stormwater program. The City of Hickory Phase II Post Construction stonnwater ordinance is
therefore approved.
DWQ appreciates the hard work you and the City of Hickory have committed to this process to develop
this program.
As you know, the City of Hickory Phase II NPDES Permit (Permit No. NCS000426) requires that your
post -construction program shall begin no later than July 1, 2007. Additionally, any proposed future changes in
your stormwater ordinance relating to the required Phase I1 post construction program must be approved by DWQ
before adoption.

Subject: Notice of Non -Compliance
Dear Mr. Cook;
In 1990, the U.S. Environmental Protection Agency's (EPA) Phase I stormwater program
was promulgated under the Clean Water Act. Phase I relies on the National Pollutant Discharge
Elimination System (NPDES) permit coverage to address stormwater runoff from: (1) "medium"
and "large" municipal separate storm sewer systems (MS4s) generally serving populations of
100,000 or greater, (2) construction activity disturbing 5 acres of land or greater, and (3) ten
categories of industrial activity. The NPDES Stormwater Phase 11 Final Rule was promulgated in
December 1999, and is the next step in EPA's effort to preserve, protect, and improve the Nation's
water resources from polluted stormwatcr runoff. The Phase II program expands the Phase I
program by requiring additional operators of MS4s in urbanized areas and operators of small
construction sites, through the use of NPDES permits, to implement programs and practices to
control stormwater runoff. Phase II is intended to further reduce adverse impacts to water quality
and aquatic habitat by instituting the use of controls on the unregulated sources of stormwater
discharges that have the greatest likelihood of causing continued environmental degradation.
The NPDES Stormwater Phase lI Final Rule requires nationwide coverage of all operators
of small MS4s that are located within the boundaries of the Bureau of Census defined "urbanized
area" based on the latest decennial Census. The Town of Longview was notified in writing on
November 6, 2002, (copy attached) that it had been identified as being located within a census
designated urbanized area. As a regulated public entity, the Town of Longview is required to:
1. File a certification that the village of xxxx does not own or operate a small MS4
2. Request a waiver, or
3. Develop a written stormwater management program and submit the stormwater
management plan along with an application for a Phase II Stormwater Discharge Permit.
The deadline for submitting, non -ownership certification, a request of waiver, or your
application package was May 6, 2004.
An incomplete application was submitted March 12, 2003. Additional information was
submitted December 8, 2004; however, the Town of Longview was notified that the application
was still incomplete on April 18, 2005. Application and certification documents, as well as
additional information on the NPDES stormwater program, are available for download at our web

Please submit the additional information requested in April, 2005, by December 31, 2005.
Thank you for your attention to this matter. These violations and any future violations are subject
to civil penalty assessment of up to $25,000.00 per day for each violation. If you have any

We are writing to you to remind you that the Town of Long View has been identified as being located within a census

MS4 or file a certification that the Town of Long View does not own or operate a small MS4. The deadline for
submitting your application package or non -ownership certification is March 10, 2003. Application and certification
documents, as well as additional information on the NPDES stormwater program, are available for download at our web
