Nationwide 14 area remains at 0.38 acres whereas Nationwide 26 is reduced to 0.71 acres (from 1.98 Ac). Total permit area will be 1.09 Acres (from 1.98 Ac). The stormwater plan has already been approved for this project using grassed swales. I am encouraging the developer to consider directing swales into the two remaining wetlands as we discussed. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Numbers 2732 and 2671. These certifications allow you to use Nationwide Permit Numbers 14 and 26 when they are issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. If possible stormwater should be directed to flow into wetlands remaining on the site. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. DATE: January 19, 1995 SUBJECT: Old South, Inc. 401 Water Quality Certification request for residential development in wetland parcels off SR 1492, Wilmington, New Hanover County, North Carolina. DEM ID: 941132. Staff biologists with the Wildlife Resources Commission have reviewed the subject request for certification. A site visit was made on January 11, 1995. Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination Act (48 stat. 401, as amended; 16 U.S.C. 661 et seq.), and section 401(b) of the Clean Water Act of 1977 (as amended), and North Carolina General Statutes (G.S. 113-131 et seq.). The applicant has applied for Water Quality Certification to fill a total of 2.36 acres of wetlands for construction of residences and roads. Project construction was underway at the time of our site visit, but no erosion control measures were evident. The wetland acreage is in 3 parcels. A 0.52 acre parcel near a remnant ditch occurs in the southeast corner of the tract and is vegetated with sweetgum, water oak, red maple, black gum, loblolly pine, gallberry and American holly. Just west of this parcel, a 1.07 acre wetland has been bisected by a road. Standing water occurs in remaining wetlands on the south side of the road and vegetation includes wax myrtle, black gum, red maple, sweet gum and greenbriar. The third wetland, a 0.71 acre parcel, occurs in the northwestern corner of the property and is vegetated with water oak, bay, red maple, sweet gum, loblolly pine, tulip poplar, common reed, gallberry and greenbriar. A small stream flows through this wetland, indicating a hydraulic connection to Greenville Sound. They also provide habitat suitable for use by woodcock, raccoon, rabbit, opossum, amphibians and various songbirds. To reduce the extent of wetland loss and resulting adverse impacts to wildlife habitat and water quality, we recommend that certification be conditioned upon the following project modifications: 1. Avoid filling the 0.71 acre wetland (with stream) in the northwestern corner of the property. 2. Avoid filling the section of the 1.07 acre wetland on the south side of the road. 3. Fill only that portion of the 0.52 acre wetland necessary for house and driveway construction on lot # 140. 4. Implement an erosion control plan immediately. Based on this review, we have identified significant uses which would be removed by this project. These uses are water storage, pollutant removal, wildlife habitat and aquatic life habitat. Furthermore, insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or. wetlands. Therefore, we are moving toward denial of your 401 Certification as required by 15A NCAC 2B.0109. Until we receive additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of Engineers and/or the N.C. Division of Coastal Management place your project on administrative hold. Please provide us with information supporting your position that your project must be constructed as planned and that you have no practicable alternative to placing fill in these waters and/or wetlands. Specifically can you construct your residential subdivision without filling the wetland near lots 102-104 and lots 136-138.7 Any documentation such as maps and narrative that you can supply to address alternative designs for your project may be helpful in our review of your 401 Certification.
