2176 issued November 4, 1987. A copy of the General

in qualifying for coverage under Corps of Engineers'
Nationwide Permit No. 26.

Dear Mr. Mills,
Enclosed are copies of the permit application and plans for the Town of
Morrisville's community park as submitted to the Corps of Engineers in
Wilmington. The Town's intent in regard to the wetland areas identified on
this site is to build up berms to the limits shown on the plans so to give
definition to the outdoor spaces and to slightly elevate certain activities
above the existing grade so a view over the expanse of the park can be
accomplished. The Town will use fill dirt from off-site, non-wetland
sources. In no case will the Town excavate earth from within wetland
areas on site.
We met with Jeff Richter of the Corps to walk this site and identify
potential wetlands. Mr. Richter noted the presence of indicative
vegetation and the resulting wetland boundary is indicated on the plan. He
also noted that this wetland is transitioning to a dry state since this is
the site of an old farm pond whose containment gave way over one year
ago.
Given the state of the identified wetland and the Town's limited
grading/filling proposal within the identified area, we believe that this
proposed work will have minimal environmental consequences. We submit
this information to you requesting permission in the appropriate
documented form to carry forward with this work. I understand that
permission from your department is required to submit for a nationwide
#26 permit with the Corps of Engineers.

authorization to place fill material in wetlands above the headwaters of a
tributary of Crabtree Creek.
Your proposed placement of this fill material may qualify for Federal
authorization pursuant to nationwide permit (33 CFR 330.5(a) (26)). Please
complete the enclosed pre-discharge notification (PDN) form and submit it with
a copy of your Section 401 Water Quality Certification from the North Carolina
Division of Environmental Management. The Section 401 Certification is
required to validate nationwide permit No. 26 in the State of North Carolina;
and therefore, it must be submitted with the PDN application.

following items must be submitted:
A copy of the deed (with state application only) or
other instrument under which the applicant claims
title to the affected property. If the applicant is not
claiming to be the owner of said property, then for-
ward a copy of the deed or other instrument under
which the owner claims title, plus written permis-
sion from the owner to carry out the project.
An accurate work plat (including plan view and
cross sectional drawings) drawn to scale in black
ink on 8 V2 x 11 white paper. (Refer to Coastal
Resources Commission Rule 7J.0203 for a detailed
description.)
Please note that original drawings are preferred and
only high quality copies will be accepted. Blue-line
prints or other larger plats are acceptable only if 16
high quality copies are provided by the applicant.
(Contact the U.S. Army Corps of Engineers regard-
ing that agency's use of larger drawings.) A site or
location map is a part of plat requirements and it
must be sufficiently detailed to guide agency per-
sonnel unfamiliar with the area to the site. Include
county road (SR) numbers, landmarks, and the like.
A stormwater management plan, if applicable, that
may have been developed in consultation with the
Division of Environmental Management.
A list of the names and complete addresses of the
adjacent waterfront (riparian) landowners. These
individuals have 30 days in which to submit com-
ments on the proposed project to the Division of
Coastal Management. The applicant must advise
the adjacent landowners of this opportunity by sen-
ding a copy of the permit application to them by
registered or certified mail. This notification is re-
quired by G.S. 113-229(d).
