A copy of the General Certification is attached. This Certification may be used in qualifying for coverage under Corps of Engineers' Nationwide Permit No. 12. If this Certification is unacceptable to you, you have the right to an adjudicatory hearing upon written request within thirty (30) days following receipt of this Certification. This request must be in the form of a written petition conforming to Chapter 150B of the North Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. RE: DEM comments on Town of Chocowinity utility line Beaufort County DEM # 94090 DEM has reviewed the plans for the Town of Chocowinity to build utility lines across Chocowinity Creek to serve Cypress Landing subdivision. DEM has no objection to the construction of the utility lines. You asked whether the Town of Chocowinity and City of Washington have wastewater treatment capacity available for use by this development. According to the DEM Washington Regional Office, there is wastewater capacity for the first phase of this development in Cypress Landing. However there is not sufficient capacity for the entire development. If (as you indicated) this first phase of the development will require 100,000 gallons of capacity, the current Washington treatment plant can treat this volume. PROJECT SUMMARY: The applicant is proposing to construct wastewater and potable water lines to serve Cypress Landing residential development. ' TOWN OF CHOCOWINITY Beaufort County Environmental setting The project site is where Chocowinity Creek, a tributary of Chocowinity Bay and the Pamlico River, crosses NC 33 approximately 1 mile east of the Town of Chocowinity in Beaufort County. At the site, the creek has a width of approximately 170' and a average depth of -3' at normal water level. In the center of the creek is an island which is approximately 40' in width and is vegetated by various types of wetland vegetation such as uncu fe fusus, Hibiscu VR,, 1So idago 5pp,, etc. On both the east and west sides of the creek, the adjacent lands have been previously disturbed by road construction. These areas are vegetated by a mixture of upland grasses. Project proposal The purpose of the proposed project is to provide wastewater collection and to provide potable water to the proposed Cypress Landing Development which is being constructed by Weyerhaeuser Real Estate on Chocowinity Bay. The development along with its amenities were previously permitted by the North Carolina Division of Coastal Management in 1989 when CAMA Major Development Permit No. 181-89 was issued. At that time, the development was proposing its own land application sewage disposal system and well system for potable water. Since that time, arrangements have been made with the Town of Chocowinity and the City of Washington to provide the services. In order to construct the necessary lines, Chocowinity Creek must be crossed resulting in the application that is being considered. The applicant is now proposing the following: (1) The construction of 14,000 linear feet of 6" sanitary sewer force main and a 10" water main along SR 1123 and NC 33 for connection into existing Town of Chocowinity lines. At Chocowinity Creek, the lines will be placed within existing NC Department of Transportation right-a-ways or the north side of NC 33. The lines will be placed approximately 10' apart within a subaqueous trench. The trench will be f 170' in length ±20' wide and the pipes will be placed a minimum of -3' below the existing creek bottom. Once the pipes are in place, the trench will be allowed to backfill naturally. The sides of the creek will be stabilized with 4" Geogrid along the disturbed area. Specifically, the extension includes approximately 14,000 linear feet of a 6-inch sanitary sewer force main and a 10-inch water main. The proposed route is from the development, northerly along NCSR 1123, NC 33, and Bragaw Lane in the Town of Chocowinity. The portion of this project to which this permit application applies is the subaqueous crossing of these utility pipes under Chocowinity Creek. This crossing will be made in NCDOT ROW, along the east side of the bridge carrying NC 33 over the creek. The application information is that associated directly with this utility project, except that information in Section S Upland Development pertains to the Cypress Landing project itself which has been permitted previously and separately. DEM has no objection to the construction of the utility lines. You asked whether the Town of Chocowinity and City of Washington have wastewater treatment capacity available for use by this development. According to the DEM Washington Regional Office, there is wastewater capacity for some development in Cypress Landing. However there is not sufficient capacity for the entire development. If (as you indicated) this phase of the development will require 100,000 gallons of capacity, the current Washington treatment plant can treat this volume. PROJECT SUMMARY: The applicant is proposing to construct wastewater and potable water lines to serve Cypress Landing residential development. TOWN OF CHOCOWINITY Beaufort County Environmental setting- The project site is where Chocowinity Creek, a tributary of Chocowinity Bay and the Pamlico River, crosses NC 33 approximately 1 mile east of the Town of Chocowinity in Beaufort County. At the site, the creek has a width of approximately 170' and a average depth of -3' at normal water level. In the center of the creek is an island which is approximately 40' in width and is vegetated by various types of wetland vegetation such as Juncus effusus, Hibiscus Vp., Solidag-o Vp., etc. On both the east and west sides of the creek, the adjacent lands have been previously disturbed by road construction. These areas are vegetated by a mixture of upland grasses. Project proposal The purpose of the proposed project is to provide wastewater collection and to provide potable water to the proposed Cypress Landing Development which is being constructed by Weyerhaeuser Real Estate on Chocowinity Bay. The development along with its amenities were previously permitted by the North Carolina Division of Coastal Management in 1989 when CAMA Major Development Permit No. 181-89 was issued. At that time, the development was proposing its own land application sewage disposal system and well system for potable water. Since that time, arrangements have been made with the Town of Chocowinity and the City of Washington to provide the services. In order to construct the necessary lines, Chocowinity Creek must be crossed resulting in the application that is being considered. The applicant is now proposing the following: (1) The construction of 14,000 linear feet of 6" sanitary sewer force main and a 10" water main along SR 1123 and NC 33 for connection into existing Town of Chocowinity lines. At Chocowinity Creek, the lines will be placed within existing NC Department of Transportation right-a-ways or the north side of NC 33. The lines will be placed approximately 10' apart within a subaqueous trench. The trench will be ± 170' in length ±20' wide and the pipes will be placed a minimum of -3' below the existing creek bottom. Once the pipes are in place, the trench will be allowed to backfill naturally. The sides of the creek will be stabilized with 4" Geogrid along the disturbed area. PROJECT SUMMARY: The applicant is proposing to construct wastewater and potable water lines to serve Cypress Landing residential development. TOWN OF CHOCOWINITY Beaufort County Environmental setting The project site is where Chocowinity Creek, a tributary of Chocowinity Bay and the Pamlico River, crosses NC 33 approximately 1 mile east of the Town of Chocowinity in Beaufort County. At the site, the creek has a width of approximately 170' and a average depth of -3' at normal water level. In the center of the creek is an island which is approximately 40' in width and is vegetated by various types of wetland vegetation such as Juncus effusus, Hibiscus spy, Solidago Vp., etc. On both the east and west sides of the creek, the adjacent lands have been previously disturbed by road construction. These areas are vegetated by a mixture of upland grasses. Project proposal The purpose of the proposed project is to provide wastewater collection and to provide potable water to the proposed Cypress Landing Development which is being constructed by Weyerhaeuser Real Estate on Chocowinity Bay. The development along with its amenities were previously permitted by the North Carolina Division of Coastal Management in 1989 when CAMA Major Development Permit No. 181-89 was issued. At that time, the development was proposing its own land application sewage disposal system and well system for potable water. Since that time, arrangements have been made with the Town of Chocowinity and the City of Washington to provide the services. In order to construct the necessary lines, Chocowinity Creek must be crossed resulting in the application that is being considered. The applicant is now proposing the following: (1) The construction of 14,000 linear feet of 6" sanitary sewer force main and a 10" water main along SR 1123 and NC 33 for connection into existing Town of Chocowinity lines. At Chocowinity Creek, the lines will be placed within existing NC Department of Transportation right-a-ways or.. the north side of NC 33. The lines will be placed approximately 10' apart within a subaqueous trench. The trench will be ± 170' in length ±20' wide and the pipes will be placed a minimum of -3' below the existing creek bottom. Once the pipes are in place, the trench will be allowed to backfill naturally. The sides of the creek will be stabilized with 4" Geogrid along the disturbed area. The proposed route is from the development, northerly along NCSR 1123, NC 33, and Bragaw Lane in the Town of Chocowinity. The portion of this project to which this permit application applies is the subaqueous crossing of these utility pipes under Chocowinity Creek.
