You have our approval to place fill material in 1.1 acres of wetlands or waters for the purpose of
residential and commercial development at NC24 and SR1447, as you described in your application
dated 19 October 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Number 2671. This certification allows you to use Nationwide
Permit Number 26 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. A
stormwater management plan is required by DEM for the commercial development before construction
begins in the commercial area. The use of existing wetland "A" should be investigated to partially
treat the stormwater. In addition, you should get any other federal, state or local permits before you
go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicator-
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

With reference to your letter dated October 4, 1995, to Gary Mitchell, requesting
additional information on the 28 acre tract in Swansboro, attached is the 'Preliminary Plan'
showing the lot locations, commercial/residential development and the wetlands. The
stormwater pond for the commercial development has not yet been designed. Also, it is
my understanding that Gary is handling the verification of the jurisdictional wetlands
determination.

The Division of Environmental Management has reviewed your submittal for a 404 permit to fill 1.1
acres of wetlands near Swansboro in Onslow County. After a site visit was conducted by Mr. Eric Galamb and
Mr. Pete Colwell of our Central Office, it has been determined that the following information is needed to
complete the review of your application:
Verification of the jurisdictional wetlands determination by the U.S. Army Corps of Engineers.
2. Accurate mapping of the subdivision plans showing the lot locations, commercial/residential
development and the wetlands.
3. Location and design of stormwater pond for the commercial development.
This information is needed by DEM in order for us to decide whether this project is practicable.
I can be reached at 733-1786 if you have any question. Until this information is received, I will request
(by copy of this letter) that the Corps of Engineers place this project on hold.

representing J&D Properties, L.L.C., to submit a Department of the Army
Nationwide Permit Application to place fill material within approximately 1.1
acres of Section 404 isolated wetlands. The proposed project site is located off
S.R. 1447 and N.C. Hwy 24, near the town of Swansboro, Onslow County,
North Carolina.
The purpose of the proposed fill in wetlands is to facilitate the
construction of a commercial and residential development. The majority of the
facility will be located in uplands, however, there are some isolated wetland
pockets which must be impacted in order for the proposed facility to be
developed.
The applicant has considered other alternatives to placement of fill
material within wetlands to accomplish their project goal, however, the
proposed plan is the only practicable alternative available. Considering the
density requirements needed in order to make the development an
economically viable one, other alternatives considered were not practicable,
significantly more expensive to the applicant, and involved even greater
wetland impacts. The project has been designed to avoid and minimize
potential adverse impacts to other wetland areas, including the augmentation
of a 30-ft. vegetative buffer along the western property line. No land or
existing vegetation within this buffer will be disturbed, both during and after
implementation of the proposed project. Additional measures will be
undertaken to maintain the work in strict conformance with all permit
conditions pursuant to Nationwide Permit No. 26, as well as all other state and
local requirements.

Certification for filling wetlands associated with
commercial/residential development, at junction of
U.S. Hwy 24 and S.R. 1447, Swansboro, Onslow
County, North Carolina. DEM ID: 95933.
The Wildlife Resources Commission has reviewed the
subject permit application. A site visit was made on
September 26, 1995. Our comments are provided in accordance
with provisions of the Fish and Wildlife Coordination Act
(48 Stat. 401, as amended; 16 U.S.C. 661 et. seq.).
The applicanL has applied for Water Quality
Certification to fill a total of 1.1 acres of wetlands. The
project's purpose is to develop a commercial and/or
residential property on a predominantly wooded site. Three
wetland areas occur on the property. Wetland "B" (0.531
acre) and wetland "C" (0.086 acre) are isolated pockets in
or adjacent to a pine plantation. Wetland "A" (0.518 acre),
however, appears to be part of a larger and much more mature
wetland system. Wetland "A" supports old-growth red maple
and sweetgum, several dead snags, and an understory of fern
and common reed. Wetland "A" provides excellent habitat for
raptors, woodpeckers, woodcock, songbirds, raccoon, and
oppossum. Deer tracks were observed throughout the project

Mature hardwood wetland habitat such as that provided
by wetland "A" is becoming increasingly rare in North
Carolina. Once developed, the project will induce greater
stormwater runoff from the site. Wetland "A"'s location in
the southwest corner of the property and its storage
capacity should make it a suitable receptacle for stormwater
leaving the project. We think there is good potential for
both preserving wetland "A" and using it to store and filter
runoff. We recommend that the project be so modified.
