After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3025. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. PROJECT SUMMARY: Applicant proposes to open canoe and small boat rental business on Town Creek with docking facilities, boat ramp and elevated walkways. PROTECT DESCRIPTION The project site is located off Hwy 17 South on the northern side of Town Creek bridge near Winnabow in Brunswick County, NC. It is approximately 11 miles south of Wilmington. The site is a 3.12 acre lot previously used as a fish camp in the early 1900's as exemplified by the concrete remnants of pits which were used for cooking fish. The lot consists mostly of mesophytic forest type vegetation with an upland area of approximately 0.82 acres surrounded almost entirely by 2.30 acres of federal wetlands. The lot borders Town Creek on it's southern and western boundaries, Hwy 17 on it's eastern boundary and the property of D. Lewis on it's northern boundary. No coastal wetland vegetation was observed on the lot. The waters of Town Creek are inland waters classified as Class C swamp waters by the Division of Environmental Management. It is not a primary nursery area and there are no commercial shellfish resources. The width of the section of Town Creek adjacent to the lot ranges from 70 ft. to 150 ft. The applicant proposes to relocate an already purchased 14' X 40' building on the upland portion of the lot which will be used as a pottery studio and canoe and small boat rental pending septic approval. Two toilets are proposed for the relocated building. He then plans to attach a permeable, elevated deck to the waterward side of the structure. The attached deck will extend over federal wetlands. The applicant has also already purchased two floating docks (6' X 107' and 6' X 58') which he plans to place in Town Creek by anchoring to existing shoreline trees along the southern and western boundaries of the lot. The applicant then plans to bridge the floating docks to the upland with two 4' wide ramps. Twelve docking slips along the floating docks for small boats (20 ft. or less) and\or canoes are proposed with no intentions for fuel handling facilities nor overboard discharge of sewage. In an unvegetated area between the two floating docks the applicant proposes a 12 ft wide oyster shell boat ramp. Along the northwest boundary of the lot, the applicant proposes to construct a 5 ft wide elevated walkway to be used as a nature trail beginning on the upland portion of the lot and extending approximately 240 ft, running parallel to the creek over federal wetlands, ending in a 6' X 12' deck also over federal wetlands where Town Creek and Dead Creek intersect. The applicant proposes to avoid the destruction of all trees during and after the construction of the walkway and deck. All other wetlands on the lot are proposed to be left undisturbed except an eastern stretch between Hwy 17 and the upland area of the lot. The applicant proposes to fill this 13,050 sq.ft.(0.3 acre) area to an elevation equal to the upland area which he then plans to use for parking. The applicant contends that this stretch of wetlands are manmade, created by a depression resulting from construction of adjacent Hwy 17 by the Division of Highways. 10. ANTICIPATED IMPACTS The floating docks will incorporate 990 sq. ft. of public trust waters. There should be little turbidity associated with the installation of the floating docks since they will be anchored to existing trees and will not involve the placement of pilings. Based on the width and depth of Town Creek adjacent to the project site, the floating docks would appear to present minimal navigational concerns. The relocated building will be located entirely on the upland and should have minimal impact on wetlands, but the attached deck impact some federal wetlands due to shading and placement of pilings. As proposed the project will cause the filling of approximately 13,050 sq. ft.(0.3 acres) of federal wetlands. If allowed, the wetland area between Hwy 17 and Town Creek will be reduced which will result in a smaller area to filter sediments and runoff from the highway. More runoff may also result from the adjacent area being converted to parking area. It could not be clearly determined if the applicant's contention that the wetlands that he is proposing to fill are manmade was accurate. Regardless, the wetlands appeared to be functional and serving as a buffer to improve water quality. Submitted by: Jerry A. If the applicant is not claiming to be the owner of said property, then forward a copy of the deed or other instrument under which the owner claims title, plus written permission from the owner to carry out the project. • An accurate, dated work plat (including plan view and cross-sectional drawings) drawn to scale in black ink on an 8 1/2" by 11" white paper. (Refer to Coastal Resources Commission Rule 7J.0203 for a detailed description.) Please note that original drawings are preferred and only high quality copies will be accepted. Blue-line prints or other larger plats are acceptable only if an adequate number of quality copies are provided by applicant. Your receipt of this letter verifies your acceptance of a valid request for certification in accordance with Section 325.2(b)(ii) of our administrative regulations. We are considering authorizing the proposed activity pursuant to Section 404 of the Clean Water Act, and we have determined that a water quality certification is required under the provisions of Section 401 of the same law. A Department of the Army permit will not be granted until the certification has been obtained or waived. According to our administrative regulations, 60 days is reasonable for State action. Therefore, if you have not acted on the request, or asked for an extension of time, by May 10, 1996, the District Engineer will deem that waiver has occurred.
