APPROVAL of 401 Water Quality Certification

Dear Mr. Lamb:
You have our approval to discharge return water from a dredging operation at Lamb's Boating Facility,
as you described in your application dated 29 October 1996. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2668.
This approval is only valid for the purpose and design that you described in your application. If you
change your project, you must notify us and you may be required to send us a new application. If total
wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be
required as described in 15A NCAC 2H.0506 (h) (6) and (7). For this approval to be valid, you must
follow the conditions listed in the attached certification. In addition, you should get any other federal, state
or local permits before you go ahead with your project. Also this approval will expire when the
accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a
written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its
conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean

Site Description
The applicant owns a 9.1 acre tract of land located on the north side of U.S. Highway
158 in Camden, Camden County. The property lies off Roland Creek, which is a tributary of
the Pasquotank River, and is developed with manmade features including a 140' x 470' boat
basin, a convenience store, a commercial seafood store, a trailer park, a boating facility with
47 slips, a fuel dock, a portable sewage pump-out device, and a large grassed parking/yard
area. The boating facility was permitted by CAMA Major Permit #52-91. The existing water
depths in the Roland Creek entrance channel vary from 5'/z feet to 8 feet. The boat basin lies
800 feet from the Pasquotank River and its' water depths vary from 4'/z feet of 10 feet. For
the r pars, the access channel is either straight or easy to navigate with the exception of
200' near the entrance. To navigate this section requires a 60° turn to starboard for 80 feet, a
65 ° turn to port for 80 feet and a 45 ° turn to starboard for 60 feet to stay in the channel. The
area the channel avoids has a water depth of 2 feet and has several stumps.
The Pasquotank River water classification in this area is C SW and the connecting water
depth is 23 feet.
Development Proposal
In order to provide safer navigational access for his customers, and increase the draft
size of the vessels he can accommodate, the applicant proposes to dredge the access channel to
a depth of 10 feet, remove the existing hazards to navigation at the entrance of the access
channel and in the process, straighten the access channel. The applicant also proposes to
dredge the boat basin to a depth of 10 feet. The applicant proposes to contain the dredged
material in an area approximately 270' x 220' x 210' x 160' with a 10' berm. This area is to
be located in a large grassed parking area adjacent to the boat basin.
Approximately 5,120 cubic yards of dredge material will be removed from the bottom of
the access channel and approximately 7,311 cubic yards of dredged material will be removed
from the boat basin. Increased siltation will increase temporarily during dredging.
Approximately 100,360 square feet (2.3 acres) of Public Trust will be disturbed during
dredging.
