After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional written approval is needed from DEM for the proposed stormwater pond. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Wilson, PE Assistant Manager TRW:br Division of Environmental Management Ecological Assessment Group April 17, 1995 To: John Domey From: Steven Kroeger Sr Subject: PYA/Monarch Inc. -- Zebulon Distribution Center (DEM #95369) I visited the site for this project on Thursday, April 13, 1995 and assessed the impacts this project may have on water quality. (The site was visited the morning after 1.0+ inches of rain was recorded at the RDU airport -- the first significant amount of precipitation in a few weeks.) Most of the site (northern portion) is abandoned agricultural fields in a very early state of succession. On the property there are two created impoundments. The largest one (0.7 acres), near NC 39, will be destroyed, the smaller one (0.45 acres), near the eastern property line, will not be impacted. The large pond was created by a berm. This 'berm represents about one-half of the border of the pond. There is a narrow band of red maple, sweet gum and lobolly pine around the pond; and a small area of willows occurred in the northwest corner. This pond was inhabited by a large population of frogs (species unknown). The most important use of this pond is habitat for amphibians. The pond is able to treat some stormwater runoff from the adjacent agricultural field, but the volume of runoff treated by the pond is small. There is one small (0.09 acres) natural wetland located north of the railroad tracks. This wetland occurs in the drainage system for the property. Tree canopy consisted mainly of lobolly pine and red maple, herbaceous ground cover was jewelweed (Impatiens spp. -- FACW). No significant water quality uses were identified with this small intermittent drainageway. The most notable water quality impact will be the removal of the large (0.7 acre) pond. The applicant proposes to provide a wet stormwater retention basin. This basin could replace the uses provided by the large pond. The portion of the property south of the railroad tracks is a riparian bottomland hardwood forest next to a tributary of Moccasin Creek. No alteration of this portion of the property is planned. I recommend that the permit application be approved. However, the design of the stormwater retention basin should be reviewed.
