Dear Mr. Dorney:
Enclosed is the application of Belvidere Properties, LLC, for Department
of the Army (DA) authorization and a State Water Quality Certification to
construct a bulkhead and four access piers, on property identified as the
Hayes Farm, located off State Road 1114, adjacent Edenton Bay and the
Albemarle Sound, near the Town of Edenton, Chowan County, North Carolina.
Your receipt of this letter verifies your acceptance of a valid request for
certification in accordance with Section 325.2(b) (ii) of our administrative
regulations.
We are considering authorizing the proposed activity pursuant to
Section 404 of the Clean Water Act, and we have determined that a water
quality certification is required under the provisions of Section 401 of
the same law. A Department of the Army permit will not be granted until
the certification has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for
an extension of time, by July 20, 1996, the District Engineer will deem that
waiver has occurred.

Dear Sirs:
You have our approval to place fIll material in 1.028 acres of waters for the purpose of constructing a
golf course/residential development at Hayes Farm near Edenton, as you described in your application dated 16
May 1996. After reviewing your application, we have decided that this flil is covered by General Water
Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application. if you
change your project, you must notify us and you may be required to send us a new application. For this
approval to be valid, you must follow the conditions listed in the attached certification. Deed restrictions
shall be placed on all lots with remaining wetlands to prevent fut~ flil. In addition, you should get any
other federal, state or local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are fmal and binding unless you ask for a hearing.
This letter completes the review of the Diyision of Environmental Management under Section 401 of
the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-1786.

Water dependent development will include some 5600 ft. of bulkhead/shoreline stabilization and four
piers to provide water access for the interior subdivision lots. Each of these proposed piers will be a
maximum length/width of 200 ft. X 6 ft. and include a 500 sf. maximum size platform gazebo at the
pier terminus. The applicant also proposes to construct 3 wooden elevated golf cart paths across US
COE jurisdictional wetlands as well as hand cut some other US COE wetlands to facilitate the
proposed golf course.

Site Description
The applicant proposes to develop the 610 acre subject project adjacent to the Albemarle Sound and
Edenton Bay in Chowan County just outside the corporate limits of the Town of Edenton. This proposed
development is south of Queen Anne's Creek and also adjacent to the previously permitted subdivision
known as Edenton Bay.
The waters of Edenton Bay are classified as Coastal Waters by the Division of Marine Fisheries. These
waters are also classified by the Division of Coastal Management as Public Trust/Estuarine Waters and as
such are part of the Estuarine System Area of Environmental Concern.
The shoreline vegetation consists predominately of a high upland bluff is mostly vegetated in a canopy of
hardwoods. Some significant stands of Taxodium distichum also exist along the NWL and waterward in
many areas. Inland wetland areas also include Taxodium d. as well as other wetland hardwood species. No
coastal wetland vegetation was observed along proposed bulkhead portions of Edenton Bay.
Existing shoreline structures include several hundred feet of bulkhead and one 75ft. long pier.
Proposed Work
The applicant proposes to develop a 610 acre subdivision adjacent to Edenton Bay, consisting of a golf
course, club house facilities and 602 associated residential lots. Water dependent development will include
some 5600 ft. of wooden bulkhead/shoreline stabilization and four piers to provide water access for the
interior subdivision lots. Each of these proposed piers will be a maximum length and width of 200 ft. by 6
ft. and include a 500 sf. maximum size gazebo at the end of each pier. One of these four pier will be
constructed at the site of the existing pier referenced above. The applicant also proposes to construct 3
wooden elevated golf cart paths across US COE jurisdictional wetlands as well as hand cut some other US
COE wetlands to facilitate play at the proposed golf course. The proposed golf course will include a
collection and drainage system to collect all runoff to prevent any discharge of golf course chemicals into
any adjacent wetlands or public trust waters. In addition, several ponds will be constructed from upland
areas to facilitate site drainage.
Anticipated Impacts
The proposed work will not directly impact any Coastal Wetlands. The proposed bulkhead construction will
impact 44,835 sf. of Estuarine/Public Trust Waters and 5,605 sf. of Estuarine Shoreline. This proposed
shoreline stabilization work may cause a temporary increase in turbidity in adjacent waters; however, due
to the high erosion rate and high embankment exposed to erosion, stabilization of this shoreline will
certainly reduce erosion and sedimentation in the long run in these adjacent waters.
The proposed pier and gazebo construction will also shade 6,800 sf. of Estuarine/Public Trust Waters. The
proposed development will also shade 9,000 sf. of US CaE jurisdictional freshwater wetlands.

A review of the Chowan County Land-Use Plan in regard to this permit application will be sent under
different correspondence.

ADDENDUM TO THE PERMITS APPLICATION
FOR
EDENTON SAY PLANTATION
SECTION 3(a)
The development proposed in the application is for the construction of a residential
community and golf course on 610 acres of land in the Town of Edenton is exterritorial
jurisdiction and Chowan County. Of the 610 acres, approximately 100 acres are
wetlands under the jurisdiction of the U. S. Army Corps of Engineers and have been
delineated and verified. Proposed are the construction of 602 single family residents,
golf club house, golf course maintenance building, tennis and swimming pool dressing
rooms and attendant stations, tennis courts, one swimming pool, seven gazebos (four
of which will be along the water and three in interior locations), golf cart bridges
crossing wetlands which in three locations, and two nature observation decks. A
bulkhead is proposed to be constructed along the shoreline and will average 8 feet
waterward of the normal water level. No bulkheading is proposed along the shoreline
which is considered wetland jurisdiction. Along approximately 700 feet of the shoreline
an unusual high bank exists which will require the bulkhead to be placed an average of
15 feet waterward of normal water level in order to establish an alignment which will not
result in unnecessary grading of the shoreline in order to stabilize this area. The
remaining 4,905 linear feet of that will be bulkheaded will average 7 feet waterward of
normal water level. One 6 foot wide pier which will not exceed 200 feet in length is
proposed in the common area and will have T-head which will not exceed 500 square
feet. Only one area of wetlands will be filled to facilitate this plan and that will be a
minor road crossing and is shown in the detail attached. Selected areas of wetlands
will be cleared in order for golf playover at fairways as indicated on the plat, and
elevated golf carts will be used to access the fairways and greens which cross the
wetland areas.
SECTION 3(d)
The purpose of the proposal is to stabilize the shoreline for the construction of a
residential golf community which will be constructed in phases. Although we are
depicting the entire subdivision development in the applications, specific applications
for waste water treatment, potable water, sedimentation and erosion control and storm
water control will be presented in phases so that these particular areas can be
engineered to incorporate the overall development proposal.
