This project consists of the relocation of existing SR 1117 near the town of Rockingham in Richmond County. Both the Vulcan Materials Company and North Carolina Department of Transportation believe that the relocation of the existing road is necessary for public safety, by diverting local traffic away from the heavy truck traffic associated with the mining operations. We believe the minor wetland impacts associated with this proposed relocation qualifies under the Nationwide Permit #26. Because the unnamed tributary to Hitchcock Creek traverses the entire length of the property in a north-south alignment, there is no means of relocating east-west SR 1117 without crossing the wetland area associated with this tributary. This is also the situation for the crossings of the wet-weather drainages and other streams. The channel relocation and crossing of the wetland associated with the sediment pond are unavoidable due to constraints of the northern property boundary. In order to minimize wetland impacts, all crossings are as close to perpendicular as practical. Best management practices for sediment and erosion control, in accordance with North Carolina Department of Transportatance standards, will be employed during construction. To mitigate wetland impacts, the 72" culvert on existing SR 1117 at the present crossing of the unnamed tributary to Hitchcock Creek will be removed. The bank will be graded to its natural slope and revegetated. Letter of Authorization The Vulcan Materials Company, hereby authorizes Kimley-Horn and Associates, Inc. to make applications on our account for permits for dredge and fill activities and to coordinate with the North Carolina Department of Environment, Health, and Natural Resources - Division of Environmental Management, and U.S. Army Corps of Engineers regarding this road relocation project in Richmond County. Kimley-Horn is not a general agent of the Vulcan Materials Company, therefore this authorization terminates upon written notice by the Vulcan Materials Company, by Kimley-Horn and Associates, Inc., or upon final agency action on this permit application. For the purposes of the-U.S. Army Corps of Engineers' Regulatory Program, Title 33, Code of Federal Regulations (CFR), Part 330.6, published in the Federal Register on November 22, 1991, lists nationwide permits.(NWP). Authorization was provided, pursuant to Section 404 of the Clean Water Act, for discharges of dredged or fill material into headwaters and isolated waters. Your work is authorized by this NWP provided it is accomplished in strict accordance with the enclosed conditions and provided you receive a Section 401 water quality certification from the North Carolina Division of Environmental Management (NCDEM). You should contact Mr. John Dorney, telephone (919) 733-1786, regarding your water quality certification. This NWP does not relieve you of the responsibility to obtain other required State or local approval. This verification will be valid for 2 years from the date of this letter unless the nationwide authorization is modified, reissued or revoked. Also, this verification will, remain valid for the 2 years if, during that period, the NWP authorization is reissued without modification or the activity complies with any subsequent modification of the NWP authorization.
