Box 1746 Watkinsville, GA 30677 Subject: Approval for Temporary Offsite Storage of Residuals Terra Renewal, Residuals Land Application Program Permit No. WQ0038087 Wilkes County Dear Mr. Coyle, In accordance with your request for Temporary Emergency Offsite Storage of Residuals the Winston-Salem Regional Office (WSRO) is forwarding this approval to Terra Renewal Services, Inc. for the time -limited operation of a temporary offsite storage structure. This approval shall be effective for a period not to exceed 180 contiguous days from the initial storage structure use within calendar -year 2019 and shall be subject to the conditions and limitations as specified in this approval and in Permit No. WO0038087. Please pay particular attention to the following Conditions: • Schedules I.1. — I.6., which must be completed prior to temporary offsite storage. • Schedules I.7. and I.8., which requires notification to WSRO and written approval prior to use. • Condition H.11., which requires that the facilities associated with the temporary offsite storage be inspected as often as necessary to prevent any malfunctions, overflows, or nuisances. • Condition II.15., which requires accurate record keeping and reporting. • Condition II.22., which requires proper closure of the offsite storage structure. Permission is hereby granted to Terra Renewal Services, Inc. for the operation of a one-time temporary offsite storage operation at Loflin Dairy located at 2466 Loflin Dairy Road, Sophia, NC. This approval only applies to use of the existing 776,546 gallon concrete structure present at the above referenced site. This approval shall become voidable unless the agreements between Terra Renewal Services, Inc. and Clifford Loflin, Jr. (Loftin Dairy) for temporary storage of residuals are in full force and effect. Hanes Mill Road, Suite 300 1 WinstonSalem, North Carolina 27105 336-776-9900 N J This approval shall be effective January 4, 2019, will expire 180 contiguous days following initial residuals storage within calendar year 2019, and shall be subject to the following specified conditions and limitations: I. Schedules 1. Animal Waste Permit No. AWC760023 shall be rescinded prior to storage structure use. 2. A lease agreement shall be in place prior to storage use. A signed copy must be submitted to this office. 3. The animal waste currently contained in the structure shall be removed prior to storage use. 4. The freeboard marker serving the structure shall be labeled with a 24-inch max level mark prior to storage use. 5. There are two waste push lanes that currently feed into the structure. Both of these lanes shall be modified to prevent waste and stormwater from entry into the structure prior to storage use. 6. The drainpipe that currently discharges into the structure shall be capped or plugged to prevent waste and stormwater from entry into the structure prior to storage use. 7. Public access to the storage structure shall be restricted (e.g. signage, fencing, other) prior to storage use. 8. When items 1. — 7. described above have been completed, the Winston-Salem Regional Office shall be notified to schedule an inspection. 9. Written approval shall be obtained from the Winston-Salem Regional Office prior to storage use. II. Conditions 1. This approval shall become voidable unless the subject temporary offsite storage activities are carried out in a manner that has been approved by this Division. 2. This approval is effective only with respect to the nature and volume of residuals described in the request dated December 19, 2018, and other supporting data. 3. The Winston-Salem Regional Office shall be notified a minimum of 48 hours in advance to initial storage at the subject facility. 4. The facilities shall be properly maintained and operated at all times and shall maintain compliance with all conditions of Permit No. WQ0038087. Page 2 of 5 5. This approval is NOT transferable. In the event that there is a desire for the facilities to change ownership, or there is a name change of the Permittee, a formal request must be submitted to the Division. 6. No type, kind or quantity of waste other than those listed in the Attachment A of Permit No. WQ0038087 shall be stored at the subject offsite storage structure. 7. This approval shall become voidable unless the agreements between Terra Renewal Services, Inc. and Clifford Loflin, Jr. (Loftin Dairy) for temporary offsite storage are in full force and effect. 8. In'the event that the facilities fail to perform satisfactorily, including the creation of nuisance conditions, Terra Renewal Services, Inc... shall cease operation of offsite storage activities and take such immediate corrective actions as may be required by this Division. 9. The residuals stored in the subject storage structure shall be land applied in compliance with Permit No. WQ0038087 or South Carolina DHEC Permit No. ND0086479 (if SC DHEC permit allows). 10. Terra Renewal Services, Inc. is liable for any damages caused by a spill or failure of the storage operations. 11. Adequate inspection, maintenance, and cleaning shall be provided by Terra Renewal Services, Inc. to ensure proper operation of the subject facilities. 12. Public access to the storage structure site shall be prohibited. 13. Terra Renewal Services, Inc. or its designee, shall inspect the storage facilities to prevent malfunctions and deterioration, operator errors, and discharges that may cause or lead to the release of wastes to the environment, a threat to human health, or a nuisance. 14. Any duly authorized officer, employee, or representative of the Division of Water Resources may; upon presentation of credentials, enter and inspect any property, premises, or place on or related to the storage facilities at any reasonable time for the purpose of determining compliance with the Division's approval; may inspect or copy any records that must be maintained under the terms and conditions of this approval and Permit No. WQ0038087; and may obtain samples. 15. An accurate record of the storage activities must be maintained by Terra Renewal Services, Inc. indicating: a. Date and times residual are offloaded into the storage structure b. Volume of residuals offloaded into the storage structure, including the residuals source facility name c. Date and times residuals are removed from the storage structure Page 3 of 5 J d. Volume of residuals removed from the storage structure, including the Permit Number used for disposal e. When Permit No. WQ0038087 is utilized; residuals sampling shall be conducted in compliance with Permit No. WQ0038087, the subject Temporary Offsite Storage Structure shall be considered an independent source for reporting purposes related to land application activities, and all associated records shall be submitted with annual reporting as specified in Permit No. WQ0038087 f. When SC DHEC Permit No. ND0086479 is utilized; all conditions contained within that permit shall be met. g. Weekly inspection of the storage structure, including a weekly freeboard measurement shall be conducted h. Precipitation records shall be maintained for the storage structure site i.Inspection of the storage structure following a precipitation event of one inch or greater j. An inspection log including the date and time of inspections, observations made, and any maintenance, repairs, or corrective actions taken by the Permittee. 16. An Operation and Maintenance Plan and Spill Response Plan shall be maintained for the offsite storage structure. 17. Failure to abide by the conditions and limitations contained in this approval may subject Terra Renewal Services, Inc. to appropriate enforcement actions available to the Division. 18. The granting of this approval does not preclude Terra Renewal Services, Inc. from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal), which have jurisdiction. 19. Noncompliance Notification: Terra Renewal Services, Inc. shall report by telephone to the Winston-Salem Regional Office, telephone no. (336) 776-9800, as soon as osn sible, but in no case more than twenty-four (24) hours or on the next working day following the occurrence or first knowledge of the occurrence of any of the following: a. If freeboard is less than 24 inches at any time. b. Any process unit failure, due to known or unknown reasons, that render the facility incapable of adequate storage such as failures of tanks, piping, pumps, etc. b. Any process failure resulting in a spill or by-pass or direct discharge to receiving waters. r 20. Persons reporting such occurrences by telephone shall also file a written report in letter form within five (5) business days following first knowledge of the occurrence. This report must outline the actions taken or proposed to be taken to ensure that the problem does not recur. 21. The facilities associated with the storage activities shall be inspected as often as necessary to prevent malfunctions, overflows, or nuisances. Page 4 of 5 22. When offsite storage has been completed or at the end of the 180-day approval period, the subject storage structure shall be properly closed (e.g. cleanout for conversion, permanent closure, other) following the Division's closure policy. If any parts, requirements, or limitations contained in this approval are unacceptable, please submit a written request within 10 days following receipt of this approval. Unless such demands are made, this approval shall be final and binding.
