Enclosed is the application of Fidelity Worldwide Investment, represented
by Mr. Ed Flynn, F&S Marine Contractors, Incorporated, for Department of the
Army authorization and a State Water Quality Certification to excavate a
basin, construct a dock and boatlift structure and construct and backfill a
bulkhead on Cedar Island Boat Basin, off the Atlantic Intracoastal Waterway
(AIWW), near Wilmington, New Hanover County, North Carolina. Your receipt of
this letter verifies your acceptance of a valid request for certification in
accordance with Section 325.2(b)(ii) of our administrative regulations.
We are considering authorizing the proposed activity pursuant to Section
404 of the Clean Water Act, and we have determined that a water quality
certification is required under the provisions of Section 401 of the same law.
A Department of the Army permit will not be granted until the certification
has been obtained or waived.
In accordance with our administrative regulations, in most cases, 60 days
after receipt of a request for certification is a reasonable time for State
action. Therefore, if you have not acted on the request, or asked for an
extension of time, by May 22, 1995, the District Engineer will deem that
waiver has occurred.

approval for development of your property located at 6420 Quail Run Rd. in Wilmington, North
Carolina. It was received completed on 2/17/95, and appears to be adequate for processing at this time.
The projected deadline for making a decision is 05/03/95. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If You have not been notified of
a final action by the initial deadline stated above, you should consider the review period extended.
Under those circumstances, this letter will serve as your notice of an extended review. However, an

NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous
point along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property;

9. PROJECT DESCRIPTION 2/27/95
The project site is located within the Cedar Island Boat Basin on the mainland side at 6420 Quail
Run Road. This is off of SR 1513 in New Hanover County. This is a residential area, with
home sites averaging 4 to 7 acres each. The applicant's property is 6.68 acres in size, and
averages 6' in elevation. There is presently a single family residence, enclosed pool, tennis
courts, bulkhead, and floating dock on the property. The property fronts the Cedar Island Boat
Basin, a man-made basin that empties into Hewlett's-Creek at its mouth. The property has the
remnants of an old basin about midway along the shoreline. The shoreline is stabilized with a
bulkhead from the southern side up to this feature. From this feature northward, there is no
bulkhead, but a fringe of coastal marsh. The escarpment is approximately 4' in elevation. The
property ends at a drainage seep separating it from the neighboring property to the north.
Hewlett's Creek is classified SA by the Division of Environmental Management. Masonboro
Sound is classified SA-ORW at this location. According to the writt en specifications delineating
the Masonboro Sound ORW Area, the island is ORW, and by proximity, the waters behind the
island would also be classified as ORW. Hewlett's Creek is a designated Primary Nursery area.
The creek is closed to the taking of shellfish from about midway into the mouth landward. It
has recently been temporarily closed for the remainder. The basin entrance to the creek is on
the AIWW side of the closure line, and therefore, remains open to shellfishing. New Hanover
County classifies the area as Conservation.
The applicant proposes the excavation of a basin at the location of a depression into the bank
that appears to be from an old basin. This depression is approximately 12' x 12'. Dredging
would cut into the bank around this depression for 30' landward and 35' in width. The cut
would continue for another 28' to connect to the channel in the Cedar Island Boat Basin.
Soundings in the proposed basin area currently average +2.5' mlw to -5' mlw. The high
ground is from 4' to 6' in elevation. Square footage of the excavated area is approximately
1742, with the removal of approximately 451 cubic yards of material. Approximately one half
of this will be removed from high ground, and one half from shallow bottom.
The applicant proposes the placement of a 6' x 24' float within the newly created basin, with
a 14' x 14' boatlift on its north side. The boatlift would be covered, and with the float would
incorporate approximately 504 square feet of Public Trust Area within the man-made basin. The
structures would extend approximately 8' into the Cedar Island Boat Basin proper. The
applicant would stabilize the boat basin with approximately 105 linear feet of,bulkheading. The
project would provide 2 mooring spaces. The applicant currently has a 60' float along his
shoreline, providing 2-3 slips.
The excavation is to be accomplished by excavator, and placed into a truck to be dried in a 50'
x 50' diked area constructed 200'+ from the water on this same property. The spoil should not
contain substantial amounts of water due to the method of excavation and the trucking of the
material to the spoil site. However, because the dimensions of the spoil area are only sufficient
to contain the amount excavated when dried, it may need to be enlarged. There is ample room
on the property for this if necessary. There are at least three other man-made basins opening
into the Cedar Island Boat Basin.
IQ. ANTICIPATED IMPACTS
This project could have been accomplished under a General Permit except for the fact that the
high ground basin was to connect to a Primary Nursery Area. The excavation will disturb
approximately 1116 square feet of previously dredged shallow bottom area, and approximately
626 square feet of high ground. This will remove approximately 225 cubic yards of material
from each system, or a total of 451 cubic yards. The placement of the material will cause the
fill of approximately 2500 square feet of high ground. The covered boatlift and float will
incorporate approximately 504 square feet of Public Trust Area. The bulkhead will stabilize the
newly disturbed shoreline, and will cause temporary disturbance of the area behind the wall.
The basin does connect to a Primary Nursery Area, but it does so only after passing through
another larger manmade basin. This area has a 4' tidal amplitude, and has shown no tendency
toward stagnation or water quality problems in the past. Water enters this basin from the tidal
marsh on the north side, opening under the bridge to the island, as well as from the opening to
Hewlett's Creek.

9. PROJECT DESCRIPTION 2/27/95
The project site is located within the Cedar Island Boat Basin on the mainland side at 6420 Quail
Run Road. This is off of SR 1513 in New Hanover County. This is a residential area, with
home sites averaging 4 to 7 acres each. The applicant's property is 6.68 acres in size, and
averages 6' in elevation. There is presently a single family residence, enclosed pool, tennis
courts, bulkhead, and floating dock on the property. The property fronts the Cedar Island Boat
Basin, a man-made basin that empties into Hewlett's Creek at its mouth. The property has the
remnants of an old basin about midway along the shoreline. The shoreline is stabilized with a
bulkhead from the southern side up to this feature. From this feature northward, there is no
bulkhead, but a fringe of coastal marsh. The escarpment is approximately 4' in elevation. The
property ends at a drainage seep separating it from the neighboring property to the north.
Hewlett's Creek is classified SA by the Division of Environmental Management. Masonboro
Sound is classified SA-ORW at this location. According to the written specifications delineating
the Masonboro Sound ORW Area, the island is ORW, and by proximity, the waters behind the
island would also be classified as ORW. Hewlett's Creek is a designated Primary Nursery area.
The creek is closed to the taking of shellfish from about midway into the mouth landward. It
has recently been temporarily closed for the remainder. The basin entrance to the creek is on
the AIWW side of the closure line, and therefore, remains open to shellfishing. New Hanover
County classifies the area as Conservation.
The applicant proposes the excavation of a basin at the location of a depression into the bank
that appears to be from an old basin. This depression is approximately 12' x 12'. Dredging
would cut into the bank around this depression for 30' landward and 35' in width. The cut
would continue for another 28' to connect to the channel in the Cedar Island Boat Basin.
Soundings in the proposed basin area currently average +2.5' mlw to -5' mlw. The high
ground is from 4' to 6' in elevation. Square footage of the excavated area is approximately
1742, with the removal of approximately 451 cubic yards of material. Approximately one half
of this will be removed from high ground, and one half from shallow bottom.
The applicant proposes the placement of a 6' x 24' float within the"newly created basin, with
a 14' x 14' boatlift on its north side. The boatlift would be covered, and with the float would
incorporate approximately 504 square feet of Public Trust Area within the man-made basin. The
structures would extend approximately 8' into the Cedar Island Boat Basin proper. The
applicant would stabilize the boat basin with approximately 105 linear feet of bulkheading. The
project would provide 2 mooring spaces. The applicant currently has a 60' float along his
shoreline, providing 2-3 slips.
The excavation is to be accomplished by excavator, and placed into a truck to be dried in a 50'
x 50' diked area constructed 200'+ from the water on this same property. The spoil should not
contain substantial amounts of water due to the method of excavation and the trucking of the
material to the spoil site. However, because the dimensions of the spoil area are only sufficient
to contain the amount excavated when dried, it may need to be enlarged. There is ample room
on the property for this if necessary. There are at least three other man-made basins opening
into the Cedar Island Boat Basin.
10. ANTICIPATED IMPACTS
This project could have been accomplished under a General Permit except for the fact that the
high ground basin was to connect to a Primary Nursery Area. The excavation will disturb
approximately 1116 square feet of previously dredged shallow bottom area, and approximately
626 square feet of high ground. This will remove approximately 225 cubic yards of material
from each system, or atotal of 451 cubic yards. The placement of the material will cause the
fill of approximately 2500 square feet of high ground. The covered boatlift and float will
incorporate approximately 504 square feet of Public Trust Area. The bulkhead will stabilize the
newly disturbed shoreline, and will cause temporary disturbance of the area behind the wall.
The basin does connect to a Primary Nursery Area, but it does so only after passing through
another larger manmade basin. This area has a 4' tidal amplitude, and has shown no tendency
toward stagnation or water quality problems in the past. Water enters this basin from the tidal
marsh on the north side, opening under the bridge to the island, as well as from the opening to
Hewlett's Creek.
