The complainant alleged through phone call and email on 02/22/2018 that waste from the beef feeding area had flowed into a wooded area on the complainant's property. Complainant's photos were dated 02/16/2018. On 02/17/2017, the uncovered concrete lot had been scraped and manure removed. I spoke with complainant and Mr. Atwood on 02/23/2018 and requested that Mr. Atwood remove any/all manure that had run-off into the wooded area on the complainant's property, to which he complied. Since the run-off occurred from a deemed -permitted facility (no general permit), the issue is a civil matter and not a violation. The WSRO visited the facility on 03/02/2018 to follow-up on the clean-up of the run-off and to determine if the facility needs to obtain a general permit. Mr. Atwood currently has 106 cattle on three different pastures (each side of feeding area). One of the pastures is VERY denuded and cannot be considered a pasture. There was evidence that sediment had broken through the silt fencing and may have entered the tributary flowing between the two pastures. The pastures are directly upstream of the complainant's frehwater pond. WSRO requested that Mr. Atwood increase the buffer width on each side of the tributary and re -install the silt fencing. The stream crossing between the two pastures also needed to be repaired since there was evidence of sediment run-off here as well. Mr. Atwood completed this by 03/09/2018. The buffer area is to be re -seeded. -This feedlot needs to be permitted. The manure removed from this site is being land -applied onto fields already in the existing cattle permit (AWC030033). Mr. Atwood is also including the manure from this site in the waste application records for AWC030033. -Please contact a technical specialist immediately to begin the process of incorporating this feedlot into the existing Certified Animal Waste Management Plan (CAWMP). Note: the waste utilization plan (WUP), waste collection, waste storage and waste management procedures will likely need to be revised. WSRO visually inspected the existing permitted facility.
