with the application and conditions hereinafter set forth.

1. That the activity be conducted in such a manner
as to prevent significant increase in turbidity
outside the area of ccnstruction or construction
related discharge (increases such that the
turbidity in the Stream is 50 Nro's or less
are not considered significant).
2. That appropriate sedimentation and erosion control
control neasures be employed to minimize turbidity
and siltation impacts.
Violations of any coOOition herein set forth shall result in
revocation of this Certification.

Dear Colonel Woodbury:
In accordance with your request, this office has circulated to interested
state review agencies U. S. Army Corps Public Notice .... 0050 dated November
12, 1987 which describes a project proposed by the City of Raleigh. The
project, involving the construction of cofferdams to facilitate sewer pipeline
crossings, is located on the Neuse River and on Crabtree Creek, east of
Raleigh, in Wake County.
Based on a coordinated agency review, the state interposes no objection
to the proposal provided: 1) materials utilized for construction of the outer
surfaces of the cofferdams are relatively clean and free of soils and other
materials that cause silt and sediment. River waters should not be in direct
contact with erodible materials, 2) strict sedimentation control measures
should be utilized throughout the project to minimize impacts to important
rare aquatic species of mollusk, 3) precaution should be taken to prevent
contamination of the watershed and stream by oil or other substances during
all phases of construction, 4) extra care is used throughout the project area
to.prevent damage to in-place water lines and other utilities, 5) appropriate
sedimentation and erosion control plans are filed with the DNRCD, Raleigh
Regional Office. It should be noted that office recommended sheet pile
cofferdams or acceptable alternatives.
For you;' information, the Division of Environmental Ma>lagement issued
Water Quality Certification No. 2193 for this project on December 31, 1987.

The Raleigh Regional Office has reviewed the subject project in order to
provide recommendations for issuance of a North Carolina State Water Quality
Certification in accordance with Section 401 of the Clean Water Act.
The subject project consists of constructing three coffer dams; two in
the Neuse River and one in Crabtree Creek, for the construction of gravity and
pressure sewer lines. A site will be located immediately downstream of
Beaverdam Creek on the Neuse River, another on the Neuse River upstream of
Beaverdam Creek, and a third crossing Crabtree Creek upstream of its conflu-
ence with the Neuse River. All three sites are class "c" waters. The City
proposes to remove and place dredged and fill material associated with the
construction of coffer dams and ultimately the construction of sewer lines.
This office recommends that the certification include a condition that
the activities not cause the downstream turbidity to increase in excess of 50
NTUs and appropriate erosion control measures be taken to prohibit impact to
the surface waters.

THE CITY OF RALEIGH, represented by MR. DEMPSEY E. BENTON, JR., City
Manager, Post Office Box 590, Raleigh, North Carolina 27602-0590, has applied
for a Department of the Army permit TO TEMPORARILY PLACE FILL MATERIAL FOR
CONSTRUCTION OF COFFERDAMS AND TO INSTALL SANITARY SEWER PIPELINE CROSSINGS AT
TWO SITES ON THE NEUSE RIVER AND AND ONE SITE ON CRABTREE CREEK ASSOCIATED
WITH THE UPPER NEUSE RIVER INTERCEPTOR SEWER SYSTEM, EAST OF RALEIGH, Wake
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show two crossings of the Neuse River and one crossing of Crabtree
Creek. The first site on the Neuse River, Cofferdam A, is located immediately
downstream of the confluence o;~Beaverdam Creek with the Neuse River. At this
site, a 66-inch diameter concrete gravity sanitary sewer main is to span the
approximate 170-foot-wide channel. Two coffer dams are to be constructed, in
sequence, so that only one-half of the width of the river will be blocked at
any time. The second site on the Neuse River, Cofferdam B, is located
immediately upstream of the confluence of the discharge of Beaverdam Lake with
the Neuse River. At this site, there are two river channels, 70- and 90-foot-
wide, bisected by an island. A 66-inch diameter concrete gravity sanitary
sewer main is to be installed. Cofferdams are to be constructed to cross each
channel in a single operation. Only one channel will be obscured at anyone
time. The site on Crabtree Creek, Cofferdam C, is located approximately 1,000
feet upstream of the confluence of the Neuse River with Crabtree Creek. At
this site, a 42-inch-diameter concrete or ductile iron pressure sanitary sewer
main is to be installed to span the approximate 90-foot-wide channel. As with
Cofferdam A, two cofferdams are to be constructed in sequence so that only
one-half of the width of the creek will be blocked at any time.
The cofferdams are to be constructed to a sufficient height above the
existing water elevation (10 feet) to provide a stable working area for
pipeline installation. The lines are to be installed approximately 14 feet
below channel substrates. All fill material used to construct cofferdams is
to be obtained from a high ground source and removed from the channels after
the lines are installed. All excess material from trench excavation is to
also be removed to high ground. The applicant estimates that all construction
will not require more than 20 working days per site. Detailed construction
drawings can be made available upon request. Plans showing the work sites are
included with this public notice.

The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 10 of the River
and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act
(33 U.S.C. 1344). Any person may request, in writing within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksite is not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, "prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer-has determined, based on a review of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the proposed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under wh~ch
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of

property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if the discharge tqat would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 7, 1987.

PUBLIC NOTICE
THE CITY OF RALEIGH, represented by MR. DEMPSEY E. BENTON, JR., City
Manager, Post Office Box 590, Raleigh, North Carolina 27602-0590, has applied
for a Department of the Army permit TO TEMPORARILY PLACE FILL MATERIAL FOR
CONSTRUCTION OF COFFERDAMS AND TO INSTALL SANITARY SEWER PIPELINE CROSSINGS AT
TWO SITES ON THE NEUSE RIVER AND AND ONE SITE ON CRABTREE CREEK ASSOCIATED
WITH THE UPPER NEUSE RIVER INTERCEPTOR SEWER SYSTEM, EAST OF RALEIGH, Wake
County, North Carolina.
The following description of the work is taken from data provided by the
applicant and from observations made during an onsite visit by a
representative of the Corps of Engineers. Plans submitted with the
application show two crossings of the Neuse River and one crossing of Crabtree
Creek. The first site on the Neuse River, Cofferdam A, is located immediately
downstream of the confluence of Beaverdam Creek with the Neuse River. At this
site, a 66-inch diameter concrete gravity sanitary sewer main is to span the
approximate 170-foot-wide channel. Two coffer dams are to be constructed, in
sequence, so that only one-half of the width of the river will be blocked at
any time. The second site on the Neuse River, Cofferdam B, is lo~ated
immediately upstream of the confluence of the discharge of Beaverdam Lake with
the Neuse River. At this site, there are two river channels, 70- and 90-foot-
wide, bisected by an island. A 66-inch diameter concrete gravity sanitary
sewer main is to be installed. Cofferdams are to be constructed to cross each
channel in a single oper~tion. Only one channel will be obscured at anyone
time. The site on Crabtree -Creek, Cofferdam C, is located approximately 1,000
feet upstream of the confluence of the Neuse River with Crabtree Creek. At
this site, a 42-inch-diameter conc~ete or ductile iron pressure sanitary sewer
main is to be installed to span the approximate 90-foot-wide channel. As with
Cofferdam A, two cofferdams are to be constructed in sequence so that only
one-half of the width of the creek will be blocked at any time.
The cofferdams are to be constructed to a sufficient height above the
existing water elevation (10 feet) to provide a stable working area for
pipeline installation. The lines are to be installed approximately 14 feet
below channel substrates. All fill material used to construct cofferdams is
to be obtained from a high ground source and removed from the channels after
the lines are installed. All excess material from trench excavation is to
also be removed to high ground. The applicant estimates that all construction
will not require more than 20 working days per site. Detailed construction
drawings can be made available upon request. Plans showing the work sites are
included with this public notice.

The State of North Carolina will review this public notice to determine
the need for the applicant to obtain any required State authorization. No
Department of the Army permit will be issued until the coordinated State
viewpoint on the proposal has been received and reviewed by this agency, nor
will a Department of the Army permit be issued until the North Carolina
Division of Environmental Management has determined the applicability of a
Water Quality Certificate as required by PL 92-500.
This application is being considered pursuant to Section 10 of the River
and Harbor Act of 1899 (33 U.S.C. 403) and Section 404 of the Clean Water Act
(33 U.S.C. 1344). Any person may request, in writing within the comment
period specified in this notice, that a public hearing be held to consider
this application. Requests for public hearing shall state, with
particularity, the reasons for holding a public hearing.
The District Engineer has consulted the latest published version of the
National Register of Historic Places for the presence or absence of registered
properties, or properties listed as being eligible for inclusion therein, and
this worksiteis not registered property or property listed as being eligible
for inclusion in the Register. Consultation of the National Register
constitutes the extent of cultural resource investigations by the District
Engineer, and he is otherwise unaware of the presence of such resources.
Presently, unknown archeological, scientific, prehistorical, or historical
data may be lost or destroyed by work under the requested permit.
The District Engineer has determined, based on a r~view of data furnished
by the applicant and onsite observations, that the activity will not affect
species, or their critical habitat, designated as endangered or threatened
pursuant to the Endangered Species Act of 1973.
The decision whether to issue a permit will be based on an evaluation of
the probable impacts, including cumulative impacts, of the proposed activity
and its intended use on the public interest. Evaluation of the probable
impacts which the propo~ed activity may have on the public interest requires a
careful weighing of all those factors which become relevant in each particular
case. The benefits which reasonably may be expected to accrue from the
proposal must be balanced against its reasonably foreseeable detriments. The
decision whether to authorize a proposal, and if so the conditions under which
it will be allowed to occur, are therefore determined by the outcome of the
general balancing process. That decision should reflect the national concern
for both protection and utilization of important resources. All factors which
may be relevant to the proposal must be considered including the cumulative
effects thereof. Among those are conservation, economics, aesthetics, general
- environmental concerns, wetlands, cultural values, fish and wildlife values,
flood hazards, flood plain values, land use, navigation, shore erosion and
accretion, recreation, water supply and conservation, water quality, energy
needs, safety, food and fiber production, mineral needs, considerations of

property ownership, and, in general, the needs and welfare of the people. For
activities involving the placement of dredged or fill materials in waters of
the United States, a permit will be denied if 'the discharge that would be
authorized by such permit would not comply with the Environmental Protection
Agencies' 404(b)(1) guidelines. Subject to the preceding sentence and any
other applicable guidelines or criteria, a permit will be granted unless the
District Engineer determines that it would be contrary to the public interest.
Generally, the decision whether to issue this Department of the Army
permit will not be made until the North Carolina Division of Environmental
Management (DEM) issues, denies, or waives State certification required by
Section 401 of the Clean Water Act. The DEM considers whether or not the
proposed activity will comply with Sections 301, 302, 306, and 307 of the
Clean Water Act. The application and this public notice for the Department of
the Army permit serves as application to the DEM for certification.
Additional information regarding the Clean Water Act certification may be
reviewed at the offices of the Environmental Operations Section, North
Carolina Division of Environmental Management, Salisbury Street, Archdale
Building, Raleigh, North Carolina. Copies of such materials will be furnished
to any person requesting copies upon payment of reproduction costs.
The North Carolina Division of Environmental Management plans to take
final action in the issuance of the Clean Water Act certification on or after
December 7, 1987.

Enclosed is the application of the City of Raleigh for a
Department of the Army permit and a State Water Quality
Certification to place fill material in waters and wetlands of the
Neuse River and Crabtree Creek for cofferdams associated with the
installation of sanitary sewer pipeline crossings, Raleigh, Wake
County, North Carolina. Your receipt of this letter verifies your
acceptance of a valid request for certification in accordance with
Section 325.2(b)(ii) of our administrative regulations.
We are considering authorization of the proposed activity
pursuant to Section 404 of the Clean Water Act, and we have
determined that a water quality certification may be required
under the provisions of Section 401 of the same law. A Department
of the Army permit will not be granted until the certification has
been obtained or waived.
In accordance with our administrative regulations, 60 days
after receipt of a request for certification is considered a
reasonable time for State action. Therefore, if your office has
not acted on the request by January 10, 1988, the District
Engineer will deem that waiver has occurred.

The City of Raleigh requests the consideration of the Corps of
Engineers of the issuance of the appropriate permit to allow its
contractors to install temporary cofferdam structures crossing the
Neuse Rive~ to facilitate the installation of its proposed Upper Neuse
River Interceptor Sewer System.
The mailing address for all correspondence pertaining to this
application is D, E. Benton, Jr" Manager, City of Raleigh, Post Office
Box 590, Raleigh, North Carolina 27602-0590. The project is sited
entirely within ~ake County, proximate to the Neuse River, east of
Raleigh.
The entire pipeline project site consists of approximately 19 miles of
easeiment being 40 to 60 feet invidth. Construction time for the entire
period of the associated construction project viII be 24-30 months from
.initial phases of pipe laying operation.
The installation of the Upper Neuse River Interceptor Sever System and
Neuse/Crabtree pumping station.<,f;orced main necessi tate the installation
of pipelines crossing these water courses. The shallow botton of these
'Ja ter courses is sill t and sediment, Evidence indicates that ledge rock-
may be encountered vi thin" the' elevations, of the pro'pbsed pipeline
installations.

proposed,
DETAILED DESCRIPTION OF SITES:
A, Crossing the Neuse River channel immediately dovnstream of the
confluence of the Beaverdam Creek yith the Neuse River.
Installation of a 66" diameter concrete gravity sanitary sever main
is proposed. Channel is aproximately 170' vide. Tyo cofferdams
will be utilized to cross Ithe river approxiaately 1/2 of yidth at a
time.
B. Crossing the Neuse River channels (river channel is bisected by an
island) at a point immediately upstream of tbe confluence of the
discharge of Beaverdaa Lake with the Neuse River. Installation of a
66" diameter concrete gravity sanitary sever main is proposed.
Vestern channel is approximately 70' vide, eastern channel is
approximately 95' vide, Cofferdams viII be used to cross each
channel fully in a single operation. Only one channel viII be
obscured at a time.
C. Crossing Crabtree Creek channel approximately 1000' upstream of the
confluence of the Neuse River vith Crabtree Crec-k. Installation of
a 42~ diameter concrete or ductile iron pressure sanitary sever
/ilain is proposed. Channel is approximately 90' vide. Tvo
cofferdams viII be utilized to cross the creek approximately 1/2 of
width at a time,
DETAILED CONSTRUCfION SEQUENCE TO BE UTILIZED
1. The contractor shall install a "J"

installation .techniques. The contractor may, at his expense,
install ~heet piling to secure the trench sides from collapse, if
necessary to comply with safety regulations.
4, After installation, and joint testing of the pipeline,
contractor shall backfill the trench.
5; The contractor shall carefully remove the select backfill placed

botton, and dispose of the material so reaoved off-site, and in a
spoil si te approved and permi t ted yi thin the soil erosion and

GENERAL DESCRIPTION OF VORK INVOLVED
A Cofferdam fill vill be installed of sufficient height to bring the
top above the then existing vater level of the vater course a
sufficient amount to provide a stable vorking area to provide for the
pipeline installation.
The Quantity of fill material to be installed for the construction of
the cofferdams viII be approximated based upon a rip-rap ber. 7' vide
at top and 20' vide at bottom, with an assumed vater depth of 10'. Tbe
earthen fill aaterial vithin the cofferdaa is calculated to indicate a
top of fill vidth of to be 50' vith an angle of repose of 2:1
horiz:vert. The 50' top vidth is the miniaum area that viII provide for
a safe vorking surface, given the class of equipment that viII be
necessary to install the proposed carrier pipe. All of the cofferdam
material viII be removed from the river channel. The quanti ty has heen
overstated by 20t to provide for the required overlap of successive
cofferdams installed from opposite sides of the channel. The vater
depth is assuaed to be a uniform 6' for the quantity calculations,
recognizing that the vater depth is not constant during the year.

Fill material for the construction of the earthen protion of the
cofferdams viII be secured by the contractor froE sites not within tbe
regulatory vetlands, but approval of his intende~ site viII be revieved
by the City and his proposed erosion control techniques viII be subject
to the provisions of the City and State Sedimentation and Erosion
regulations, The rip-rap portion of the proposed cofferdams viII be
acquired from a commercial aggregates supplier.
The depth of excavation of trench for the installation of pipeline viII
be approximately 14' beloy the bottom of the existing channel bottom of

The City of Raleigh requests the consideration of the Corps of
Engineers of the issuance of the appropriate permit to allow its
contractors to install temporary cofferdam structures crossing the
Neuse River to facilitate the installation of its proposed Upper Neuse
River Interceptor Sewer System.
The mailing address for all correspondence pertaining to this
application is D. E. Benton, Jr" Manager, City of Raleigh, Post Office
Box 590, Raleigh, North Carolina 27602-0590. The project is sited
entirely within Yake County, proximate to the Neuse River, east of
Raleigh.
The entire pipeline project site consists of approximately 19 miles of
easement being 40 to 60 feet in width. Construction time for the entire
period of the associated construction project will be 24-30 months from
,initial phases of pipe laying operation.
The installation of the Upper Neuse River Interceptor Sewer System and
Neuse/Crabtree pumping station forced main necessitate tha installation
of pipelines crossing these water courses. The shallow bottom of these
water courses is silt and sediment. Evidence indicates that ledge rock
may be encountered within the elevations of the proposed pipeline
installations.

DETAILED DESCRIPTION OF SITES:
A. Crossing the Neuse River channel immediately downstream of the
confluence of the Beaverdam Creek with the Neuse River.
Installation of a 66" diameter concrete gravity sanitary sewer main
is proposed. Channel is aproximately 170' wide. Two cofferdams
will be utilized to cross the river approximately 1/2 of width at a
time.
B. Crossing the Neuse River channels (river channel is bisected by an
island) at a point immediately upstream of the confluence of the
discharge of Beaverdam Lake with the Neuse River. Installation of a
66" diameter concrete gravity sanitary sewer main is proposed.
Yes tern channel is approximately 70' wide, eastern channel is
approximately 95' wide. Cofferdams will be used to cross each
channel fully in a single operation. Only one channel will be
obscured at a time.
C. Crossing Crabtree Creek channel approximately 1000' upstream of the
confluence of the Neuse River with Crabtree Creek. Installation of
a 42" diameter concrete or ductile iron pressure sanitary sewer
main is proposed. Channel is approximately 90' wide. Two
cofferdams will be utilized to cross the creek approximately 1/2 of
width at a time.
DETAILED CONSTRUCTION SEQUENCE TO BE UTILIZED

of the proposed pipeline, utilizing conventional pipeline
installation techniques. The contractor may, at his expense,
install sheet piling to secure the trench sides from collapse, if
necessary to comply with safety regulations.
4. After installation, and joint testing of the pipeline,' the
contractor shall backfill the trench.
5. The contractor shall carefully remove the select backfill placed
within step 3, above, down to the original contour of the channel
bottom, and dispose of the material so removed off-site, and in a
spoil site approved and permitted within the soil erosion and
sedementation provisions of the contract.

dispose of off-site, or re-use, as permitted by the engineer.

The Quantity of fill material to be installed for the construction of
the cofferdams will be approximated based upon a rip-rap berm 7' wide

cofferdams installed from opposite sides of the channel. The water
depth is a~sumed to be a uniform 6' for the quantity calculations,
recognizing that the water depth is not constant during the year.

Fill material for the construction of the earthen protion of the
cofferdams will 'be secured by the contractor from sites not within the
regulatory wetlands, but approval of his intended site will be reviewed
'by the City and his proposed erosion control techniques will be subject
to the provisions of the City and State Sedimentation and Erosion
regulations. The rip-rap portion of the proposed cofferdams will be
acquired from a commercial aggregates supplier.
The depth df excavation of trench for the installation of pipeline will
be approximately 14' below the bottom of the existing channel bottom of
the Neuse River. The material to be removed from the trench excavations
and replaced, as backfill over the pipeline, will be:

Material removed from either the trench for the pipeline that is not
reinstalled as backfill in restoring the trench bottom to original
contour, or as material removed from the construction of the temporary

Construction equipment anticipated for the installation of cofferdams,
excavation of trench material for pipeline installations, backfill of

probability, include: 4 cy - 5 cy hydraulic backhoe, 100 ton crane, 5
cy dragline or clamshell, tracked loaders and dozers of various size.
The actual installation of cofferdam, pipeline and removal of the
cofferdam material will not require more than 20 working days per
cofferdam.
