Proposed acttivitiee will involve fill (approximately 44 cubic yards) below ordinary high water utilizing native materials such as lope, root wade, larger boulders, gravel, and earthen materials. As part of the project, the Upper Creek channel will be narrowed and the floodplain reestablished with native riparian vegetation. In addition, vortex weirs will be installed and/or clean washed gravel deposited in layers in riffle areas. The purpose for the project is to improve trout habitat, reduce sedimentation occurring alone unstable streambanke, and improve the riparian zone. Approximately 0.1 acre of headwater stream channel will be impacted as a result of the work. This project will be directed by the KRC in coordination with Trout Unlimited. The work is expected to be accomplished within 10 days and before June 30, 1995. For the purposes of the Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits. Authorization was provided, pursuant to section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this nationwide permit provided it is accomplished in strict accordance with the enclosed conditions. This nationwide permit does not relieve you of the responsibility to obtain other required State or local approval. ThLe verifioation will be valid for two years from the date of this letter unless the nationwide authorisation is modified, reissued or revoked. Also, this verification will remain valid for the two years if, during that period, the nationwide permit authorization in reissued without modification or the activity complies with any subsequent modification of the nationwide Permit authorization. If during the two years, the nationwide permit authorization expires or is suspended or revoked, or is modified, ouch that the activity would no longor comply with the terma and conditions of the nationwide permit, activities which have commenced or are under contract to commence, in reliance upon the nationwide permit, will remain authorized. Fullwood, Executive Director March 16, 1995 Mr. Steve Chapin, Permit Coordinator U.S. Army Corps of Engineers 151 Patton Avenue, Room 143 Asheville, North Carolina 28801-5006 SUBJECT: Application for an individual permit to restore 457 feet of channelized stream on Upper Creek, Burke County Dear Mr. Chapin: The North Carolina Wildlife Resources Commission (NCWRC) is requesting a 404 permit from the U.S. Army Corps of Engineers on behalf of Mr. Charles J. Poore for the above referenced project. By copy of this letter we are applying to the North Carolina Division of Environmental Management (NCDEM), Water Quality Section, for 401 certification. The proposed project is located on Upper Creek near the Jonas Ridge community. Upper Creek is designated as Outstanding Resource Water by NCDEM. An unauthorized relocation of this stream section in 1990 resulted in unstable stream banks, accelerated erosion and downstream sedimentation to private and public waters. Upper Creek has a fair to good wild brook trout population in the vicinity of the project. The altered stream habitat has resulted in reduced numbers of larger trout while favoring young of year fish. This project is a cooperative effort between the land owner, the NCWRC and Trout Unlimited. The applicant proposes to incorporate stream restoration techniques and principles of Dave Rosgen (Wildland Hydrology Consultants) to reduce stream bank erosion on his portion of Upper Creek. The stream channel will be narrowed and the floodplain reestablished. Two existing stream curves will be stabilized by restoring the proper radius of curvature. Water velocities will be reduced by increasing channel sinuosity and roughness. Vortex rock weirs will be used to dissipate stream energy and prevent head cutting. Finally stream banks will be revegetated with grasses, mulch and native species of trees and shrubs. As a project cooperator, we will take all necessary precautions to insure that negative environmental impacts will be minimized. Proposed activities will result in fill below ordinary high water consisting of native materials such as logs, root wads, boulders and earthen materials. As the new channel is completed, the old altered channel will be filled with materials from high ground. Construction timing, April 15 through June 30, will minimize impacts to trout populations. No wetlands or habitats likely to support any endangered, threatened or special concern species will be impacted. During the project, turbidities are expected to exceed baseline levels. However, the increase in short-term turbidities will be compensated by the reduction in long-term sedimentation from this site. In addition to restoring a functioning stream ecosystem, the site will be used to demonstrate stream bank stabilization and channel restoration methods.
