Box 30013 Raleigh, N.C. 27622-0013 Ad03 3111 Dear Mr. Long: You have our approval to place fill material in 2.5 acres of wetlands or waters for the purpose of mine development at Maiden Quarry, as you described in your application dated 9 August 1994. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 2671. This certification allows you to use Nationwide Permit Number 26 when it is issued by the Corps of Engineers. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application. For this approval to be valid, you must follow the conditions listed in the attached certification. Additional conditions are that 1) a 100 foot buffer must be maintained around the remaining wetlands on the site and 2) if monitoring well data show that wetland hydrology is being inadvertently removed, the water shall be directed into the wetland to restore its hydrology. In addition, you should get any other federal, state or local permits before you go ahead with your project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 30 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Environmental Management under Section 401 of the Clean Water Act. If you have any questions, please telephone John Dorney at 919-733- 1786. Chapin and Dorney: Wetlands Group The purpose of this letter is to request approval of the enclosed permit application for the proposed Martin Marietta, Maiden Quarry. Please find enclosed our permit application, site plans showing location of jurisdictional wetlands and proposed impact acreage for the quarry. All impacts are to occur in a maintained pasture and an intermittent steam. Steve Chapin of the Corps has visited the site during review of the wetlands and made suggestions on minimization and avoidance which we have incorporated into the proposed plan. Map 1 indicates the revised site plan. Rather than piecemeal permit over the next few years our client would rather be "up front' about their long range plans and address them all in this application even though some will occur sooner than others. The pasture wetland was flagged and located by GPS (Global Positioning) (See attached map points JP1 thru JP8). The Corps agreed that we did not need to flag the stream channels or locate them and that we could use the average channel widths shown on the attached map to calculate acreage impacts. Several small 20'x 20' pockets of wetland were also found which will not need to be located but are considered in impact calculations. We also discovered a signif icant high quality wooded wetland area adjacent to the Edith Proctor Wilson Property. It was flagged and located by GPS as well (see attached Map Points WL1 thru WL14). Map 2 indicates to old site plan and shows approximate wetland locations. The long range need of our client involves eventually including all the jurisdictional areas on-site except the intermittent stream on the southern border, Soil/Site Evaluation ¦ Mapping and Physical Analysis ¦ Wetlands Mapping and Mitigation ¦ Environmental Audits On-Site Waste Treatment Systems, Evaluation and Design Clarks Creek and the high quality wooded wetlands adjacent to Clarks Creek (see Map). The total impact of berms roads lake and pit would be 2.5 acres above headwaters. (1 acre of channels and 1.5 acres of vegetated °juncus pasture". The lower parts of the intermittent stream to be impacted have been channelized during agricultural operations on the past. The upper reaches contain deeply incised channels which often contain bare rock at the bottom. Our client and S&EC will be glad to meet other involved agencies on-site to discuss this project further. Please call if you have questions.
