Reference your application for a Department of the Army permit
to excavate a channel/canal and basin off Cedar Island Bay, Cedar
Island, Carteret County, North Carolina.
Your proposal has been reviewed and found to be consistent
with the provisions and objectives of general permit No. SAWC080-
N-000-0291. Therefore, you may commence construction activity in
strict accordance with applicable State authorization, the
enclosed plan and the following condition:
In conjunction with excavation of the channel/canal, the
permittee will mitigate the proposed loss of vegetated wetlands by
grading a 450 square foot area of high ground to marsh elevation
and sprigging this area with the mixed cordgrass (Spartina
alterniflora) and black needle rush (Juncus roemerianus) removed
from the area of vegetated wetlands to be excavated.
Failure to comply with the aforementioned condition, the State
authorization or conditions of the general permit could result in
a violation of Federal law.
If any change in your work is required because of unforeseen
or altered conditions or for any other reason, plans revised to
show the change must be sent promptly to this office and the North
Carolina Division of Coastal Management prior to performing any
such change or alteration. Such action is necessary as revised
plans must be reviewed and the authorization modified.

This permit, issued on ~/ 11./'67 , is subject to compliance with the application (where consistent
, with the .permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may subject
permittee to a fine, imprisonment or civil action; or may cause the permit to be null and void.
(1) During excavation of the basin, an earthen plug wi 11 be left between the
basin and the Bay. To reduce the amount of suspended sediments from reaching
the Bay, a 24 hour period will elapse prior to removal of the plug.

(3) In order to protect water qual ity, runoff from the construction area must
not vi s; b 1y increase the amount of suspended sediments i'n adjacent waters.
(4) Spoil material resulting from the excavation must be graded and with stabilized
ground cover within 30 days of project completion.

This pennit action may be appealed by the pennittee
or other qualified persons within twenty (20) days of the
issuing date. An appeal requires. resolution prior to work
initiation or continuance, as the case may be.
This pennit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification
not covered hereunder requires further Departmental
approval.

Dear Mr. Styron:
By copy of North Carolina Department of Natural Resources and
Community Development letter to you of January 6, 1987, we have
been informed that your application for State authorization to
excavate a channel/canal and basin off Cedar Island Bay, Cedar
Island, Carteret County, North Carolina, has been denied. Under
the administrative rules of our regulatory program, denial of
required State authorization precludes favorable consideration of
a Federal permit. Accordingly, your Department of the Army
application is hereby denied, and your file has been retired.
Additionally, by letter of September 17, 1986 (copy enclosed),
we received unfavorable comments from the U.S. Environmental
Protection Agency. This agency's reaction to your proposal is the
result of anticipated significant adverse impacts on water
quality. I have provided these comments to alert you to concerns
in addition to those identified in the State's denial letter.
While appeali ng the State permit is the next step in pursuing
State authorization, you should be aware that Federal agency
comments will be unchanged by the outcome of that appeal. Because
of the U.S. Environmental Protection Agency's influence on
Department of the Army regulatory decisions, it is unlikely a
Department of the Army permit would be available unless your
project can be modified to lessen its impacts.

The Subject application has been reviewed for water
quality impacts and the following comments are offered:
1. The project as proposed will not require a 401
Water Quality Certification.
2. The project should be conducted in such a manner
so as to not cause turbidity in adjacent surface
waters to exceed 25 NTU's after a reasonble
opportunity for mixing.
3. The excavation of the basin and the majority of
the channel should be completed with an earthen
plug left in place separating the work from open
waters.
4. This basin should be restricted to boats used for
commercial fishing (no pleasure boats should be
allowed to dock within the facility).

The applicant proposes to excavate a channel and basin off Cedar
Island Bay, classified SA and open to shellfishing.
The project has been reviewed to determine impacts to water quality.
The following comments are offered:
1. That the project will not require 401 certification.
2. That the project must not raise the turbidity outside the
construction site above 25 NTUs.
3. That the excavation of the basin and the majority of the channel
be done with an earthen plug separating the work from the open
waters. '
4. The basin should be restricted to boats used for commercial
fishing (no pleasure boat docked within).
This office has no objection to the project provided the above
conditions are adhered to.

The applicant's property is a tract approximately one-half acre
in size located off Hwy. 12 on Cedar Island Bay, Cedar Island, Car-
teret County. The property is about 1/4 mile. north of the Post
Office, immediately south of a r~cent project undertaken by Eugene
Styron under Permit No. 97-85.
The property is undeveloped and wooded by pines and oaks. The' soils
are . composed of deep, ,extremely fine sand.' The shoreline is bor-
dered by a wide fringe of marsh and transitional species composed
of myrtle, saltmeadow grass,' black needlerush and smooth cordgrass.
Most of the'myrtle and saltrneadow grass are found above MHW and
are' fed by a salt spray or unusual high tides. The remaining marsh
fringe b~ders most of the shoreline in this area and"borders the
entirety of this tract, being as much as 30' (or wider) in places.

10. Anticipated impacts
This project will . involve the excavation of a 14' wide by 150' long
channel which will lead to a 50' square highground basin. Proposed
'depths will be to -6' NWL. The channel excavation will involve con-
'nection to an existing 6' deep channel leading into the Eugene
Styron project and will require the removal of 280 sq. ft. of shallow
intertidal area and 448 sq. ft. of mixed smooth cordgrass and black
needlerush marsh. The remainder of the channel and basin will be on
high ground and will disturb approximately 2,920 sq. ft. The spoil
'material will amount to about 1,222 cu.yds and will be bermed over
!, 6,000 sq.ft on the north side of the 'basin.
Adjacent waters are classified as a primary nursery area by DMFi are
classified as SA ,by DEM and are currently open to shell fishing ac-
cording to the Div. of Health Services.

Reference the application of Mr. Raymond G. Styron for a
Department of the Army permit to excavate a channel/canal and
basin off Cedar Island Bay, Cedar Island, Carteret County, North
Carolina.
The Federal agencies have completed review of the proposal as
presented by the application and your field investigation report.
The U.S. Environmental Protection Agency (EPA), by letter of
September 17, 1986 (copy enclosed), recommends that the
application be denied because of the proposed excavation of salt
marsh wetlands and the anticipated degradation of water quality
within an area classified as a primary nursey area open to
shellfishing. We concur with this recommendation.

Dear Cblonel WXJdbury:
This is in response to the subject public notice proposing to excavate a
channel am basin off Cedar Island Bay, Cedar Island, Carteret County,
North Carolina.
As a result of this activity, a 14 ft wide by 150 ft. long by -6 ft. MWL
access channel and a 50-ft. square by -6 ft. MI.W upland boat basin will
be created. The channel excavation portion of the project will also
involve a connection to an existing -6 ft. MLW deep channel leading to an
adjacent property owner. This will require the excavation of 280 sq. ft.
of productive intertidal zone and 448 sq. ft. of mixed cordgrass (Spartina
alterniflora}and black needlerush (Juncus roemerianus) salt marsh.
Tidal salt marsh wetlands perfonn valuable functions to aquatic systems
including: wildlife habitat values, water quality services and vital
storm water retention capabilities.
It is clear that the fill activity will el~nate a valuable aquatic
resource and could result in poor water quality conditions wi thin the
access channel and boat basin. These environmental problems becane more
significant due to the fact that the adjacent waters are classified by
the State of North Carolina as a primary nursery area open to shellfishing.
Consequently, it is our opinion that the protx>Sed project will result in
unacceptable adverse aquatic impacts and should be denied.

On February 6, 1986, we renewed general permit No. SAWC080-N-
000-0291 (enclosed), which provides Federal authorization for
construction activities that receive authorization from the State
of North Carolina.
A review of your application received September 4, 1986, for a
Department of the Army permit to excavate a channel/canal and
basin off Cedar Island Bay, Cedar Island, Carteret County, North
Carolina, indicates it to be a candidate for Federal authorization
under this general permit. Accordingly, the administrative
processing of your application will be accomplished by the North
Carolina Division of Coastal Management. Comments from Federal
review agencies will be furnished to the State.
If your application must be withdrawn from this general permit
process for any reason, you will be written and informed of its
further management. If there are no unresolved differences of
State-Federal positions or policy, the final action taken on your
~pplication by the State will result in your receiving written
notice from us that your application has been successfully
processed under our general permit. Only after receiving such

The applicant's property is a tract approximately one-half acre
in size located off Hwy. 12 on Cedar Island Bay, Cedar Island, Car-
teret County. The property is about 1/4 mile, north of the Post
Office, immediately south of a r7cent project undertaken by Eugene
Styron under Permit No. 97-85.
The property is undeveloped and wooded by pines and oaks. The'soils
are composed of deep, extremely fine sand.' The shoreline is bor-
dered by a wide fringe of marsh and transitional species composed
of myrtle, saltmeadow grass,' black needlerush and smooth cordgrass.
Most of the'myrtle and saltmeadow grass are found above MHW and
ar~ fed by a salt spray or unusual high tides. The remaining marsh
fringe borders most of the shoreline in this area and' borders the
entirety of this tract, being as much as 30. (or wider) in places.

10. Anticipated impacts
This project will involve the excavation of a 14' wide by 150' long
channel which will lead to a 50' square highground basin. Proposed
. depths will be to -6' NWL. The channel excavation will involve con-
nection to an existing 6' deep channel leading into the Eugene
Styron project and will require the removal of 280 sq. ft. of shallow
intertidal area and 448 sq. ft. of mixed smooth cordgrass and black
needlerush marsh. The remainder of the channel and basin will be on
high ground and will disturb approximately 2,920 sq. ft. The spoil
,.material will amount to about 1,222 cu. yds and will be bermed over
6,000 sq.ft on the north side of the basin.
Adjacent waters are classified as a primary nursery area by DMFi are
