In reference to your letter dated November 5, 1993 (enclosed),
the work you requested has been completed as outlined below.
1. Hole 12B - The dissipator has been installed.
2. Hole 10B - The excavated channel has been closed with a
plug 20 feed wide.
3. The buffers referenced have been marked and presently the
grass is approximately two and one-half inches in height.
As soon as the new grass comes out of dormancy next
spring, we will maintain it between 3-5 inches as
required.
4. The trees have been planted in the disturbed wetland area
adjacent to the flood control structure as requested.

A compliance inspection of the subject project was conducted by P& Ron FamU of
my staff on October 20, 1993 M. Bic Alsmeyer, ll+lr. Tony Widws, Mr. L.oftee Smith and
W. Ran Gilnxwe were also present during the inspectiom. The purpose of the inspection was
to determine if the actions outlined in the water quality certification conditions issued rune
21, 1993 were being ir?piemented. The results of this inspection are oufted below.

my staff on October 20, 1993. Mr. Eric Alsmeyer, Mr. Tony Withers, Mr. Loftee Smith and
Mr. Ron Gilmore were also present during the inspection. The purpose of the inspection was
to determine if the actions outlined in the water quality certification conditions issued June
21, 1993 were being implemented. The results of this inspection are outlined below.
Hole 12B - The dissipator pad has not been installed.
2. Hole 10B - The excavated channel that drains the existing sediment basin is to
be closed with a plug at least 20 feet in width. The flow from this basin is to
be directed into the existing natural channel. No excavation or enlargement of
the natural channel is permitted.
3. Buffers are not being maintained adjacent to the streams and lakes as agreed
upon. Twenty-five foot buffers of 3-5" high grass are to be maintained
adjacent to all waterways that have not been stabilized with rip-rap. Fifty foot
buffers of 3-5" grass are required adjacent to all rip-rapped portions of
Crabtree Creek.
4. As agreed to by Mr. Ferrell last summer, the planting of the wetland trees in
the disturbed wetland area adjacent to the flood conirol structure and the green
of Hole 12B will be completed by December 31, 1993.

Thank you for meeting on site today to resolve the final wetlands and water quality questions.
Present at the meeting were Tom Jackson, Don Thomas, Tim Smith, Randy Smith, Tony
Withers, Loftee Smith, Ron Gilmore, Buddy Howard, Ron Ferrell, Eric Alsmeyer, Kevin
Martin, and Larry Sink. The purpose of the meeting was to discuss tie various construction
items that need to be completed in order to secure the 401 Water Quality Certification from the
State. The issues discussed dealt directly with the active portions golf course and subdivision
and focused on areas presently under construction or soon to be under construction. Several
wetlands areas that are being mapped still need to be finalized to include Preston Oaks, Preston
Grove, and Preston Wynds. These will be mapped by Larry Sink in the next several days, field
located, and final map revisions prepared and submitted including proposed impact if any. The
impacted areas as field viewed, discussed, and actions to be completed are itemized below as
follows:
(1) Hole 12B - A plastic pipe presently discharges into a sediment basin below the
12B green. Upon stabilization of the, fairway this basin is to be removed with
installation of the rip rap dissipator, the existing check dam size will be reduced
to approximately one half its present height, and additional marsh plantings will
be seeded around the dissipator.
(2) Hole 8B - Existing channel reconstruction was completed and looked very good.
Above the previously discussed and required channel improvements were periodic
check dams along the creek bottom approximately every 50' as well as a bridge
versus pipe over the creek at the tee area to further enhance the re-establishment
of the original creek and reduce additional impacts. The temporary earth crossing
approximately halfway down the hole will be removed and the new channel
section will be established as per the approved detail. Upon removal of the
temporary crossing the juncus grass from the original channel will be transplanted
to the improved channel. The check dams will remain in the channel and not be
removed. The original channel will be filled and taken out of service. The
discharge pipe adjacent to the 8B green will be tied to a catch basin and piped
under the creek into another catch basin at the current pipe discharge point just

above the wooden bridge. The basin on the east side of the creek will be
removed. The storm will be extended down to just below the bridge. At that
point a large flat swale will be graded from the elevation of the pipe outlet down
to the approximate edge of the existing wetland area with the anticipation of this
area holding_some water and returning to wetlands. All disturbed areas are to be
seeded._,,"" Upon completion of all construction the check dam at the lower end of
C A L c 'the wetland area will be carefully removed to allow water level to be exactly the
4 ? \ same as the control structure #18 water level.
(4) Hole 10B - The existing check dam beside Coles Branch will be left in place to
allow for detention in the existing channel. The sides will be sodded similar to
the cross section of the channel on Hole 8. We will also outlet the storm system
at the 10B tee in the channel upstream of the check dam.
(5) Hole IOB - The existing sediment basin approximately 100 yards in front of the
N,4- green on the left side of the fairway, presently receiving the discharge from four
fairway drainage pipes, will be cleaned up and rip rapped. The excavated outlet
channel will be filled/ Used so that when water discharges it will follow the
previously existing channel outlet.
(6) Hole 11B - The check dam at the outlet from the new pond into the existing
watershed control structure #18 will eventually be removed to allow the water
surface elevation for both ponds to remain the same. All storm discharges from
11B are received by this pond. A 25' stream buffer of approximately 3" to 5"
grass shall be maintained around the pond. No pesticides, fertilizers, or other
chemicals will be used in this buffer.
(7) Crabtree Creek - No additional rip rap will be used to stabilize the banks of the
?\ creek without prior approval. A 50' grass buffer approximately 3" to 5" in
eight will be maintained from the edge of the channel out into the rough/fairway
area. No pesticides, fertilizers, or other chemicals shall be used within this
buffer area. Tree growth within the rip rap sections can be cut, but other natural
vegetation will be allowed to grow.

(8) Preston Meadows Subdivision - The proposed wetland loss areas were
evaluated. The revised lot layout for Preston Meadows will show the loss of one
lot to reduce the wetland area impact beside the creek. We will also require deed
restrictions to prevent disturbance without further approval of these wetlands
areas. Finally we will direct storm water such that it will continue to provide
water to these areas.

(9) Beside Hole 9A (PM-5) - The existing road construction within Preston
Meadows can be completed with the revised lot layout showing the existing
channel flowing between two lots. No disturbance may occur in the existing
channel below wetlands flagged E02 down to the golf course.
We will obtain written confirmation by letter referencing this letter from Preston Development
Company, including signature by Tim Smith and Don Thomas, confirming their agreement to
the conditions and requirements covered within this correspondence. Upon your receipt of this
written confirmation and agreement to the conditions stated herein or as modified according to
your understanding, we understand that you can process, in approximately one week the 401
Water Quality Certification. Approval may be complete in about two weeks.
We have also copied Eric Alsmeyer, Corps of Engineers, with this letter providing our intended
construction to complete the water quality mitigation efforts of the golf course and subdivision.
We understand that even though the 401 State Water Quality Certification is issued no additional
construction into these areas can be completed until Eric issues the 404 Certification. Eric
indicated at today's meeting that this would not occur until a minimum of 15 days past the date
of his receipt of this letter to allow the appropriate review agencies the minimum required time
for review and comment.
Should you find any information contained herein unacceptable please call. If the information
contained herein is agreeable, we look forward to your timely processing and 401 issuance. We
have attached several sketches as supporting information to clarify the descriptions of the various
items. Again thank you for your help.

Upon review of your request for 401 Water Quality Certification to place fill material in
2.96 acres of wetlands or waters (plus 1.7 acres of a drained pond filled by the previous
owner) which are tributary to Crabtree Creek for Prestonwood Golf Course and residential
development located at High House Road in Wake County, as described in your submittal
dated 14 May 1993, we have determined that the proposed fill can be covered by General
Water Quality Certification Nos. 2664, 2665, 2671, 2732, & 2733 issued January 21, 1992.
Copies of the General Certifications are attached. These Certifications may be used in
qualifying for coverage under Corps of Engineers' Nationwide Permit Nos. 12, 13, 14, 18 & 26,
respectively restored. Additional conditions are described on the attachment from DEM dated
21 June 1993.
If this Certification is unacceptable to you, you have the right to an adjudicatory
hearing upon written request within thirty (30) days following receipt of this Certification. This
request must be in the form of a written petition conforming to Chapter 150B of the North
Carolina General Statutes and filed with the Office of Administrative Hearings, P.O. Box
27447, Raleigh, N.C. 27611-7447. Unless such demands are made, this Certification shall be
final and binding.

ADDITIONAL 401 WATER QUALITY CERTIFICATION CONDITIONS
FOR NATIONWIDE PERMITS 12, 13, 14, 18 and 26
PRESTON GOLF COURSE EXPANSION

1. The 0.7 acre wetland area adjacent to the Wake County flood control structure and the
fairway for hole 8B which was impacted by land clearing activities will be restored by
returning to the pre-existing elevation. Wetland tree species such as bald cypress
(Taxodium distichum), green ash (Fraxinus pennsvlvanica), water oak (Quercus niara),
willow oak (Quercus phellos), swamp chestnut oak (Quercus michauxii), laurel oak
(Quercus laurifolia) and black gum (Nvssa svlvatica var. biflora) shall be planted at a
density of 320 trees per acre if using bare root seedlings (1/4 to 1/2 inch diameter root
collar). Planting density may be decreased if using larger tree specimens upon
approval by DEM. A single species shall comprise no more than 25% of the total
species planted. Additional tree species may be substituted with approval from DEM.
The trees must survive for 3 growing seasons after planting.
2. All of the activities described in the May 17, 1993 letter from Mr. Tony Withers to
Mr. Ron Ferrell (attached) will be conducted as described in the letter. Any
modifications to these activities must be approved by DEM in writing prior to
conducting the activity.
3. No pesticides or other chemicals shall be applied to any of the rip-rapped stream
channels. Woody vegetation may be removed by hand cutting. Herbaceous vegetation
will be left in place.
4. A 50 foot grassed buffer shall be maintained adjacent to all rip-rapped channels.
Grass will be maintained at no less than 3-5 inches in height. No pesticides,
herbicides or other chemicals will be applied within the buffer areas.
5. A 25 foot grassed buffer shall be maintained adjacent to all non rip-rapped channels
that were impacted by the golf course construction. Grass will be maintained at no
less than 3-5 inches in height. No pesticides, herbicides or other chemicals will be
applied within the buffer areas.
6. The rock check dams installed in the relocated channel adjacent to Hole 8B will be
left in the channel.
7. The Division of Environmental Management shall be notified at the time the above
activities have been completed so that a site inspection can be performed. If the
activities have not been completed by September 30, 1993 the Division shall be
notified so that an interim site inspection can be conducted.
RESIDENTIAL SUBDIVISIONS

1. Deed restrictions will be placed on all lots within the subdivision that contain
jurdisdictional wetlands or waters of the state as indicated on the the wetlands map
dated May 7, 1993. The following language will be used in the deed restriction:
In accordance with Title 15 NCAC 2H .0504 (c) the following DEED
RESTRICTIONS AND PROTECTIVE COVENANTS shall be recorded in the Wake
County Registry prior to the conveyance of lots. Said Deed Restrictions and
Protective Covenants shall apply to Preston Meadows , Preston Links, Preston Pines
and Preston Highlands Ridge Subdivisions in Wake County, North Carolina as shown
on plans titled Preston Development Company, Wetlands-Subdivision Overlay
prepared by Withers & Ravenel, P.A. dated May 7, 1993:
"No additional impacts to wetlands or surface waters shall be permitted on this
lot without notification and written approval by the Water Quality Section of the
Division of Environmental Management. This covenant is intended to insure
continued compliance with water quality standards adopted by the State of North
Carolina and therefore benefits may be enforced by the State of North Carolina. This.
covenant is to run with the land and shall be binding on all parties and all persons
claiming under them."
2. Stormwater from the roads shall be diverted into the preserved wetland areas whenever
possible. Dissipators will be installed where necessary to prevent erosion.
3. All driveways that cross wetlands or surface waters shall be culverted so that the
normal water flow is not disrupted.

Thank you for meeting on site today to resolve the final wetlands and water quality questions.
Present at the meeting were Tom Jackson, Don Thomas, Tim Smith, Randy Smith, Tony
Withers, Loftee Smith, Ron Gilmore, Buddy Howard, Ron Ferrell, Eric Alsmeyer, Kevin
Martin, and Larry Sink. The purpose of the meeting was to discuss the various construction
items that need to be completed in order to secure the 401 Water Quality Certification from the
State. The issues discussed dealt directly with the active portions golf course and subdivision
and focused on areas presently under construction or soon to be under construction. Several
wetlands areas that are being mapped still need to be finalized to include Preston Oaks, Preston
Grove, and Preston Wynds. These will be mapped by Larry Sink in the next several days, field
located, and final map revisions prepared and submitted including proposed impact if any. The
impacted areas as field viewed, discussed, and actions to be completed are itemized below as
follows:
(1) Hole 12B - A plastic pipe presently discharges into a sediment basin below the
12B green. Upon stabilization of the fairway this basin is to be removed with
0\?-- installation of the rip rap dissipator, the existing check dam size will be reduced
to approximately one half its present height, and additional marsh plantings will
be seeded around the dissipator.
(2) Hole 8B - Existing channel reconstruction was completed and looked very good.
Above the previously discussed and required channel improvements were periodic
check dams along the creek bottom approximately every 50' as well as a bridge
versus pipe over the creek at the tee area to further enhance the re-establishment
of the original creek and reduce additional impacts. The temporary earth crossing
approximately halfway down the hole will be removed and the new channel
section will be established as per the approved detail. Upon removal of the
temporary crossing the juncus grass from the original channel will be transplanted
to the improved channel. The check dams will remain in the channel and not be
removed. The original channel will be filled and taken out of service. The
discharge pipe adjacent to the 8B green will be tied to a catch basin and piped
under the creek into another catch basin at the current pipe discharge point just

above the wooden bridge. The basin on the east side of the creek will be
removed. The storm will be extended down to just below the bridge. At that
point a large flat swale will be graded from the elevation of the pipe outlet down
to the approximate edge of the existing wetland area with the anticipation of this
N S ?/ area holding some water and returning to wetlands. All disturbed areas are to be
seeded. Upon completion of all construction the check dam at the lower end of
the wetland area dill be carefully removed to allow water level to be exactly the
same as the control structure #18 water level.
L/J (4) Hole lOB - The existing check dam beside Coles Branch will be left in place to
allow for detention in the existing channel. The sides will be sodded similar to
the cross section of the channel on Hole 8. We will also outlet the storm system
at the 10B tee in the channel upstream of the check dam.
(5) Hole 10B - The existing sediment basin approximately 100 yards in front of the
green on the left side of the fairway, presently receiving the discharge from four
fairway drainage pipes, will be cleaned up and rip, rapped. The excavated outlet
channel will be filled/diked so that when water discharges it will follow the
previously existing channel outlet.
(b) Hole 11B - The check dam at the outlet from the new pond into the existing
watershed control structure #18 will eventually be removed to allow the water
surface elevation for both ponds to remain the same. All storm discharges from
11B are received by this pond. A 25' stream buffer of approximately 3" to 5"
grass shall be maintained around the pond. No pesticides, fertilizers, or other
chemicals will be used"" in this buffer.
(7) Crabtree Creek - No additional rip rap will be used to stabilize the banks of the
creek without prior approval. A 50' grass buffer approximately 3" to 5" in
height will be maintained from the edge of the channel out into the rough/fairway
area. No pesticides, fertilizers, or other chemicals shall be used within this
buffer area. Tree growth within the rip rap sections can be cut, but other natural
vegetation will be allowed to grow.
(8) Preston Meadows Subdivision - The proposed wetland loss areas were
evaluated. The revised lot layout for Preston Meadows will show the loss of one
lot to reduce the wetland area impact beside the creek. We will also require deed
restrictions to prevent disturbance without further approval of these wetlands
areas. Finally we will direct storm water such that it will continue to provide
water to these areas.

(9) Beside Hole 9A (PM-5) - The existing road construction within Preston
Meadows can be completed with the revised lot layout showing the existing
channel flowing between two lots. No disturbance may occur in the existing
channel below wetlands flagged E02 down to the golf course.
We will obtain written confirmation by letter referencing this letter from Preston Development
Company, including signature by Tim Smith and Don Thomas, confirming their agreement to
the conditions and requirements covered within this correspondence. Upon your receipt.of this
written confirmation and agreement to the conditions stated herein or as modified according to
your understanding, we understand that you can process, in approximately one week the 401
Water Quality Certification. Approval may be complete in about two weeks.
We have also copied Eric Alsmeyer, Corps of Engineers, with this letter providing our intended
construction to complete the water quality mitigation efforts of the golf course and subdivision.
We understand that even though the 401 State Water Quality Certification is issued no additional
construction into these areas can be completed until Eric issues the 404 Certification. Eric
indicated at today's meeting that this would not occur until a minimum of 15 days past the date
of his receipt of this letter to allow the appropriate review agencies the minimum required time
for review and comment.
Should you find any information contained herein unacceptable please call. If the information
contained herein is agreeable, we look forward to your timely processing and 401 issuance. We
have attached several sketches as supporting information to clarify the descriptions of the various
items. Again thank you for your help.

Thank you for neeting today with Loftee Smith, Kevin Martin and myself to discuss the current
wetlands situation at Preston. Based upon this meeting we understand the following items must
be satisfactorily addressed before we can anticipate review and approval of 401 Water Quality
Certifications by the State. The items in point include:
(1) Remove direct discharge to channel hole 8B.
(2) Restore wetlands below hole 8B within backwaters of watershed control structure
#18 previously disturbed.
(3) Resolve connection of a pipe behveen structure #14 and #15 on hole 10B to
prevent a direct discharge and remove existing channel.
(4) Eliminate any "direct discharges" into the golf course specifically on holes 6B
through 12B which occurred after State review of the site and construction of
previous direct discharges.
(5) Review basin outlet behind hole 12B.

We also understand that Soil & Environmental Consultants will field flag a small portion of
wetlands in Preston Forest, a couple of jurisdictional channels in Preston Highlands, and a
couple of jurisdiction streams in Preston Crossings. Kevin indicated that they would be field
mapped on April 30th but it was confirmed today that they were done such that Withers &
Ravenel could field locate these flags and add them to the overall Preston wetlands map, the
draft of which was reviewed at our meeting. This map will be provided to Kevin Martin by the
end of the day on May 6th. With this he will prepare the appropriate 401 application to be in
your office by the end of the day Monday, May 10th. We will meet with you on site at 8:30
a.m. on Monday. May 17th to review the existing golf course conditions with respect to
jurisdictional waters, discharges, etc and resolve at that time any outstanding water quality issues
to your satisfaction. These resolutions will then be shown on drawings prepared by our office,
Mr. Loftee Smith, and returned immediately to you. At that time we understand you will
process the application and if the plans accurately reflect the results of your May 17th meeting
that the 401 certification can be issued by the State in approximately one week after May 17th
or approximately the 25th to the 30th of May.
We will also provide a note on the plan that reads:
"Written concurrence shall be requested and secured from the State for all sewer line
construction through wetlands."
We will also restore all sewer construction crossing jurisdictional waters and wetlands to the
original contour after construction.
Finally, the overall wetlands map that will be prepared by Withers & Ravenel will show three
tables of wetland/jurisdictional water information. The tables will determine square footages of
impacts to be broken down as:
(1) Areas constructed before SAS involvement.
(2) Areas constructed after SAS involvement, before DEM inspection.
(3) Proposed square footages to be impacted with future construction.
We will also show existing areas mapped as wetlands but will not lable reflecting- that no impact
will occur to these areas.
I offer this summary letter to keep everybody abreast of the circumstances as we understand
them. It will be Kevin's intention to have Eric Alsmeyer at the meeting on the 17th, if possible.
We will also notify Don Thomas, Tom Jackson, Tim Smith, Buddy Howard and any other
individual we feel necessary to be present in order to come to a complete resolution of the
wetlands issue at this meeting.

will work according to standard mapping review and approval procedures for further

Subject: Preston Golf Course
I have reviewed the plans for holes 6B through 12B of the Preston Golf Course
submitted by you on December 29, 1992. The proposal appears to be consistent with the
agreements reached during the meeting held on November 3, 1992. However, the plans
indicate an extensive fairway drainage system that discharges to surface waters which is
unacceptable.
As you will recall from our meeting, my major concern with the unpermitted activities
that had taken place at this site was the potential impact to surface waters. Considerable time
was spent discussing the measures needed to reduce the impact to surface waters by
establishing buffers along stream channels. The proposed fairway drainage system would
negate the beneficial aspects of the buffers and therefore cannot be approved. The discharge
of stormwater from the fairways into a pond, as indicated on hole 11B, may be acceptable
with appropriate safeguards.
Finally, I feel that it is imperative that a permit application for this project be
submitted by January 15, 1993. If you are unable to comply with this request please notify
me as soon as possible.

This correspondence shall serve to summarize the results of our meeting at Prestonwood on
Monday, November 2nd including outlining the proposed actions that should be anticipated by
the appropriate parties in order to bring this project into compliance.
ACTIONS TO BE COMPLETED BY WITHERS & RAVENEL
1) Develop several channel sections for Hole 8B to be reviewed and approved by
Tom Jackson prior to submission to Ron Ferrell, Eric Alsmeyer, and Lars
Godwin for approval. Upon approval by the Corps, the State, and Wake County
construct the approved channel section as quickly as possible to stabilize the
existing graded creek channel.
2) Upgrade the existing erosion control plan including addition of pond presently
under construction at Hole 11B and depression borrow area in Hole 9B.
3) Assemble detailed information for bridges and pipes and provide to Dave Proper
for review and approval by Soils Conservation Service for construction of
structures including proper anchorage etc. in the SCS controlled flood area.
4) Complete and submit for the State of North Carolina 401 permit application
including justification of piping of creek section in front of Hole 9B. This needs
to be piped since this is a blind landing area for the approach of Hole 9B. Work
closely with Soil and Environmental Consultants in coordinating final field
mapping of existing waters of the US. Upon final mapping by S&EC complete
field surveys to locate the exact wetlands/waters of US for use with future
development plans.

5) Prepare a list of existing lots that will be impacted by storm drainage lines and
provide this information to Ron Ferrell for specific approvals.
6) Upon completion of grading provide field surveys and earth work computations
to substantiate no net flood storage volume loss within the 100 year flood storage
area of watershed structure 18.
7) General wetlands coordination between owner, contractor, and regulatory
authorities during completion of construction, is necessary.
8) Review significance of modifications to mannings "n" factor with respect to 100
year flood elevation and provide response to Mr. Terry Warren with Town of
Cary.
9) Coordinate with Eric Alsmeyer including providing letter explanation of work
done as a mitigating measure to eliminate need for nation wide permit.
10) Complete and provide easement maps to Dave Proper for water transfer network
piping as previously agreed and approved.
11) No more direct storm discharges will be allowed into any creeks.
ITEMS TO BE COMPLETED BY OWNER
1) Continue to maintain existing erosion control structures in good order according
to current plans on file and direction provided by Scott Shellabarger, Wake
County Inspector.
2) Review rip rapped Crabtree Creek section to ensure that 50' buffer at 3"
minimum grass height will be maintained. Where areas less than 50' will be
maintained provide justification and mapping to substantiate requested reduction.
25' buffers will be acceptable at non-rip rap creek sections.
3) Clean existing sediment deposits out of Crabtree Creek at all storm drainage
discharge points which are a result of earlier construction.
4) Eliminate any further spraying or fertilizing within buffers of Crabtree Creek.
Allow vegetation to grown within rip rap. Control of growth by mechanical
means is acceptable, but no herbicides or chemicals are to be used at rip rap.

5) Do not complete any other construction in the noted wetland areas without prior
authorization.
6) Rip rap only in areas where directed by the State or the County for erosion
control purposes.
7) Tom Jackson to provide information including construction done in excess of
required wetlands restoration as a mitigating measure to Corps of Engineers for
elimination of requirement for nationwide permit.
8) Restore creek at Hole 8B to its original condition as best as possible. Seed with
appropriate stabilizing vegetation according to County specifications that portion
of the channel which has not been relocated below the existing crossing point
roughly mid-way along fairway.
CORPS OF ENGINEERS
1) Review information to be submitted by owner including final wetlands mapping
and mitigating measures taken to determine need for nationwide permit.
2) Advise and direct owner in future construction.
STATE OF NORTH CAROLINA
1) Review and process 401 permit application.
2) Advise and direct owner in further construction on site.
WAKE COUNTY
1) Review and administer through the Soil Conversation Service any submissions for
approvals for construction within the flood control area (below elevation 320.5)
2) Review and comment on erosion control plans being resubmitted to address
Corps, State, and County concerns.

Mr. Lars Godwin, P.E. Wake County Engineer also indicated a need for prompt attention to any
mitigating measures agreed to prevent enforcement action by the county. We would hope that
the Corps and State would work closely with us and the County to ensure that we can meet the
County's erosion control requirements while working through the wetlands items.

A site inspection of the expansion of the Prestonwood Golf
Course on October 2, 1992 by Mr. Ron Ferrell of my staff revealed
numerous unauthorized activities which have impacted waters of the
state. Mr. Ferrell was accompanied by Mr Eric Alsmeyer of the U.S.
Army Corps of Engineers, Mr. Larry Sink of Soil and Environmental
Consultants, and Mr. Tony Withers.
Activities which impact waters of the state, including
wetlands, require a Section 404 permit issued by the U.S. Army
Corps of Engineers. The NC Division of Environmental Management
(DEM) must issue a 401 Water Quality Certification before the
Section 404 permit is valid. The purpose of the certification is
to ensure that the activity will not result in the violation of
state water quality standards.
The unauthorized activities observed by. Mr. Ferrell at the
Prestonwood Golf Course include the placement of rip-rap on the
banks of Crabtree Creek and other stream channels, relocation of
stream channels and the placement of fill material in wetlands. It
appeared that the majority of the impacts to waters of the state
could have been avoided. Also, there were numerous stormwater
drains with direct discharges into Crabtree Creek. All of the
above activities have the potential to cause violations of state
water quality standards as indicated by the excessive amount of
sediment in Crabtree Creek at the outlets of the stormwater drains.

Group of DEM with a surveyed map of all waters of the state on t-he
golf course property and the associated housing developments. The
map should include all surface waters, stream channels and wetland
areas as they presently exist and an estimate of the extent and
location of waters and surface waters prior to the construction
activities. You must also refrain from any activities which may
impact waters of the state until you have received the appropriate
authorization from the Division.
After receipt of the above map and the appropriate
applications for water quality certification, an evaluation will be
conducted of your request. A determination will be made concerning
which activities can be certified, the areas that will need to be
restored to their original condition, and the actions that will be
required to ensure that state water quality standards will not be
violated. I recommend that you contact Mr. Ferrell at 919/733-1786
to schedule a meeting to discuss these issues.
Failure to respond to this letter in writing by November 10,
1992 will result in the initiation of an enforcement action by this
office. A response to this letter will not preclude initiation of
an enforcement action if the Division determines that your actions
have resulted in the violation of state water quality standards.
Furthermore, nothing in this letter should be construed as
absolving you of the responsibility to comply with"all requirements
associated with the 401 Water Quality Certification process as
outlined in 15A NCAC 2H .0500.

completed by S&EC. The information consists of the base map prepared by S&EC with the

This letter confirms that on October 2, 1992, Mr. Eric Alsmeyer of my
staff met with your representative, Mr. Tony Withers of Withers & Ravenal
Engineering and Surveying, Inc., and Messrs. Larry Sink of Soil and
Environmental Consultants, Inc. (S&EC), and Ron Ferrell of the North Carolina
Department of Environment, Health and Natural Resources (NC-DEHNR), at the
site of your ongoing golf course expansion. The site is located adjacent to
Crabtree Creek, at Cary, Wake County, North Carolina. The purpose of this
visit was to inspect unauthorized activities you have undertaken within
wetlands on your property.
Mr. Alsmeyer's inspection revealed that you have undertaken filling
activities within Crabtree Creek and its adjacent tributaries and wetlands.
These unauthorized fill activities, without a Department of the Army permit,
are a violation of Section 404 of the Clean Water Act.
As Mr. Withers agreed, you should cease and desist from any further work
within waters and/or wetlands on your property, including additional work in
areas where waters and/or wetlands have already been adversely affected.
Mr. Withers further agreed to provide additional information estimating the
extent and nature of the jurisdictional impacts, based on the preliminary
jurisdictional determination done by S&EC within the last year, and the
observations made on October 2, 1992. When we have received this information,
we will determine the next step in resolving this violation.
You should provide the requested information to this office and NC-DEHNR
by October 19, 1992. Please note that failure to provide this information, or
to honor your agreement to stop all fill activities in waters and/or wetlands
may result in a referral to the United States Attorney for appropriate
prosecution. You should also note that we are investigating to determine if
you had sufficient prior knowledge of the need for permits for the work
performed to establish that the work was a willful and knowing violation of
the Clean Water Act. If this is sufficiently established, we may request that
the U.S. Attorney take appropriate legal action. You should be aware that
this action may include civil or criminal action.
In addition, you should provide information concerning the further
proposed development of residential property adjacent to the golf course for a
determination of jurisdictional impacts and permit requirements.

Dear Don:
As you are aware I met on site today with Eric Alsmeyer with the Corps of Engineers and Ron
Ferrell with NCDEHNR, the Corps and State Environmental Wetland Scientist. We reviewed
the existing site conditions, with respect to wetlands, and compared them to the preliminary
wetlands analysis that was completed by Kevin Martin and Soil & Environmental Consultants,
sometime ago. As a result of today's inspection three specific areas were identified that have
immediate concerns. They are:
(1) Hole 9B - No additional disturbance should occur to the existing
channel which runs across the fairway in front of the green
location. The channel has been excavated on Hole 10B,
however, it has only been cleared with no excavation on
Hole 9B. Until we resolve the wetlands questions it is the
State's direction that no further work on this channel be
done.
(2) Hole 8B - No rip rap should be placed in the existing relocated creek
section. This creek will likely have to be widened
somewhat and stabilized with grass if possible with a non-
erosive cross section. Again no rip rap should be placed.
This will need to coordinated with the County's erosion
control requirements.

(3) Hole 8B - No pond construction or further disturbance should occur
at the lower end of the hole which was identified as
previous wetlands. This area also will likely be required
to be recovered and planted to be returned to a wetland
condition.
The Corps has requested that we complete an accurate estimate of the wetland areas identified
on the Martin Map that have been impacted. This includes all areas where wetland channels
crossed fairways and subdivision lands with these square footages computed and areas provided
to the Corps. This needs to be completed as quickly as possible. With your approval I feel that
Soil & Environmental Consultants, Mr. Kevin Martin, should complete this area determination
broken down into five separate numbers. They would be as follows:
(1) Estimate of previous wetland pocket covered in Hole 5A.
(2) Estimate of previous wetland pocket covered in Hole 9A.
(3) Estimate of wetland area cleared and disturbed at Hole 8B.
(4) Estimate of area of impacted wetland stream channel areas on total site.
(5) Estimate of area of not yet impacted stream channels on site.
This total summed would constitute the total wetlands area on site.
By copy of this letter I am requesting Kevin Martin to provide a proposal for completing the
area determination outlined above. I am anticipating that these channels will be walked and
measured with a 100' tape, estimating the width of wetland channel and flagging where
necessary on site for future location reference. The linear footage and estimated channel widths
could then be used to determine the various areas requested.
It is also important that no wetland areas (channels) on areas proposed to be subdivision lots be
disturbed until the wetland issues have been resolved. It is likely that these areas will need to
be field located for protection during the lotting process. By copy of this letter, I am notifying
Tim Smith of this requirement.
Apparently the most significant impact occurs below head waters which is disturbance that
occurs below the Corps of Engineers designated head water point. As discussed earlier, this is
the confluence point of Coles Branch into Crabtree Creek. The rip rapped channel is of
significant concern to both the Corps and the State as this was impacted wetland areas below
headwaters. The Corps had discussed the possibility of a need to remove the rip rap, however,
I indicated to them that would give the Town of Cary significant problems as a result of the
potential erosion that could occur. Also the damage that would occur in the form of erosion and
sedimentation to further have equipment in and around the area of the stream would only lead

to further water quality problems. This item will need to be discussed further. Another item
of concern that was mentioned at the inspection was direct storm water discharges into the creek
with no water quality mitigating features such as settlement or ponding areas prior to discharge.
This allows direct introduction of wash off of the course into the creek without any mitigating
water quality measures. Finally, the close proximity of the cart path to the creek very probably
would not have been allowed due to its potential for impact on the creek. Whether or not it will
be allowed to remain in its present location is still uncertain.
Also at our meeting today was Mr. Larry Sink, an employee of Kevin Martin's and Soil and
Environmental Consultants. He was the individual that completed the original wetlands mapping
and was very helpful in providing pre-existing condition information to Ron and Eric during the
site inspection.
Work that has been done to Hole 8B was considered somewhat disturbing in that the existing
creek was completely regraded and portions of it relocated. The preference would have been
to allow the existing channel to remain undisturbed, however, at this time until further
discussion, no further construction should occur on this channel, especially rip rapping. I feel
this area will very likely be reconstructed with a non-erosive channel cross section and grassed
for stabilization. Similarly on Hole 9B this would be the case in that no additional rip rap
should be placed within channels. The rip rap channel on Hole 12A was also of concern. This
channel too may require some reconstruction and rip rap removal, however, again we run into
the erosion control stabilization matter with the Town of Cary and this will need to be
coordinated and satisfactorily resolved to both agencies mutual agreement.
Current wetland regulations require that disturbance of over an acre requires notification and
approval from the Corps of Engineers. Disturbance over one third of an acre requires
notification and approvals from the State. Further direction cannot be taken until we know the
exact square footages we are dealing with, hence the need for the fairly accurate field
determinations of wetland areas.
Should we be able to work out with the Corps some of their concerns which would include
removal of rip rap, cleaning out existing sediment in the creek, elimination of direct discharges,
and restoration and stabilization of creeks, we may be able to work under a Nationwide broad
permit. However, there is also a strong possibility that we will require an individual permit
since we have affected some areas below headwaters and this would open a clearing house
review by multiple agencies.

In summary, work on the identified areas should stop immediately. We should allow Soil and
Environmental Consultants to, as soon as possible, determine the appropriate square footages
of wetlands, allowing the Corps and State to complete their initial evaluations. At this time a
meeting between yourself, Tom Jackson, and the State and Corps should be arranged to further
discuss what direction to proceed. I hope this summary brings you up to speed on the
circumstances and the direction as we see it at this time. Please contact me should you have any
