Box 761 Smithfield, N.C. 27577 FILEX0 F I Dear Mr. Owens: ,P You have our approval to place fill material in 4.68 acres of wetlands or waters for the purpose of developing a recreational park at SR 1923 and SR 1003, as you described in your application dated 24 May 1995. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow•the conditions listed in the attached certification. Stromwater shall be directed to sheetflow into wetlands remaining the site. Additional written DEM approval is required for the final mitigation plan. Undersized culverts are suggested at the path crossing to increase water retention time in the wetlands. The Town of Smithfield is urged to consider a nature trail with appropriate signage through the wetland. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. N 0 w W JUN 2 31995. `G Smithfield Recreational Park Johnston County NW26 Danny Smith of the RRO conducted an site inspection of the proposed Smithfield Recreational Park on June 21, 1995. Prior to the City of Smithfield buying this property the entire tract was cut over. The Town of Smithfield is proposing to fill 4.68 acres of wetlands. As a result of the large wetland impacts proposed at this site the Corps is requiring enhancement of the wetlands that are not proposed for impact (see attached). Due to the low relatively low wetland rating but the significant amount of impact the RRO recommends the following conditions to the 401 Certification. - Stormwater should be diverted and spread back into the wetlands that are avoided. - A condition of the State 401 Certification should also include wetland enhancement. - In addition to enhancement of the wetlands a condition of the 401 Certification should require the placement of educational wetland exhibits along trail systems that are being proposed for this tract. As per the education component of DEM's Basin Wide Plan, this is an excellent site for this type of activity due to both the recreational activities available at this site and the adjacent High School. They have agreed to perform this work as mitigation for proposed impacts on site. Conceptually the enhancement will involve hydraxing (bushhogging) the entire site to cut back undesirable saplings that have gotten a head start on seedlings proposed for planting. Laps and debris left from the earlier clear cutting of the site will be removed also, but in a fashion that does not cause land disturbance that requires Corps authorization. Our forester has recommended that large stumps be removed so that we could more easily plant the site and expect a reasonable survival rate. It is my understanding that based on current information you will not allow this, but are open to considering reasons that might cause you to change your opinion. Seedlings will be planted and BMP's followed to facilitate successful planting. This will likely involve bushhogging between seedlings at some interval (no more then yearly) to ensure seedlings are not out competed by undesirable species (e.g. loblolly pine, sweet gum, red maple). Some areas may be planted with larger specimens of desirable species. A detailed enhancement plan will be submitted prior to construction and will be prepared by a registered forester in cooperation with the project architect However, the Corps can expect the specifications to be equal to or better than those attached. Please call if you have questions or to provide additional input cc: Paul Embler, Mckim & Creed, 233-8031 KCM/jmb Reforestation Concept All non-impacted wetland areas within the project will be replanted in the first available non growing season (November through February) after construction begins with a minimum of five suitable wetland hardwood species such as river birch, swamp chestnut oak, overcup oak, yellow poplar, willow oak, cherrybark oak,.black gum, water oak, bald cypress and green ash. If saplings are used they will be planted at a density of 400 trees per acre, on ten foot centers. No single species will occupy more than 20% of the canopy. The project is located in Smithfield, NC (Johnston County) and is bordered by Booker Dairy Rd. as shown on the enclosed plans. Our firm has performed the detailed wetland delineation shown on the attached map. We have also had these delineations approved by Ms. Jean Manuele of the US Army Corps of Engineers. In addition, we have met in the office and on site with Mr. Ron Ferrel of DEM to discuss permitting, avoidance, minimization and mitigation. Fill in the wetlands will be required to utilize the property for play fields, parking, roads and trails (see attached plans). As you can see, available uplands j have been utilized as much as possible so that wetland impacts have been minimized. The site is adjacent to an existing school. Much of the site is in open agricultural fields while the remainder is recently cutover timberland (see attached Aerial Photograph). All wetland areas within 100' of the dramageway thru the site have been avoided except for a road crossing. Areas proposed for k: t impact outside this "buffer" are of extremely low quality. In fact they raged between 9 and 12 by DEUs old rating system (see attached rating forms and " Corps delineation forms). Areas within the stream buffer rated in the mid 30's. I should note that the low quality wetland areas contain mostly Rains type soils and the site appears "drier" than one would expect considering the soil types present. While wetland hydrology may no longer exist over a significant part of the area now classified wetland, the owner does not have time to monitor the water table for a year (under normal precipitation) in order to attempt having the area reclassified as non-wetland. So, for the purpose of this project, we will assume the area indicated on the map as wetland based on soils and vegetation does have wetland hydrology. At best the site is of low quality. We discussed the unusual nature of this site with Mr. Ferrel during his site visit As a result of meeting with Mr. Ferrel the impacts to wetland has been $" reduced significantly (see attached "Previous Site Plan"). One soccer field, two volley ball courts, horseshoe areas,.numerous picnic shelters, and numerous parking areas have been eliminated (compare "Previous Site Plan" to current plan that shows wetland impacts). Mx. Ferrel suggested an enhancement plan be developed as mitigation for the unavoidable impacts. The plan would involve planting of native species. He also suggested incorporating this with an interpretative frail. Our client would welcome the opportunity to discuss such a plan with you if it is determined to be necessary to mitigate for proposed impacts. z' It will be necessary to fill 4.68 acres (see map) of cutover low quality jurisdictional wetlands above headwaters for placement of the proposed facilities. The project is located in Smithfield, NC (Johnston County) and is bordered by Booker Dairy Rd, as shown on the enclosed plans. Our firm has performed the detailed wetland delineation shown on the attached map. We have also had these delineations approved by Ms. Jean Manuele of the US Army Corps of Engineers. In addition, we have met in the office and on site with Mr. Ron Ferrel of DEM to discuss permitting, avoidance, minimization and mitigation. Fill in the wetlands will be required to utilize the property for play fields, parking, roads and trails (see attached plans). As you can see, available uplands have been utilized as much as possible so that wetland impacts have been minimized. The site is adjacent to an existing school. Much of the site is in open agricultural fields while the remainder is recently cutover timberland (see attached Aerial Photograph). All wetland areas within 100' of the dramageway thru the site have been avoided except for a road crossing. Areas proposed for impact outside this "buffer" are of extremely low quality. In fact they rated between 9 and 12 by DEM's old rating system (see attached rating forms and Corps delineation forms). Areas within the stream buffer rafted in the mid 30's. I should note that the low quality wetland areas contain mostly Rains type soils and the site appears "drier" than one would expect considering the soil types present. While wetland hydrology may no longer exist over a significant part of the area now classified wetland, the owner does not have time to monitor the water table for a year (under normal precipitation) in order to attempt having the area reclassified as non wetland. So, for the purpose of this. project, we will assume the area indicated on the map as wetland based on soils and vegetation does have wetland hydrology. We discussed the unusual nature of this site with Mr. Ferrel during his . site visit As a result of meeting with Mr. Ferrel the impacts to wetland has been reduced significantly (see attached "Previous Site Plan"). One soccer field, two volley ball courts, horseshoe areas, numerous picnic shelters, and numerous parking areas have been eliminated (compare "Previous Site Plan" to current plan that shows wetland impacts). Mr. Ferrel suggested an enhancement plan be developed as mitigation for the unavoidable impacts. The plan would involve planting of native species. He also suggested incorporating this with an interpretative trail. Our client would welcome the opportunity to discuss sucha plan with you if it is determined to be necessary to mitigate for proposed impacts. It will be necessary to fill 4.68 acres (see map) of cutover low quality jurisdictional wetlands above headwaters for placement of the proposed facilities. The remaining wetland area will not be impacted. The requested impacts will facilitate the construction of playing fields, roads, parking, and trails. Specifically, the tract is located south of Booker Dairy Road (SR 1923), approximately 1/4 mile east of Buffalo Road (SR 1003), west of Smithfield, Johnston County, North Carolina. The site is located adjacent to, and above the headwaters of, an unnamed tributary to Buffalo Creek. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your proposed work is authorized by this nationwide permit provided it is accomplished in strict accordance with your submitted plans, the enclosed conditions, and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding water quality certification. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. The conceptual mitigation plan as described in Mr. Kevin Martin's memo dated June 6, 1995, wili be implemented in its entirety. A final mitigation plan, elaborating upon this conceptual document, must be submitted and approved by the Corps prior to any construction activities occurring within jurisdictional waters of the United States. The final plan must include, at a minimum, a list of the plant species to be utilized in the areas of proposed wetland enhancement, the approximate dates of mitigation construction activities (e.g., grading, planting, etc.), proposed vegetative success criteria (e.g., 85% for canopy species), as-built plans, and a monitoring plan with reporting procedures. The required mitigation construction must be accomplished concurrently with the authorized work to provide for planting of all mitigation sites within the first available planting season (November through March) after site construction begins.
