Dear Mr. Ruffalo & Mr. Stover:
You have our approval to place fill material in 1154 square feet of wetlands or waters for the
purpose of restoring a bulkhead and dock at east side of Dutchess Court; Lots 12, 13, 14 and 15, as
you described in your application dated 12 May 1995. After reviewing your application, we have
decided that this fill is covered by General Water Quality Certification Number 2665 or its equivalent.
This certification allows ym to use Nationwide Permit Number 13 when it is issued by the Corps of
Engineers.
This approval is only valid for the purpose and design that you described in your application. If
you change your project, you must notify us and you may be required to send us a new application.
For this approval to be valid, you must follow the conditions listed in the attached certification. In
addition, you should get any other federal, statebr local permits before you go ahead with your
project.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatorti
hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing,
send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the
Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and
its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under Section 401

Site Description
The applicants, John Ruffalo and John Stover own 4 lots totaling 30,000 square feet
with frontage of 206 linear feet on a canal off Colington Bay, on Duchess Court, Colington
Harbour Subdivision, Kill Devil Hills, Dare County. In the early 1970's the entire frontage
of the project site was protected by the installation of a concrete/asbestos bulkhead. The
northernmost 100 feet of bulkhead was replaced approximately 4 years ago when a dwelling
was constructed on the site but the remaining 106 linear feet of concrete bulkhead has
collapsed allowing canal waters to erode an area approximately 7 feet landward of the
collapsed bulkhead. Approximately 80 linear feet of the bank has subsided allowing a fringe
of salt meadow grass S artina patens) approximately 2-3' wide to become established just
landward of the NWL. Landward of the salt meadow grass fringe the bank slopes upward at
a 1:1 ratio. Landward of the top of the slope the lot is fairly level at 4-5' above MSL and
vegetated with volunteer grasses and weeds.
The applicants propose to construct a new 106 foot long wooden bulkhead
approximately 2 feet waterward of the collapsed bulkhead, with the new bulkhead connecting
to the existing wooden bulkheads at the north and south sides of the subject property. The
new 106' long bulkhead is to be located a maximum distance of 14 feet waterward of NWL
and an average distance waterward of 9 feet. The rate of erosion in this area is estimated to
be 1-2' year based on aerial photography. Also proposed is an 8' x 16' dock to be
constructed approximately 10 feet from the property line at the southern end of the project
site. Approximately 75 feet from the northern end of the project site and just landward of
the existing bulkhead and 10' x 18' dock, the applicants propose to construct a 16' x 32'
platform.
Anticipated Impacts
Approximately 200 square feet of coastal wetlands would be filled as a result of the
proposed bulkhead construction.
The construction of the bulkhead will result in the loss of 954 square feet of shallow
water habitat. The proposed 8' x 16' dock would shade 128 square feet of public trust
waters. The 16' x 32' platform proposed landward of the existing bulkhead would
disturb/cover 512 square feet of highground within the estuarine shoreline AEC. Some
short-term local turbidity will be created by the bulkhead/dock construction. No cultural
resources have been identified in this area.

Site Description
The applicants, John Ruffalo and John Stover own 4 lots totaling 30,000 square feet
with frontage of 206 linear feet on a canal off Colington Bay, on Duchess Court, Colington
Harbour Subdivision, Kill Devil Hills, Dare County. In the early 1970's the entire frontage
of the project site was protected by the installation of a concrete/asbestos bulkhead. The
northernmost 100 feet of bulkhead was replaced approximately 4 years ago when a dwelling
was constructed on the site but the remaining 106 linear feet of concrete bulkhead has
collapsed allowing canal waters to erode an area approximately 7 feet landward of the
collapsed bulkhead. Approximately 80 linear feet of the bank has subsided allowing a fringe
of salt meadow grass S artina patens) approximately 2-3' wide to become established just
landward of the NWL. Landward of the salt meadow grass fringe the bank slopes upward at
a 1:1 ratio. Landward of the top of the slope the lot is fairly level at 4-5' above MSL and
vegetated with volunteer grasses and weeds.
The applicants propose to construct a new 106 foot long wooden bulkhead
approximately 2 feet waterward of the collapsed bulkhead, with the new bulkhead connecting
to the existing wooden bulkheads at the north and south sides of the subject property. The
new 106' long bulkhead is to be located a maximum distance of 14 feet waterward of NWL
and an average distance waterward of 9 feet. The rate of erosion in this area is estimated to
be 1-2' year based on aerial photography. Also proposed is an 8' x 16' dock to be
constructed approximately 10 feet from the property line at the southern end of the project
site. Approximately 75 feet from the northern end of the project site and just landward of
the existing bulkhead and 10' x 18' dock, the applicants propose to construct a 16' x 32'
platform.
Anticipated Impacts
Approximately 200 square feet of coastal wetlands would be filled as a result of the
proposed bulkhead construction.
The construction of the bulkhead will result in the loss of 954 square feet of shallow
water habitat. The proposed 8' x 16' dock would shade 128 square feet of public trust
waters. The 16' x 32' platform proposed landward of the existing bulkhead would
disturb/cover 512 square feet of highground within the estuarine shoreline AEC. Some
short-term local turbidity will be created by the bulkhead/dock construction. No cultural
resources have been identified in this area.

The Department of Environment, Health and Natural Resources hereby gives public
notice as required by NCGS 113A-119(b) and 143-215 3(a)(1)(c) that JOHN RUFFALO
AND JOHN STOVER of Dare County, filed an application on May 4, 1995, for a permit
from the Division of Coastal Management to develop in an Area of Environmental Concern
and for certification from the Division of Environmental Management that a discharge of fill
material in project wetlands will not violate applicable water quality standards.
According to said application JOHN RUFFALO AND JOHN STOVER propose to
replace a damaged 106' bulkhead along the estuarine shoreline an average of 9' waterward of
NWL and a maximum of 14' waterward of NWL. Also proposed are a 16' x 32' platform
landward of the bulkhead and a 8' x 16' dock. The project site is located on the east side of
Dutchess Court, Lots 12, 13, 14 and 15, Section "W', Colington Island, Kill Devil Hills,
Colington Bay, Dare County.
A copy of the entire application and additional information may be examined (or
copies furnished upon request and payment of reproduction costs) during normal business
hours at the office of M. Edward Harrell, Division of Coastal Management, located at 1367
US 17 South, Elizabeth City, N.C., 919/264-3901, and/or the office of Deborah Sawyer,
Division of Environmental Management, DEHNR Regional Field Office, Washington, N.C.,
919/946-6481.
The Division of Environmental Management proposes to take final action on this
water quality certification on or before June 10, 1995. The issuance of the CAMA Major
Development permit and the Section 401 Certification may deviate from this projected date
depending upon the nature of the comments submitted and subsequent hearings that may
result.
All persons desiring to make comments should do so in writing to Roger N. Schecter,
Director, Division of Coastal Management, P.O. Box 27687, Raleigh, N.C., 27611, prior to
June 5, 1995 for consideration in the CAMA permit decision, and to Mr. John Dorney,
Division of Environmental Management, P.O. Box 27687, Raleigh, N.C.,'27611, prior to
June 1, 1995 for consideration in the water quality certification decision. Later comments on
the CAMA application will be accepted and considered up to the time of permit decision.
Project modifications may occur based on review and comment by the public and state and
federal agencies. Notice of the permit decision in this matter will be provided upon request.
