APPROVAL of 401 Water Quality Certification

Dear Mr. Denver:
You have our approval to place fill material in 0.26 acres of wetlands or waters for
the purpose of multi-family development at Hyw 51 near Providence Senior High School,
as you described in your application dated 1 May, 1994. After reviewing your application,
we have decided that this fill is covered by General Water Quality Certification Number
2671. This certification allows you to use Nationwide Permit Number 26 when it is issued
by the Corps of Engineers.
This approval is only valid for the purpose and design that you described in your
application. If you change your project, you must notify us and you may be required to
send us a new application. For this approval to be valid, you must follow the conditions
listed in the attached certification. In addition, you should get any other federal, state or
local permits before you go ahead with your project.
If you do not accept any of the conditions of this certification, you may ask for an
adjudicatory hearing. You must act within 30 days of the date that you receive this letter.
To ask for a hearing, send a written petition which conforms to Chapter 150B of the
North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and
binding unless you ask for a hearing.
This letter completes the review of the Division of Environmental Management under
Section 401 of the Clean Water Act. If you have any questions, please telephone John

Dear John,
On behalf of Mr. Mark T. Denyer of Brock Consulting Group, I am requesting a
General 401 Water Quality Certification - NWP #26 to impact .26 Acres or less
of Jurisdictional Waters in headwaters on this ±40 Acre multi-family residen-
tial site in southeast Mecklenburg County. The project site is along NC Hwy 51
adjacent to Providence Senior High School.
The majority of the site is upland and wooded, except for a small clearing of a
former agricultural field along Hwy 51. The soils are Cecil- sandy clay loam (CeB2
to Cel)2) in the clearing and wooded areas, and Mecklenburg fine sandy loam (MeB)
in the wooded interior section of the site. The site is near the top of the drain-
age area of a headwater tributary of McAlpine Creek (Class - C), with a small
intermittent channel with two small pockets of perched and seep wetlands in the
center of the drainageway. The total area of Jurisdictional Waters on the site
is conservatively ±.26 Acres. The development plans require that the area be
crossed to develop the upland ridges and to create recreational open space and
amenities. Much of the area will remain natural. and will be utilized for passive
recreation.
I have informed my client that an application to the NC Division of Environmental
Management will be required if the development area changes and impacts of 1/3
Acre or greater to Jurisdictional Waters are necessary.
