Good morning Alan,
Please see the response from the engineering project manager regarding avoidance and minimization during site
planning, as well as an early site layout which is attached. This layout demonstrates an avoidance and minimization
improvement over initial preliminary concept site layouts (not provided) which proposed 1 -acre of wetland impacts and
over 600 If of stream impacts. This version does not propose steam relocation (100 If) and adds another 75 If of stream
and 0.2 -acres wetland impacts from proposed grading limits. Here's his response:
Chris,
This site has substantial grades to account for across the site from Matheson Avenue right-of-way to Little Sugar
Creek. Early Grading Plans for this project minimized the height of retaining walls and "daylighted" proposed
grades at a 3:1 slope.
In attempt to provide avoidance on site, the developer has substantially increased size and amount of retaining
walls (some +20 feet in height) on-site to minimize impacts. These retaining walls extend along most of the
developed area on the west side of Little Sugar Creek to minimize impacts to the wetlands and stream in the
area. In addition to these retaining walls, the building footings will be much deeper foundations to avoid
pressures against these retaining wall.
While I can appreciate Mr. Johnson questioning the western building size and the ability to provide additional
avoidance by making the building a smaller footprint; the project still must provide an adequate number of units
for it to be viable. The building footprint and height, as well as the size of the parking lot, have reduced from
earlier plans to provide additional avoidance and still meet City of Charlotte code requirements.
For reference, 1 have attached a previous Grading and Drainage Plan (dated 2/1/2019) that can be compared to
current plans showing measures taken to minimize impacts as discussed.
Please let me know if additional information is requested and we will attempt to accommodate.
As you can imagine based on the reasons above, this site is highly constrained which increases development costs;
therefore, maximizing the number of units to offset those costs is the main driver for the shape of the northern
building. Going higher would be the natural solution to modify the footprint in order to avoid the additional impacts,
but the zoning ordinance prohibits the additional height.

Hey Alan — sorry about that. Construction plans definitely get jumbled. I've attached a marked -up site plan sheet which
highlights those areas and calls -out the permanent impacts. The stream flows through the wetland and functions as a
stream/wetland complex. You can also refer to Figure 5 that I included with the ePCN submittal. It's part of the
compiled PDF that I uploaded in the 'Miscellaneous' section of the ePCN. If you're not seeing it please let me know and
I'll forward it along. It's certainly easier to read than the plan sheets.
I've contacted my engineers regarding pipe details for the stream impact. I think there may be a bit of semantics here,
mostly inconsistency on my end and information that was lost a little in translation from the engineers to myself. The
main stream impact (204 If) results from the installation of a 175 If, 30" reinforced concrete pipe, not your standard
culvert crossing. I referred to this impact in the cover letter as both a pipe and culvert, so I hope I didn't confuse. Calling
this a culvert is not really appropriate.
Also, Dave Shaeffer has requested that this project be authorized under NWP 14 (WQC 4135) for the impacts associated
with linear transportation and NWP 18 (WQC 4139) for the retaining walls and grading in the southwest corner of the
northern half of the project. He feels that those permits are more appropriate for the proposed activities. Are you able
to provide your authorization with those updates? Need anything from me in order to make that change?

Can you provide a site plan without all the extraneous construction information (0-1), with the buffers, SW layout,
wetlands, and stream.
The stream is not pointed out. It appears to be just part of the wetland (based on the buffer indicated).
There was no culvert detail that I could find
