You have our approval to place fill material in 0.10 acres of wetlands or waters for
the purpose of warehouse facility for Bannister Properties at US401 South, as you
described in your application dated 19 July 1994. After reviewing your application, we
have decided that this fill is covered by General Water Quality Certification Number
2733. This certification allows you to use Nationwide Permit Number 18 when it is issued
by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

By affect of this letter and the attached joint application form we are requesting approval to place 4,356
SF (0.10 Ac.) of fill material for the construction of a warehouse facility. Enclosed for your review is a
Site Location Map and a joint application form for Nationwide Permit #18.
As you can see by reviewing the attached Site Plan all Run-off form the proposed new pavement areas
will be directed to the existing Storm Water Management Facility located south of the proposed
warehouse facility. The roof drains along the back portion of the building will be the only additional
impervious area that will not be directed to the SWM Facility. They will empty into an existing rip rap
channel along the back portion of the building.
As you know, we have evaluated several alternatives to eliminate the wetland impact totally and we have
been unsuccessful, therefore, we believe that this proposal, which minimizes the wetland impact, should
receive a favorable consideration.
Your prompt attention to this matters would be greatly appreciated. We have currently postponed
building construction and we are eager to resolve these matters and continue construction activity.

Enclosed please find our application for the deletion of 1/3 of an acre of the above-
mentioned wetlands site, for working purposes.
Also enclosed are our reasons for the deletion of this 1/3 acre area, and a copy of a
plan which indicates how the new building will overlay on the original wetlands map as
approved by Ken Jolly on July 2, 1990.
It is our understanding that disturbing this 1/3 of an acre area does not require
notification, however we want to keep you informed of our activity at this site.
If the information set forth above meets with your understanding and approval,

DRAINAGE AREA 2 IN REALITY DOESN'T ENTER THE WETLAND BUT DOES FLOW
INTO THE RAILROAD R/LU DITCH RT THE LOWEST RIND NEWEST PIPE UNDER THE
RRILRORD. THE PREVIOUS PIPE AT THIS POINT WAS REPLACED AND TAILED
DITCHED OVER TO YATES BRANCH. THE EAST R,'LLI DITCH WAS PULLED ALMOST
BACK TO THE NEXT CROSS PIPE ON THE SITE. THIS ACTION MAY HAVC CAUSED
ADDITIONAL PONDING IN THE WETLAND SITE.
DRAINAGE AREA 3 IS PRESENTLY RETAINED IN A COMBINATION OF 01VERSION
DITCHES AND SILT BASINS AND ONLY DRAINS INTO THE 111FTLAND AREA DURING
HEAVY STORM EVENTS LLIHICH OVERTOP THE SILT BASIN ONO THEN THIS FLOW
ONLY ENTER THE RAILROAD R,'LV DITCH NEAR THE SOUTH END.
DRAINAGE AREA 4 PRESENTLY HAS AN EXISTING 24" PIPE WHICH TAKES THE
PRIMARY SURFACE DRAINAGE AND A 48" PIPE WHICH STARTS AS 11 JIf
DRAINAGE ON THE FRONT. THESE TWO HRUE BEEN COMBINED AND ARE
DIVERTED PAST A PERMANENT DETENTION POND. THE POND LVILL COLLECT THE
SURFACE DRRINRGE FROM THE EHISTING BUILDINGS ONO THE PROPOSED NEW
BUILDING AS WELL AS BECOME ADDITIONAL LVETLflNO.
REASON FOR WORKING IN WETLAND:
1. TO PROTECT EXISTING SEPTIC: SYSTEM.
2. TO DIVERT STORM WATER INTO PERMANENT DETENTION POND.
3. THE PERMANENT DETENTION POND REDUCES THE IMPACT OF RAPID STORM
WATER BUILDUP IN THIS AREA.
