Dear Mr. Mannen:
The Division received the subject letter from the consultant on behalf of your client, John Elmore
and Porters Neck Company, Inc. The letter contained a stormwater permit application prepared by
the consultant, which proposes the following actions:
1. Consolidates all of the permits within Porters Neck into one permit;
2. Reduces the project area to eliminate the Section Il area which is now Eagle Point.
3. Recalculates the built -upon area within the reduced project area to demonstrate overall
25% low density.
However, the application is not complete. Please address the following items to continue with the
review of the modified application:
1. Decide which direction Mr. Elmore will take regarding the 5080 sf BUA limit. The options
are:
a. Provide documentation which verifies that no lot has exceeded 5080 sf BUA limit.
This option (a) requires an amendment to the covenants; or,
b. Provide documentation that, based on totaling the amount of BUA currently
constructed on each lot, and dividing by the number of lots, verifies that the average
BUA on the lots is no more than 5080 sf. This option (b) does not require an
amendment to the covenants.
2. Both options described in Comment 41 require the submission of documentation and
verification of the amount of built -upon currently existing on each lot.
3. Please have Mr. Elmore sign the permit application and have it notarized.
