to serve area annexed by the City o Concord.

CARRIED OUT IN WETLANDS. ALSO, NOTE MEASURES TAKEN TO MINIMIZE WETLAND
IMPACTS. Project runs parallel to a branch in the drainage basin to be served
with sanitary sesewer. Also, Irish Buffalo Creek.will need to be crossed
to access existin sewer.. Original contours will be maintained upon line
installation and areas will not be filled.

A NARRATIVE DESCRIPTION OF THE PROJECT
MT. HERMON SANITARY SEWER
This project consists of the installation of approximately
3,362 +/- linear feet of 8" PVC and DIP sanitary sewer outfall
along with appurtenances and other associated project work to
install a public sanitary sewer extension in the Mt. Hermon
Lutheran Church community area of the City of Concord.
The effective area of ground disturbance is 4.55 acres based
upon an average construction width of 50 feet (maximum) disturbed
by the installation of this linealong with approximately 1,000
feet of 30 ft. wide construction access. The work shall proceed
in such a manner as to limit the amount of ground disturbance by
having only one section of the ditch open at a time thereby
reducing the potential for large quantities of sediment to be
transported off site. Seeding of denuded areas shall be done as
soon as possible, but in no case longer than 30 days and in
accordance with the specifications given in the plans. Removal
of all sedimentation and erosion control devices shall only be
done after approval has been coordinated with the NCDEHNR -
Division of Land Resources and the City of Concord.
Location and protection of all utilities in the work area shall
be the sole responsibility of the Contractor (see note below).
Please note that this project crosses an underground fiber optic
cable.
All traffic control and safety shall be the responsibility of
the contractor and shall be conducted in strict accordance with
the latest revision of Part IV of the M.U.T.C.D., NCDOT, OSHA
and all other local, state and federal regulations. Completion
of this project is anticipated to take 120 days after notice by
the City of Concord to proceed. Final completion and acceptance
of the work is anticipated to be MAY 30, 1996.

APPROVAL of 401 Water Quality Certification

Dear Mr. Lowder:
You have our approval to place fill material in 2.0 acres of wetlands or waters for the purpose of
constructing the Mt. Hermon Church outfall near the intersection of US 601 and NC 49, as you
described in your application dated 9 January 1996 . After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 3022. This
certification allows you to use Nationwide Permit Number 12 when it is issued by the Corps of
Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to seed us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the (late that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section
401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733-
