Damage to Surface Waters and Other Permit Violations

Dear Mrs. Bottomley:
This Notice is a follow-up to the routine Compliance Inspection conducted by Division of Water Resources
(DWR) staff on August 23, 2018. A copy of the inspection report is attached for your review..
Violations
1. Silage leachate was observed discharging into an unnamed tributary (UT) to Big Pine Creek (class C,
trout waters) on the facility property. An excessive amount of atypical fungal growth was documented in
the UT and in Big Pine Creek which flows along the Blue Ridge Parkway. Approximately 3,000 linear
feet of surface water has been impacted. Condition V.1 of the Cattle Waste Management System
General Permit (permit) states that Glade Creek Dairy Farm is responsible "for damages to surface
waters, wetlands, or groundwaters resulting from the animal operation." Damages to surface waters,
such as Big Pine Creek, is a violation of permit condition V.1.
The potential for additional adverse impacts to waters of the State exists since low dissolved oxygen is
often associated with oxygen depleting waste such as silage leachate. Note that, the depletion of
oxygen due to the decomposition of the leachate within the stream, is known to cause fish
mortality. North Carolina Administrative Code 15A NCAC 2B stipulates that the water quality standard

for dissolved oxygen in Class C waters may not be less than a daily average of 5.0 mg/l with a minimum
instantaneous value of not less than 4.0 mg/l. There is, therefore, the possibility for a water quality
standard violation of dissolved oxygen if conditions persist.
2. Corn grain still needs to be added to the Certified Animal Waste Management Plan (CAWMP) as a
receiving crop. This was also noted in the 2017 inspection report. Failure to abide by the CAWMP is a
violation of permit condition I.3 and II.2.
3. Glade Creek Dairy Farm is currently permitted for 400 dairy milk cows. Since the farm has converted to
a beef type operation, the CAWMP needs major changes which must be approved by the Division.
Failure to abide by the CAWMP is a violation of permit condition I.3.
4. Waste residue on the interior of the "new" waste pond indicates that the waste level in the pond has been
2-3 inches above the maximum liquid mark at some point. Failure to notify the Division of non-
compliant waste levels is a violation of permit condition III.13.
Corrective Actions:
1. The silage leachate must immediately be excluded from surface waters. Additionally, any other sources
of oxygen depleting waste should also be identified and excluded. This may include manure run-off
from the small cattle lot below the heifer barn and/or animal waste or commercial nitrogen from the
fields on the east side of the stream (on the hill across from the pesticide storage area). Please continue
to monitor the UT and.Big Pine Creek for abnormal conditions such as algae and fungal growth,
discolored water, unusual odor, etc.
2. Please contact a technical specialist to add additional crops, fields, etc. to the CAWMP.
3. Contact your technical specialist to change the CAWMP from dairy to beef. A recertification form and
permit application must also be submitted to the Division.
4. A reminder that the Division must be notified anytime the waste level exceeds the maximum freeboard
level in the waste pond.
Other Concerns:
1. Permit Condition H.12 requires that storage pond vegetation shall be kept mowed. The embankment of
the "new waste pond" requires mowing and maintenance since the vegetation is more than 18-inches
tall.
2. Permit Condition II.14 requires that the storage pond be kept free of foreign debris such as bottles,
gloves, syringes, or any other solid waste. There is a large amount of foreign debris that needs to be
removed from the "heifer waste pond" and properly disposed.
3. Please repair/re-paint waste level marker in the "milk parlor" waste pond. It was difficult to determine
the maximum liquid mark (aka "red" or "non -compliant" mark) at the time of inspection.
4. Stockpiled waste in the lot below the heifer lot should be scraped and land applied. This will help keep
nutrients out of Big Pine Creek.
5. Animal waste management records indicate that no slurry applications have occurred since the last
inspection. Since the beef cattle are now confined to a barn near the "new" waste pond, there is the

expectation that solid waste has accumulated and been land applied. Please submit copies of records for
any solid waste applications since the last inspection, including applicable waste analysis reports.
