You have our approval to place fill material in less than 0.10 acres of wetlands or waters for the
purpose of construction of a roadway to serve a proposed transfer station at Lake Way Road, you
described in your application dated 25 August 1995. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2732. This certification
allows you to use Nationwide Permit Number 14 when it is issued by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, state or local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

Attached are seven copies of the Joint Form for Nationwide Permits for Section 401
Certification and the Corps of Engineers. Attached to each copy of the application are a
copy of the location map and a copy of a plan sheet indicating the scope of work involved.
By submittal of these applications, we are requesting review of this project for compliance
with the State water quality regulations.
A copy of this application along with the attachments is being forwarded to the
Wilmington District Engineer of the Corps of Engineers for their review. Copies will also
be forwarded to the Fish and Wildlife Service and the State Historic Preservation officer
for their review. Since this is a very small scale project, the impact on wetlands or
watersheds should be negligible. If you have questions about this project as you review the
plans, please do not hesitate to call.

In order to determine whether provisions for dual or standby power may be required for
subject facility, the classification of the closest downslope surface waters (the surface waters
any overflow from the facility would flow toward) must be determined. You are required io
submit this form, with items 1 through 10 completed, to the appropriate Division of Environmental
Management Regional Water Quality Supervisor (see attached listing). At a minimum, you must
include an 8.5" by 11" copy of the portion of a 7.5 minute USGS Topographic Map which shows
the subject surface waters. You must identify the locadon of the facility and the closest downslope
surface waters (waters for which you are requesting the classification) on the subnuttcd map copy.
The application may not be submitted until this form is completed and included with the submittal.
