After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification,. you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter. 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. Reference is also made to my letter of October 17, 1994, that verified your wetlands survey showing a total of 11.10 acres of waters and wetlands at the referenced, proposed pond site. Uwharrie River and a smaller, second pond on an unnamed tributary to the Little Uwharrie River. Previous site inspections and plan review reveals that adverse impacts to wetlands associated with your proposed construction are located in the upper reaches, and above the headwaters, of the project streams. We understand that this plan was developed to avoid and minimize impacts to downstream wetland areas associated with the backwater marshes and bottomland hardwoods of the existing Wheatmore Pond. Our review of the plans furnished with your request shows that you propose to construct two ponds at the site with the larger pond at a reviously authorized site (authorization dated March 30 1993) on the Little p , For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Dept. of EHNR JAIL! 05 *95 Winston-Salem RegiOn f 1'.I; v,, John Dorney: January 17, 1995 SUBJECT: Steeplegate Dam & Pond 401 Certification This area rates very good on the wetlands rating sheet and is, in fact, a nice wetland area. The pond and dam location has been moved back from the original plans to save some of the wetlands and it appears that the pond has been properly planned. Mr. Loflin is using the pond and surrounding natural areas as a selling point for his properties with certain buffer restrictions and access restrictions (such as no motor boats). From a water quality and aquatic wildlife standpoint, the pond should be a plus. The only restriction that needs to be included in the permit is the following: The overflow from the pond needs to be spread out or dissipated over a wide enough area to an extent that stream flow is not drastically impeded on the left side of the dam (area 1 on the attached map) and the wetlands are not dried out on the right side of the dam (area 2 on the map).
