REGAN Secretary LMA CULPEPPER Interim Director This Notice is a follow-up to the routine Compliance Inspection conducted by Division of Water Resources (DWR) staff Melissa Rosebrock and Rebecca Chandler on December 14, 2017. The compliance report also documents that you and Brent Woody were present for the inspection. A review of the farm, and the required waste management records, indicates that several mandatory items have not been addressed or recorded. A "final copy" of the report is attached for your review. Violations 1. Animal waste has not been contained to the calving lot and has been flowing and accumulating downhill, only 90-feet from a well. Additionally, several hundred gallons of slurry waste has been pushed from the barn and has flowed and accumulated on the ground, within 60-feet from a well. Per the Certified Animal Waste Management Plan's (CAWMP) "Required Specifications for Animal Waste Management," waste may not be applied closer than 100-feet to a well. Both areas pose a potential ground water concern, therefore, the waste must be removed immediately and properly land applied. Be advised that failing to abide by the CAWMP is a violation of permit condition 1.3. 4, 2. The uncovered, concrete, milk parlor waste pit is not certified or properly addressed or t managed through the CAWMP. Per the CAWMP, the parlor waste was to be piped into the - new waste pond. Uncontained waste from the push -off ramp was also to have been piped to the new waste pond in 2016. Failure to abide by the CAWMP is a violation of Condition 1.3. of the permit. 3. As required by the Certificate of Coverage (COC) issued March 11, 2016, PLAT (Phosphorous Loss Assessment Tool) was to be run on Tract 30637 (Fields 1-6) within 180 days of issuance. �In This evaluation is to determine the facility's ability to comply with the NRCS nutrient k ` management standard as it relates to phosphorous. Failure to conduct the required PLAT evaluation is a violation of Condition 1.5. of the permit. You should contact your technical specialist for assistance with completing this task. The results should be forwarded to DWR. 4. The permit requires that a representative sample of the animal waste be obtained within 60-days (before or after) the date of application. Waste management files indicate that there were no waste analyses for the February -June 2017 application events. Failure to obtain the required waste sample/analysis is a violation of Section 111.5. of the permit. Note that some permittees find it helpful to sample each quarter so that they have the year "covered." There is a waste analysis form attached for your use. 5. DWR staff were not able to evaluate land application compliance since there was no plant available nitrogen (PAN) balance determined for any of the fields. Please complete the SLUR-1 and SLUR-2 forms using the load data that you recorded, and the most recent waste analysis, then submit the forms for our review. Failure to properly record all land application events is a violation of permit Conditions 111.6. and 111.11. 6. Additional required records were missing which violated several permit conditions: permit and COC (111.11.), stocking (111.8. and 111.11.), weekly freeboard (111.2. and 111.11.), weather code (11.22.), crop yield (111.11.), and rainfall (111.11.). Again, failure to maintain required records are a violation of your permit. A copy of the COC and permit is attached for your records. Don't hesitate to contact our office, or a technical specialist, to request a copy of any of the recordkeeping forms, or if you need assistance completing them. 7. One cow, which had been dead more than 24-hours, was observed in the lot north of the parlor. The carcass was to have been picked up later in the day on December 14, 2017. A reminder that the failure to dispose of dead animals according to the CAWMP is a violation of Condition 11.10. of the permit. Other Concerns:. 1. Sediment and manure was observed in the stream within the buffer area in the denuded lot north of the parlor. As discussed with DWR staff, the buffer must be increased to help exclude waste and sediment caused by excessive cattle activity surrounding the buffer. A 20-foot wide crossing may be installed if desired. This is to be completed by April 1, 2018. W008y — NOV January 8, 2018 Page 3 2. Maps for Tract 3582 (Fields 1-4) and Tract 3566 (Fields 1,2,4) are included in the waste plan but there is no allowable PAN listed for each field. Contact your technical specialist immediately for assistance. 3. Manure from the milk parlor lot is also leaking through the concrete berm. As discussed during the inspection, it is our expectation that this repair has already been made. If not, it should be addressed immediately.
