DANIEL SMITH Interim Director Mr. William Pate Project Manager Case Farms Morganton Division 121 Rand Street Morganton, NC 28655 Dear Mr. Pate: NORTH CAROLINA Environmental Quality July 9, 2019 Subject: General Permit No. NCG060000 Case Farms Morganton Division COC No. NCG060392 Burke County In accordance with your application for a discharge permit received on February 14, 2019, we are forwarding herewith the subject certificate of coverage (COC) to discharge under the subject state — NPDES general permit. This permit is issued pursuant to the requirements of North Carolina General Statute 143-215.1 and the Memorandum of Agreement between North Carolina and the US Environmental Protection Agency dated October 15, 2007 (or as subsequently amended). Please be aware that South Buffalo Creek (segment index number 16-11-14-2) is an impaired water. This stream is impaired because benthos is rated as fair. There are also multiple Total Maximum Daily Loads (TMDLs) that affect this watershed. Information about these TMDLs can be found on Division of Water Resources' website: httns://deq.nc.gov/about/divisions/water-resources/plannin modeling_ assessment/tmdls. In Part I, Section A, the General Permit explains that for discharges to watersheds affected by a TMDL, coverage under this permit may depend on the facility demonstrating that discharges have no reasonable potential to violate applicable water quality standards for specified pollutants. Please take notice that this certificate of coverage is not transferable except upon approval of the Division of Energy, Mineral and Land Resources (Division). The Division may require modification or revocation and reissuance of the certificate of coverage. This permit does not affect the legal requirements to obtain other permits which may be required by the Division of Water Resources, the Coastal Area Management Act, or any other federal or local government permit that may be required. - D E Q North Carolina Department of Environmental Quality I Division of Energy, Mineral and Land Resources 512 North Salisbury Street 1 1612 Mail Service Center I Raleigh, North Carolina 27699-1612 NORTH CPAd,IN4 919.707.9200 If you have any questions concerning this permit, please contact Shane Strickland at telephone number (919) 707-3647 or by email shane.stricklandgncdenr.gov.
