Farms 1190 Fallview Rd Boomer, NC 28606 NORTH CAROLINA Environmental Quality August 6, 2019 SUBJECT: Notice of Deficiency: NOV-2019-PC-0177 Certificate of Coverage #AWC970003 Facility #97-03 Wilkes County Dear Mr. Weston: This Notice is a follow-up to the routine Compliance Inspection conducted by Division of Water Resources (DWR) staff on July 10, 2019. A follow-up inspection is scheduled for August 7, 2019 at 10:00am. Violations Silage leachate was observed to be overflowing and discharging into Warrior Creek (Class C stream) on the subject property. A leachate diversion ditch was overflowing into the stream during the time of inspection. This is a violation of Permit Condition V.1 which states the Permittee is responsible for compliance with all surface water standards and for damages to surface waters. Additionally, the potential for adverse impacts to waters of the State exists as low dissolved oxygen is often associated with this type of impact. 15A NCAC 28 water quality standards stipulate that dissolved oxygen in Class C waters may not be less than a daily average of 5.0 mg/1 with a minimum instantaneous value of not less than 4.0 mg/l. DWR staff understand that you plan to extend the diversion ditch away from the stream bank and into a grassy area further downslope from the existing ditch end. A follow-up inspection has been scheduled for August 7 at 10:00 am to review this repair and assess the condition of the diversion ditch. Other Concerns: 1. Permit Condition 111.11 requires all nutrient sources, including commercial nitrogen, be recorded. Please be sure to keep commercial nitrogen application up to date in your waste application records in order to maintain the Plant Available Nitrogen balance. 2. Permit Condition 11.4 states that in no case shall land application rates exceed the agronomic rate of the nutrient of concern for the receiving crop. While an overapplication of Nitrogen on corn was noted, it was also determined that the calculations were not all correct. Please ensure that Nitrogen application rates are properly calculated so that tracking of Plant Available Nitrogen is accurate and up to date.
