Mebane Phase II Post -Construction stormwater ordinance and believes that the ordinance mccts the requirements
of the Phase II stormwater program. The City of Mebane Phase II Post Construction stortwater ordinance is
therefore approved.
DWQ appreciates the hard work you and the City of Mebane have committed to this process to develop
this program. . .
As you know, the City of Mebane Phase 11 NPDES Permit (Permit No. NCS000402) requires that your
post -construction program shall begin no later than July 1, 2007. Additionally, any proposed future changes in
your stormwater ordinance relating to the required Phase II post construction program must be approved by DWQ
before adoption.

In accordance with the Environmental Protection Agency/North Carolina Memorandum
of Agreement, we have completed our review of the above referenced draft National Pollutant
Discharge Elimination System (NPDES) Phase II municipal separate storm sewer system
(MS4s) permit, received by this office for review on July 26, 2005. Upon reviewing the draft
MS4 permit, EPA has no comments. We request to be afforded an additional review opportunity
only if significant changes are made to the draft permit prior to issuance or if significant
comments objecting to the permit are received. Otherwise, please send us one copy of the final
permit when issued.

After reviewing the Draft Phase II Stormwater Permit for the City of Mebane, I feel it will
be an effective and flexible tool that will address water quality and water quantity
impacts in our receiving streams. I would; however, request the following changes to
the permit:
1. Part II, Section B: Public Education and Outreach, paragraph 2, item (d), page 3.
We would prefer to begin the dissemination of public education material in year 2.
2. Part II, Section D: Illicit Discharge Detection and Elimination, paragraph 2, Items (d
& e), page 4. Given the amount of work involved, we would like to begin developing
the storm sewer map and implementing illicit discharge detection procedures in year
2, rather than year 1.
3. Section F: Post Construction Site Runoff Controls, paragraph 2, item (i), page 7.
Please change the definition of low -density projects to "No more than 24 percent
built -upon area for all residential and non-residential development". This follows the
Permanent Rule Language from 15A NCAC 2H .0126.
4. Section G: Pollution Prevention and Good Housekeeping for Municipal Operations,
paragraph 2, Item (a), page 8. There is no time frame indicated for implementation
of the operation & maintenance program. We can begin developing the O&M
program in year 2.
5. Section G: Pollution Prevention and: Good Housekeeping for Municipal Operations,
paragraph 2, Item (d), page 9. Begin annual reviews of industrial Phase I NPDES
permits in year 2 rather than year 1.

After a review of your permit application materials I found that with changes to Section 7,
there is sufficient content to continue with the review and drafting of your permit.
Section 7.3.1 BMP Summary Table. The objective of the Public Involvement
and Participation Program is to provide opportunities for the public not only to participate
in program development, but implementation as well. The BMPS should address
Volunteer Program / Community involvement (i.e., Organize and implement a volunteer
stormwater related program designed to promote ongoing citizen participation).
Section 7.3,1 BMP Summary Table. The BMP, "train employees on how to
inspect for illicit connections and establish a tracking system for managing reported
problem areas" should read " training employees on how to inspect for and report illicit

Subject: NPDES Phase II Stormwater Program
In 1990 the U.S. Environmental Protection Agency's (EPA) Phase I stormwater program was promulgated under the
Clean Water Act. Phase I relies on National Pollutant discharge Elimination System (NPDES) permit coverage to
address stormwater runoff from: (1) "medium" and "large" municipal separate storm sewer systems (MS4s) generally
serving populations of 100,000 or greater, (2) construction activity disturbing 5 acres of land or greater, and (3) ten
categories of industrial activity. The NPDES Stormwater Phase 11 Final Rule was promulgated in December 1999 and is
the next step in EPA's effort to preserve, protect, and improve the Nation's water resources from polluted storm water
runoff. The Phase II program expands the Phase 1 program by requiring additional operators of MS4s in urbanized areas
and operators of small construction sites, through the use of NPDES permits, to implement programs and practices to
control stormwater runoff. Phase II is intended to further reduce adverse impacts to water quality and aquatic habitat by
instituting the use of controls on the unregulated sources of stormwater discharges that have the greatest likelihood of
causing continued environmental degradation.
The NPDES Stormwater Phase II Final Rule requires nationwide coverage of all operators of small MS4s that are
located within the boundaries of a Bureau of the Census defined "urbanized area" based on the latest decennial Census.
We are writing to you to remind you that the City of Mebane has been identified as being located within a census
designated urbanized area in both the 1990 and 2000 decennial census. As a regulated community, you are required to
develop a stormwater management program and apply for stormwater permit coverage, if you own and operate a small
MS4 or file a certification that the City of Mebane does not own or operate a small MS4. The deadline for submitting
your application package or non -ownership certification is March 10, 2003. Application and certification documents, as
well as additional information on the NPDES stormwater program, are available for download at our web site, Our web
