Dear Mr. Taylor.
You have our approval to dredge in 1.54 acres of waters for the purpose of conducting maintenance
dredging at canals between Laurinburg and Concord Streets in Ocean Isle Beach, as you described in your
application dated 16 July 1996. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 3025.
This approval is only valid for the purpose and design that you described in your application except as
modified below. If you change your project, you must notify us and you may be required to send us a new
application. For this approval to be valid, you must follow the conditions listed in the attached certification
and any additional conditions listed below. The return water from the upland diked disposal basin shall be
discharged back into the canal that is to be dredged. In addition, you should get any other federal, state or local
permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control,
Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing.
You must act within 60 days of the date. that you receive this letter. To ask for a hearing, send a written
petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of
Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions
are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean water

Per the applicants plans, the discharge from the diked disposal area resulting from the hydraulic
dredging of the canals should be returned to similar waters, i.e., closed shellfishing waters. The
applicant states on the plans that the discharge will be returned to the canals being dredged. This
condition should included in the CAMA Permit.

8. PROJECT SUMMARY: The applicant wishes to obtain a permit for maintenance excavation
of the four existing canals, between Laurinburg and Concord streets, and proposes, initially,
to complete maintenance dredging in at the entrances of the four existing canals. The canals are
approximately 2500 feet long and the channel width is 40 feet. The Town is proposing to
complete maintenance excavation of the northern 320-400 feet of the canals and the connecting
channels to the AIWW, in conjunction with work to be completed under State Permit 59-96.

9. PROTECT DESCRIPTION
The project site consists of four (4) existing canals which connect to the AIWW, on the north side of
Ocean Isle Beach, between Laurinburg and Concord streets. The canals are approximately 2500 feet
long and 100 feet wide, and provide water access for adjacent residential development. Most of the lots
adjoining the canal system are currently developed with single-family residences, and the majority of
the shoreline is stabilized with a individual wooden bulkheads on each lot. Along the shoreline of the
canals, there is a border of coastal wetland vegetation, varying from 0 to 20 feet in wwidth. It is
primarily Smooth Cordgrass (Spartina alternifloral, but some high marsh species were observed in the
transition slope to highground on lots without bulkheads. These include: Sea Lavender(Limonium, spp.),
Saltwart (Salicornia, spp.), Spike Grass (Distichlis apicata), and Salt Meadow Grass (Spartina patens).
The Atlantic Intracoastal Waterway is approximately 550 feet wide in the project area
and the waters are classified SA by the N. C. Carolina Division of Environmental Management. The
waters inside the canal system are Closed to shellfishing, however, once outside the plane across the
access channels, the waters of the AIWW are OPEN to shellfish harvest. The N. C. Division of Marine
Fisheries does not consider the project area as primary nursery area.
For maintenance purposes, the applicant proposes a 40 ft. wide channel, 6 ft. deep at MLW, in the
center of the four existing canals, which accumulatively total, 9600 feet in length (2400 ft. ea.).
Currently, the canal system has adequate water depth (4-6 ft. @ MLW) for navigation during all tide
stages, however , the mouths of the access channels are beginning to narrow as a result of shoaling. The
Town of Ocean Isle Beach is proposing to complete maintenance excavation of the northern 250 - 300
feet of the canals and the connecting channels to the AIWW, in conjunction with work to be completed
this fall, under State Permit 59-96. The Town is requesting to flair the AIWW end of the channels,
from 40 feet, to 80 feet, over the last 100 feet of the access channel, in an effort to control the shoaling
problem. Although the applicant is requesting maintenance dredging for the entire length of the acc°,ss
canals, given the existing water depths, initial work by the Town would be limited to the shoaled area
at the northern end of the canals (varies 320-400 ft.) and waterway portions of the channels. The Town
estimates that the proposed maintenance excavation and flair expansion would create approximately 6000
cubic yards of spoil material. The project would be completed using a hydraulic dredge and spoil
material would be placed in an existing diked area, approximately 1/4 mile east of the project. The
portion of the existing spoils disposal area to be used for the project measures approximately 380 feet
square, with approximately 8 feet of depth available for spoils disposal inside the diked area.
10. ANTICIPATED IMPACTS
The proposed project would disturb approximately 67,200 square feet of shallow water bottom. Of that
total. approximately 10,400 square feet would consist of previously undredged bottom. There would be
144,400 square feet of highground disturbance within the existing spoils disposal area. There would be
some short-term turbidity and siltation associated with the dredging
project. Provided the project is timed to avoid periods of peak biological activity, and that there is no
significant shellfish resource located in the previously undredged area, no long term adverse impacts
are anticipated from the dredging activity.

Enclosed is the application of the Town of Ocean Isle Beach for
Department of the Army authorization and a State Water Quality Certification
to maintenance dredge approximately, 67,200 square feet of material from four
existing canals, each 250 feet long by 40 feet wide, off the Intracoastal
Waterway, between Laurinburg and Concord Streets, in Ocean Isle Beach,
Brunswick County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with Section
325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
According to our administrative regulations, 60 days is reasonable for
State action. Therefore, if you have not acted on the request, or asked for an
extension of time, by September 27, 1996, the District Engineer will deem that
waiver has occurred.

U.S. Army Corps of Engineers disposal area located north of Cumberland, Goldsboro,
and Lee Streets in Ocean Isle Beach, North Carolina, along the Atlantic Intracoastal M ;
Waterway, for deposition of 47,000 cubic yards of dredged material.
You may, ui' this 'site if you obtain the proper permits, maintain the dikes and
spillways through ut dewatering, and continue your procedure of regularly removing
material from flip disposal area without disturbing the dikes.
