(E) Primary Nursery Area: Yes (F) Water Classification: SA Open: No PROJECT SUMMARY: The applicant proposes the construction of a private, 7-slip community dock into Whiskey Creek, which would accommodate 7 new lots within the Bluffs at Trails End Subdivision. Tom Beebe, The Bluffs at Trails End Subdivision Page 2 9. PROJECT DESCRIPTION: The project site is located at 311 Trails End Road, adjacent to Whiskey Creek, in New Hanover County. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn left onto Masonboro Loop Road and travel north approximately 1 mile. Turn right onto Trails End Road and travel east for approximately 0.3 miles and until you reach the property of interest located on the left. Existing structures on the property include a new road and utilities currently under construction. The 3.77 acre tract has approximately 672 feet of shoreline and averages approximately 15' above mean sea level. Hgghground vegetation of this tract consists of grasses and shrubbery. Other upland vegetation includes mixed hardwood and other species including: Oak, Dogwood and Pine. Waterward of the highground towards Whiskey Creek, the elevation of the property drops off substantially. The vegetation at this elevation transitions into an area approximately 10-20' in width consisting primarily of Smooth Cordgrass (Spartina alterniflora). Waterward and surrounding tl~e low marsh are several areas of oyster reefs visible in the mud flat at low water. The western end of the property borders a cove along with an area of mixed coastal wetlands and §404 Wetlands, which is influenced by an existing drainage easement that extends from the highground area along Trails End Road. An existing private pier is located on the eastern end of the property, which extends into Whiskey Creek. The pier terminates onto an access ramp, which leads onto an existing floating dock located on the western side of the pier. The floating dock runs parallel to the landward side of the existing channel and shoreline. The New Hanover County Land Use Plan classifies the adjacent waters as Cor~se~-vation, and the adjacent high ground portion of the project area as Resou~~ce Protection. In the project area, the waters of Whiskey Creel: are classified as SA by the NC Division of Water Quality, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the NC Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes the construction of a private, 7-slip community dock into Whiskey Creek. which would accommodate 7 new lots within the Bluffs at Whiskey Creek Subdivision. The upland development for the subdivision appears to be located landward of the 75' Estuarine Shoreline Area of Environmental Concern (AEC). The 3.77 acre tract is approximately 725' in depth from Trails End Road to Whiskey Creek and averages approximately 150'in width. The property would be subdivided into 7 lots averaging approximately 0.4 acres each. A 20' private driveway within a 40' right-of--way would terminate in a cul-de-sac, which would access the proposed lots from Trails End Road. The application states that the existing private pier and floating dock would remain and be incorporated into the proposed community dock. Two boatlifts, 12' in length by 12' in width, would be installed at this existing dock. One would be located on the eastern side of the existing pier (Lift 7) and the other on the western end of the existing floating dock (Lift 6). These boatlifts would be located slightly waterward of the existing footprint of the existing docking facility. The application states that the existing floating dock would be used only to access Lift 6. The application also states that a 10' community pedestrian easement would be located between Lots 1 and 2, which would be the location of the proposed community private pier into Whiskey Creek. An access pier would extend from this easement into Whiskey Creek a distance of 74' in length by 6' in width. The access pier would then terminate in a "T-head" platform 60' in length by 6' in width, which would run parallel to the shoreline and landward of the established channel of Whiskey Creek. Three tnger piers, 24' in length by 6' in width, would extend from the platform approximately 26'.apart, which would run perpendicular to the shoreline and channel. These finger piers would accommodate an additional five boatlifts, 12' in length by 12' in width. The proposed new community dock would be incorporated to the existing docking facility to accommodate the seven vessels. The application states that a header system would be constructed for each boatlift and is designed to not allow the boatlift cradle to rest on the substrate. The application indicates that current water depths range from approximately-1.3' to -2', relative to Mean Low Water (MLW), within the area of the proposed 7 slips, which would be located on the waterward edge of the proposed finger piers and boatlifts. The application states that a Special Use Permit through the New Hanover County Planning and Zoning was issued for the proposed community dock on February 7, 2007. ANTICIPATED IMPACTS: The proposed upland development for the subdivision would not be located within the 75' Estuarine Shoreline AEC. The proposed community dock would incorporate 1,928 sq. ft. of Public Trust Area and Estuarine Waters and shade approximately 100 sq. ft. of Coastal Wetlands. Minor increases in turbidity should be expected during construction. The proposed structures would extend approximately 85' into a waterbody, which measures approximately 350 feet. This distance would conform to the 1/4 width Wile. The construction would provide docking space for a total of seven (7) vessels. The proposed structures could potentially provide docking space for up to eight vessels, however, the application states the existing floating dock would be used only as access to Lift 6.
