After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2733. These certifications allow you to use Nationwide Permit Numbers 14 and 18 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to-Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Description of proposed work (Attach PLANS-8 1/2" drawings only): Fill associated with an access road and residential dwelling is proposed for the site See Attachment A 13. Purpose of proposed work: To allow property owner access to existing upland and allow the construction of a private residential dwelling. 14. State reasons why the applicant believes that this activity must be carried out in wetlands. Also, note measures taken to minimize wetland impacts. Lot #3 is approximately 0.48 acre. Increased building are limitations could deprive the lot of its potential value Adjacent lots found on similar soils and in a similar topographic setting have already been disturbed/developed Fill (approximately 1.350 square feet) is proposed to provide access to the upland portion of the lot Fill for this access is proposed as a driveway between the existing upland and Windjammer Drive Although there does not appear to be any surface flow of water in the vicinity of the wetland near the road a culvert may be installed to allow the movement of any high water. In recognition of the value of wetlands and the regulations protecting them the wetlands between the existing upland and coastal marshes of Topsail Sound will not be filled The avoidance of fill between the existing upland and sound should allow any functions associated with these wetlands to remain unchanged. Proposed fill on the lot has been minimized to affect only a small portion (4,984 total square feet) of lower quality wetlands between the existing disturbed lots and paved Windjammer Drive. 15. You are required to contact the U.S. Fish and Wildlife Service (USFWS) and/or National Marine fisheries Service (NMFS) regarding the presence or any Federally listed or proposed for listing endangered or threatened species or critical habitat in the permit area that may be affected by the proposed project. If the proposed project will be removing pines greater than or equal to 30 years of age in pine or pine/hardwood habitat, surveys should be conducted for active red-cockaded woodpecker cavity trees in appropriate habitat within a 1/2 mile radius of project boundaries. If red-cockaded woodpeckers are observed within the project area or active cavity trees found, the project has the potential to adversely affect the red-cockaded woodpecker, and you should contact this office for further information. The Service concurs that the proposed project is not likely to adversely affect Federally-listed endangered or threatened species, their formally designated critical habitat, or species currently proposed for Federal listing under the Endangered Species Act, as amended.
