Subject: Nationwide 401 Permit Application for Mary Quay and Lynda de Nijs (Agent),
310 Hodges St., Oriental, Pamlico County, North Carolina. (Project # 95018)
Staff biologists with the Wildlife Resources Commission have reviewed the project and
associated impacts on wildlife and fishery resources in the area. An onsite investigation was
conducted on February 1, 1995 Our comments are provided in accordance with provisions of the
Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.) and Section
401 of the Clean Water Act (as amended) and North Carolina General Statutes (G.S. 113-131 et
seq.).
The applicant is proposing to fill a water/rubble filled depression created by the removal
of an old building. This area is adjacent to Raccoon Creek and coastal marsh habitat borders a
significant portion of the area. There was some confusion with the application which stated that
up to 0.5 acres were to be filled. If 0.5 acres were allowed to be filled the majority would consist
of coastal marsh habitat. However, after discussion with the agent during our site visit, the area
to be filled would not involve any coastal marsh habitat, and the area to be filled should be
significantly less than 0.5 acres.
Therefore, we would not object to the project provided the fill area is limited to only the
water/rubble filled depression and does not include any of the coastal marsh habitat. This area
should be less than 0.2 acre.

On 31 December 1994 you wrote to the Division of Environmental Management requesting a
401 Water Quality Certification for your project to fill wetlands for fill of lot # 308 (next to 310
Hodges Street in Oriental in Pamlico County. We have been informed by the N.C. Division of
Coastal Management that this project will require a Permit from the N.C. Division of Coastal
Management. We cannot continue to process your application until the Division of Coastal
Management (DCM) begins the permitting process. Therefore I must hereby place this project on
indefinite hold until you and the Division of Coastal Management gather the necessary information to
develop an acceptable DCM permit application. Also by copy of this letter, I am also notifying the
U.S. Army Corps of Engineers that this project will need processing by the Division of Coastal
Management.
If you believe that this decision is in error, please call me at 919-733-1786 to discuss the
matter.
