Your proposal has been reviewed and found to be consistent with the provisions and objectives of general permit No. SAWC080- N-000-0291. Therefore, you may commence construction activity in strict accordance with applicable State authorization, the enclosed plan and the following condition: In conjunction with excavation of the channel/canal, the permittee will mitigate the proposed loss of vegetated wetlands by grading a 450 square foot area of high ground to marsh elevation and sprigging this area with the mixed cordgrass (Spartina alterniflora) and black needle rush (Juncus roemerianus) removed from the area of vegetated wetlands to be excavated. Failure to comply with the aforementioned condition, the State authorization or conditions of the general permit could result in a violation of Federal law. If any change in your work is required because of unforeseen or altered conditions or for any other reason, plans revised to show the change must be sent promptly to this office and the North Carolina Division of Coastal Management prior to performing any such change or alteration. Styron Star Route, Box 14 Cedar Island, North Carolina 28516 Dear Mr. Styron: By copy of North Carolina Department of Natural Resources and Community Development letter to you of January 6, 1987, we have been informed that your application for State authorization to excavate a channel/canal and basin off Cedar Island Bay, Cedar Island, Carteret County, North Carolina, has been denied. Under the administrative rules of our regulatory program, denial of required State authorization precludes favorable consideration of a Federal permit. Accordingly, your Department of the Army application is hereby denied, and your file has been retired. Additionally, by letter of September 17, 1986 (copy enclosed), we received unfavorable comments from the U.S. Environmental Protection Agency. This agency's reaction to your proposal is the result of anticipated significant adverse impacts on water quality. I have provided these comments to alert you to concerns in addition to those identified in the State's denial letter. While appeali ng the State permit is the next step in pursuing State authorization, you should be aware that Federal agency comments will be unchanged by the outcome of that appeal. Because of the U.S. Environmental Protection Agency's influence on Department of the Army regulatory decisions, it is unlikely a Department of the Army permit would be available unless your project can be modified to lessen its impacts. The property is about 1/4 mile. north of the Post Office, immediately south of a r~cent project undertaken by Eugene Styron under Permit No. 97-85. The property is undeveloped and wooded by pines and oaks. The' soils are . composed of deep, ,extremely fine sand.' The shoreline is bor- dered by a wide fringe of marsh and transitional species composed of myrtle, saltmeadow grass,' black needlerush and smooth cordgrass. Most of the'myrtle and saltrneadow grass are found above MHW and are' fed by a salt spray or unusual high tides. Dear Cblonel WXJdbury: This is in response to the subject public notice proposing to excavate a channel am basin off Cedar Island Bay, Cedar Island, Carteret County, North Carolina. As a result of this activity, a 14 ft wide by 150 ft. long by -6 ft. MWL access channel and a 50-ft. square by -6 ft. MI.W upland boat basin will be created. The channel excavation portion of the project will also involve a connection to an existing -6 ft. MLW deep channel leading to an adjacent property owner. This will require the excavation of 280 sq. ft. of productive intertidal zone and 448 sq. ft. of mixed cordgrass (Spartina alterniflora}and black needlerush (Juncus roemerianus) salt marsh. Tidal salt marsh wetlands perfonn valuable functions to aquatic systems including: wildlife habitat values, water quality services and vital storm water retention capabilities. It is clear that the fill activity will el~nate a valuable aquatic resource and could result in poor water quality conditions wi thin the access channel and boat basin. These environmental problems becane more significant due to the fact that the adjacent waters are classified by the State of North Carolina as a primary nursery area open to shellfishing. The property is undeveloped and wooded by pines and oaks. The'soils are composed of deep, extremely fine sand.' The shoreline is bor- dered by a wide fringe of marsh and transitional species composed of myrtle, saltmeadow grass,' black needlerush and smooth cordgrass. Most of the'myrtle and saltmeadow grass are found above MHW and ar~ fed by a salt spray or unusual high tides.
