Dear Mr. Emory:
You have our approval to place fill material in 2.18 acres of wetlands or waters for the purpose
of land fill expansion at Harnett County land fill on SR 1724, as you described in your application
dated 30 January 1995. After reviewing your application, we have decided that this fill is covered by
General Water Quality Certification Numbers 2671 and 2732. These certifications allow you to use
Nationwide Permit Numbers 26 and 14 when they are issued by the Corps of Engineers.
This approval is only valid for the purpose and design that: you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid,. you must follow the conditions-listed in the attached. certification. Waste
disposal areas shall be no closer:than 300 feet to Stewart's Creek:-. In addition, you, should get any
other federal, state or local permits before you go ahead with, your: project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory
hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401
of the Clean Water Act. If you have any questions, please telephone John Domey at 919-733-1786.

We have reviewed the archaeological survey report by Thomas H. Hargrove
and offer our comments.
For purposes of compliance with Section 106 of the National Historic
Preservation Act, we concur that the following properties were determined
not eligible for listing in the National Register of Historic Places:
31HT176, 31HT177, 31HT178
In general the report meets our office's guidelines and those of the
Secretary of the Interior.
The above comments are made pursuant to Section 106 of the National
Historic Preservation Act of 1966 and the Advisory Council on Historic
Preservation's Regulations for Compliance with Section 106, codified at
36 CFR Part 800.

threatened species which may occur within the project impact area.
The attached page(s) list(s) the Federally-listed species which
may occur within the project impact area.
If the proposed project will be removing pines greater than or equal
to 30 years of age in pine or pine/hardwood habitat, surveys should
be conducted for active red-cockaded woodpecker cavity trees in
appropriate habitat within a 1/2 mile radius of project boundaries.
If red-cockaded woodpeckers are observed within the project area or
active cavity trees found, the project has the potential to
adversely affect the red-cockaded woodpecker, and you should contact
this office for further information.
The Service concurs that the proposed project is not likely to
adversely affect Federally-listed endangered or threatened species,
their formally designated critical habitat, or species currently
proposed for Federal listing under the Endangered Species Act, as
amended.
/ Staffing limitations prevent us from conducting a field inspection

Dear Mr. Bahos:
McKim & Creed Engineers has recently submitted Nationwide Permit Applica-
tions on behalf of Harnett County. The Nationwide Permit Applications are
associated with the Dunn-Erwin Landfill. This landfill is located adjacent to
Stewart Creek. (See attached U.S.G.S. map.) One Nationwide Permit deals with
three proposed minor road crossings; the other permit proposes to fill 1.93 acres
of wetlands in association with the construction of a lined landfill. All affected
wetland areas are upstream of the headwaters for Stewart Creek. The affected
areas are also outside of the 100-yr. floodplain for Stewart Creek.
Irrespective of whether endangered species exist adjacent to the landfill, the
following measures will be undertaken:
1. A 300-foot buffer has been placed between the proposed limits of waste
disposal and Stewart Creek.
2. A leachate management system with composite liner, leachate collection
piping, leachate pretreatment, and discharge to a treatment facility will be

SUBJECT: 401 Water Quality Certification Review for Harnett County's Proposed Placement
of Fill Material into 404 Wetlands near Erwin for Landfill Expansion, Harnett
County, North Carolina, DEM ID: No. 95103.
Staff biologists with the North Carolina Wildlife Resources Commission (NCWRC) have
completed a review of the proposed project and evaluated possible impacts on fisheries, wildlife,
and wetland resources in the project area. An on-site investigation was made on March 1, 1995.
Our comments are provided in accordance with provisions of the Fish and Wildlife Coordination
Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.), Section 401-b of the Clean Water Act of
1977 (as amended), and North Carolina General Statutes (G. S. 113-131 et seq.).
Harnett County is requesting permit authorization to place fill material associated with
expansion of the County's landfill in 404 wetlands near the town of Erwin in Harnett County.
Placement of the fill material will result in the unavoidable loss of 2.18 ac of 404 hardwood
wetlands. The purpose of the proposed project is to facilitate the hauling of borrow and spoil
material associated with existing landfill operations and to provide a larger footprint and more
constructible cell for landfill.
The project area consists primarily of the existing landfill, interspersed with hardwood
uplands and 404 wetlands which are considered 404 jurisdictional areas by the U.S. Army Corps
of Engineers. These wetlands provide numerous functions which benefit the public as well as
fish and wildlife. These functions include retention and purification of stormwater runoff and
providing valuable habitat for numerous species of fish and wildlife. These wetlands play a
major role in the overall biological productivity of adjacent waters.

Due to the direct, unmitigated loss of wildlife habitat and stormwater retention capacity,
we find the proposal inconsistent with our Policies and Guidelines for Conservation of Wetlands
and Aquatic Habitat. It is the policy of this agency to oppose projects which "displace, damage,
or modify wetland values and functions". We also believe that this project is inconsistent with
the Environmental Protection Agency's Section 404(b)(1) guidelines in that the proposed project
does not constitute a water dependent activity. Therefore, we recommend that 401 Water
Quality Certification not be issued. Modification of the project to avoid or minimize wetland
impacts would result in a more favorable review by this agency.
