Reference your modified pplication of September 23, 1993, for Department
of the Army (DA) authorizati n to place fill material into 0.44 acre of
wetlands at the Windward Oak subdivision located on Masonboro Sound Road in
Wilmington, L.cver Coun y, North Carolina. 0.14 acre of wetlands will be
filled for the road crossing and 0.30 acre of isolated wetlands will be
filled for miscellaneous Dur oses.
For the purposes of the Corps of Engineers' Regulatory Program, Title 33,
Code of Federal Regulations CFR), Part 330.6, published in the Federal
Register on November 22, 199 , lists nationwide permits. Authorization,
pursuant to Section 10 of th Rivers and Harbors Act of 1899 and Section 404
of the Clean Water Act, was frovided for fills for roads crossing waters of
the United States (including wetlands and other special aquatic sites)
provided:
a. The width of the fill is limited to the minimum necessary for the
actual crossing; I
b. The fill placed in aters of the United States is limited to a filled
area of no more than one-thi d acre. Furthermore, no more than a total of 200
linear feet of the fill for he roadway can occur in special aquatic sites,
including wetlands;
C. The crossing is cul erted, bridged or otherwise designed to prevent
the restriction of, and to w'thstand, expected highflows and the movement of
aquatic organisms;
d. The crossing, inching all attendant features, both temporary and
permanent, is part of a sin a and complete project for crossing of a water of
the United States.
In addition, authorization was provided, pursuant to Section 404 of the
Clean Water Act, for discha es of dredged or fill material into headwaters
and isolated waters.

accomplished in strict acco dance with the enclosed conditions and provided
you receive a Section 401 w ter quality certification from the North Carolina

The North Carolina Division of Coastal M agement has reviewed the above-referenced application for a Nationwide
Permit dated August 4, 1993 pursuant to ection 307 of the Coastal Zone Management Act of 1972 as amended.
Based upon our review, we have determin that the proposed activity is consistent with the North Carolina Coastal
Management Program provided the follo ing conditions are met:
1. The activity described in the abov referenced application qualifies to receive one of the Nationwide
Permits described in 33 CFR P 330 with the exception of Numbers 17, 21, 24, and 34 which
were found inconsistent with the orth Carolina Coastal Management Program.

Upon review of your request for 401 Water Quality Certification
to place fill material i 0.44 acres of wetlands or waters which are
tributary to AIWW for residential development located at Windward Oaks
on Masonboro Road in New Hanover County as described in your submittal
dated 21 September 1993, we have determined that the proposed fillJcan
be covered by General Wa er Quality Certification Numbers 2732 and
2671. Copies of the Gen ral Certifications are attached. These
Certifica'tions may be used in qualifying for coverage under Corps of
Engineers' Nationwide Pe it Numbers 14 and 26. An additional
condition is that deed restrictions shall be placed on all wetlands to
prevent future wetland fill, the restrictions shall run with the land
and the state shall be listed as a beneficiary.
If this Certificati n is unacceptable to you, you have the right
to an adjudicatory hearing upon written request-within thirty (30)
days following receipt o this Certification. This request must be in
the form of a written petition conforming to Chapter 150B of the North
Carolina General Statute and filed with the Office of Administrative
Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. Unless such
demands are made, this Certification shall be final and binding.

wetlands at the Windward Oaks subdivision located on Masonboro Sound Road in
Wilmington, New Hanover ounty, North Carolina. 0.14 acre of wetlands will be
filled for the road crossings and 0.30 acre of isolated wetlands will be
filled for miscellaneous purposes.
