After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2665. This certification allows you to use Nationwide Permit Number 13 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this, certification, you may. ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms, to Chapter 150B of the North Carolina. General Statutes to the Office of Administrative Hearings, P.O. PROJECT SUMMARY: Applicant proposes to construct a pier with a utility shed, place riprap along the shoreline, and create a parking area. Mr. Howard C. Slack Pier with Utility Shed, Riprap and Parking Area Ocracoke Island, Hyde County Project setting The project site is located adjacent SR 1350 on Ocracoke Island on Northern Pond, off the Pamlico Sound, in Hyde County, North Carolina. The proposed site is approximately 0.5 acre with the majority being high ground. The property is bordered on the northwest by Riggs Ellis property, the southwest by SR 1350, the southeast by Ruth J. Wilson property and the north by Northern Pond. The project site is primarily high ground f3' above mean sea level. The site is vegetated by Sea Oats and Spartina Patens as well as various species of woody plants such as myrtle and red cedar. Within the portion of the site where the applicant proposes to construct the pier and place riprap, is an existing concrete "dock"/jetty constructed by Mr. Jack Wilson and is composed of septic tanks placed in a line to facilitate water access on the subject property. Accretion has been occurring on this site in recent years. The portion of the site for the proposed parking area is located outside the 75' AEC adjacent SR 1350. No habitable structures are present on the project site. There is an existing septic tank and associated drain field that has never been used. There. are other piers constructed on various other lots surrounding Northern Pond. Some of these piers were constructed prior to LAMA, while others were permitted by the Division. Northern Pond is an Estuarine Water with a sparse shellfish (oyster and clam) population. No Primary Nursery Area exists. Northern Pond is classified as SA waters by the Environmental Management Commission. Project description . Mr. Howard C. Slack proposes to construct a ±75' x 8.5' wooden pier with a ±3' x 4' utility shed at the waterward end of the pier and place ±20' of concrete riprap, obtained from removal of the existing concrete "dock", along the shoreline not to exceed an average of 10' waterward. Mr. Slack also proposes to build a ± 12' x 30' parking area, utilizing the remaining concrete from the removal of the old concrete "dock", in an area set back greater than 75' from mean high water adjacent to SR 1350. Anticipated impacts The project proposed will result in the disturbance of ±540 ft2 of sound bottom for removal of the existing concrete "dock". The riprap will fill ±200 ft2 of sound bottom with concrete. Approximately 638 ft2 of sound bottom will be shaded by the proposed pier. An additional ±340 ft2 of high ground, outside 75', will be filled, by the remaining concrete not used as riprap, in the construction of a parking area adjacent SR 1350. Slack C As stated in the permit application, there presently exists on-site an old concrete dock. It is the intention of Mr. Howard C. Slack to remove this old concrete dock, and to replace it with a wooden pier supported on pilings. Some of the concrete dock is below the mean high water level, and will have to be removed from the water. Small pieces and rubble O from the removal of the dock will be reused as protective riprap where the new pier passes the mean high water level line. The large pieces of the concrete dock will be used to create a stable concrete parking pad adjacent to S.R. 1350. There are no plans to disturb ` any marshlands, swamps or water areas other than the water area directly affected by the DD removal of the old concrete dock, as previously described. There are no plans to disturb or fill any marsh or wetland. (If any wetlands were to be crossed--there are no such plans--they would be crossed on mats in order to minimize damage.) Y Plans by Mr. Howard C. Slack to build a pier in the place of the old concrete dock will provide a more open marine environment in the waters under the pier, and will remove a historical hazard from the area of the shore.
