Dear Mr. Hockett:
This letter is a follow-up to the site visit conducted by Division of Water Resources (DWR) staff, in
conjunction with an NRCS technical assistance visit, on May 30, 2018. A copy of the DWR report is
attached for your review. Some permit deficiencies were observed and are described below.
Deficiency #1:
The waste level marker is still missing in waste pond #1 and has been a concern for several years
(2013-2018 compliance inspections).
Corrective Action:
The marker must be re -installed within 30 days. NRCS has stated that they will assist with
determining the correct placement. Please notify DWR when the new marker has been installed.
Deficiency #2:
DWR staff observed that waste had previously overtopped a damaged section of waste pond #2.
There was no evidence, however, that waste left the farm property or flowed into Randleman Lake.
DWR was not notified of the overtopping prior to the May site visit.
Corrective Action:
Please repair the dam of waste pond #2 using the elevation provided by NRCS. Our records indicate
that the condition of the dam has been an on -going concern (2016-2018 compliance inspections). If
this section of the dam had already been repaired, DWR believes the waste may not have over
topped. Per discussions with Herschel Hockett, DWR understands that the dam will need to be dry,
then waste and sand removed, followed by the repair and re -shaping of the top of the dam.
Permanent vegetation should be established this Fall, followed by another visit by DWR to document
the repairs. A reminder that DWR must always be notified of high waste levels per permit condition
111.13.e. (fee 2013 Notice of Deficiency).

Deficiency #3:
The waste level in structure #3 (new one) is approximately two to three feet above the maximum
liquid level and is seeping through the sand placed in the spillway.
Corrective Action
The seepage was not in danger of reaching surface waters on May 30, 2018 as the waste was still in
the spillway and the well vegetated buffer is 200' wide. Again, the Permit requires that you notify
DWR of all non -compliant waste levels (condition 111.13.e. and 111.13.f).
Deficiency #4:
A small amount of sand is still mounded in the spillway of waste pond #3 (March 2018 inspection).
Corrective Action:
The sand must be removed as soon as the waste level is lowered so that the structural integrity of the
dam is not compromised. As discussed, you may wish to install a shallow trench in the grass near the
buffer fence as an emergency back-up for any future events.
DWR acknowledges that there had been a great deal of rain prior to May 30, 2018 which contributed
to the high waste levels. Records also indicate that the waste levels in the structures were compliant
up to two weeks prior our visit. It is also our understanding that Green Valley Farm plans to extend
the roof line over the flush trench which should improve each structure's waste holding time.
