North Carolina Department of Environmental Quality Division of Water Resources 450 West Hanes Mill Road, Suite 300 Winston-Salem, NC 27105 Re: Notice of Violation: NOV-2018-PC-0364 Dear Ms. Knight: This letter is in response to your letter of September 5, 2018 regarding Notice of Violation: NOV-2018- PC-0364. In response to the corrective actions noted in the letter, please note the following: 1. Bottomleys will redo the retention ditch on the bank to prevent any leakage from going downstream. The necessary equipment was being moved to the location this week, and ditching should be complete within the next two weeks, as weather allows. We are also exploring the option of redirecting the drainage to the manure pit. 2. We have engaged Maggie Osborne and Aaron Tompkins of NCSU Extension to assist us in adding the additional crops to the CAWMP. 3. We have engaged Maggie Osborne and Aaron Tompkins of NCSU Extension to assist us changing the CAWMP from dairy to beef, and preparing the appropriate forms and applications. 4. Please know that we have been diligent in monitoring the waste level in the pond, and that it has never exceeded the maximum liquid level. The residue you observed was the result of us having agitated the waste. Further, we have formalized our Standard Operating Procedure for internal monitoring of the waste level in the waste pond which does includes notifying the Division anytime the waste level exceeds the minimum freeboard level in the waste pond. In addition, we are reviewing the Other Concerns listed in your letter and will make changes as necessary. Thank you to you and Melissa for your help with this matter.
