A review of your application received April 13, 1993, for Department of the Army authorization to excavate a basin and construct a pier with gazebo, floating dock and pilings on the Atlantic Intracoastal Waterway (AIWW), Landfall, Wrightsville Beach, 'New Hanover County; North Carolina, indicates it to be a candidate for Federal authorization under this general permit. Accordingly, the administrative processing of your application will be accomplished by the North Carolina Division of Coastal Management. Comments from Federal review agencies will be furnished to the State. If your application must be withdrawn from this general permit process for any reason, you will be informed regarding its further management. If there are no unresolved differences in State-Federal positions or policies, the final action taken on your application by the State will result in your receiving written notice from us that your application is consistent with the general permit and you may commence your activity. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: a. All work authorized by this permit must be performed in strict compliance with the permit plans. b. All excavated materials will be confined landward of the mean high water (MHW) elevation contour and any regularly or irregularly flooded vegetated wetlands. C. No vegetated wetlands will be excavated or filled. d. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. e. Excavation will not exceed seven (7) feet below the elevation of mean low water (MLW). f. The permittee's scheme of development, of which the authorized work is a part, contemplates the presence of structures and their attendant utilities --- on lands subject to an easement in favor of the United States for the operation, maintenance, improvement, and enlargement of the Atlantic Intracoastal Waterway (AIWW). Accordingly, the permittee will be required to remove such structures and improvements at his own expense in the event that, in the judgment of the U.S. Army Corps of Engineers acting on behalf of the United States, the lands are needed at any time for any purpose within the scope of the easement. Permanent buildings will not be constructed within the easement. t 1? -2- g. This permit does not authorize the interference with any existing 3r proposed Federal project, and the permittee will not be entitled to compensation for damage or injury to the authorized structure or work which may be caused from existing or future operations undertaken by the United states in the public interest. h. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Use of the permitted activity must not interfere with the public's right to free navigation on all navigable waters of th6 United States. i. If the display of lights and signals on the authorized structure is not otherwise provided for by law, such lights and signals as may be prescribed by the U.S. Coast Guard will be installed and maintained by and at the expense of the permittee. j. The permittee will maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 1-. The activity will be conducted in such a manner as to prevent a A. significant increase in turbidity outside the area of construction or construction-related discharge. Increases such that the turbidity in the waterbody is 25 NTU's or less are not considered significant. 1. Approval of the structure was based on determination that there would be no obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway (AIWW), a possibility exists that the structure may be damaged by wave wash from passing vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to nullify the navigational benefits on which the AIWW was justified. Issuance of this permit should not be construed as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash normally to be expected in the AIWW. PROJECT SUMMARY: Applicant proposes to construct a pier approximately 655' in length to access water. He requests construction of a dock system with dredged basin at the waterward end. Rolf Sass Page 2 9. PROJECT DESCRIPTION The project site is Lot 10, The Villas at Landfall. This is the southernmost lot adjacent to the AIWW in Landfall, a development on Highway 74 in New Hanover County. The size of the lot is approximately .5 acre, and averages 27' above mean sea level. The lot is vegetated with typical high ground vegetation. This gives way to coastal marsh spanning approximately 565' to open water. The New Hanover County Land Use Plan classifies the area as Conservation. The waters of Banks Channel are classified SA by the Division of Environmental Management. The area is not designated as Primary Nursery by the Division of Marine Fisheries, and is closed to the taking of shellfish. The bottom in this area is sandy. A single family residence is currently under construction on the site. The applicant is proposing to construct a 6' wide pier across the marsh to open water. The structure would begin on high ground (at the 100 year flood elevation), crossing approximately 72' before encountering coastal marsh. The pier would then be elevated over approximately 25 linear feet of Juncu roemerianus, and 540 linear feet of SSpartina alterniflora. The pier is proposed to extend another 18' into open water. The request is for a 16' x 16' gazebo at the waterward end of the structure, with a ramp connecting it to an 8' x 24' floating dock. There are to be four tie pilings associated with the floating dock to allow for the mooring of two boats. The mooring pilings will be placed a maximum of 14' from the floating dock in order to remain 15' from the adjacent corridors. The structure extends approximately 68' into open water, and terminates 85' short of the AIWW, at the -1.5' mean low water contour. In order to make this facility feasible for docking, the applicant proposes to dredge a 60' x 60' basin, with a 30' x 40' access channel to the AIWW. The bottom graduates to -7' mean low water at the waterward end of the proposed dredging. The basin would begin at the gazebo, and span 60' in both directions. The access channel would continue for 40' toward the AIWW, and would be 30' in width. The proposed depth is -6' mean low water. The dredging is to be accomplished by dragline onto a barge. The spoil will be transported by truck to a previously approved spoil site on Market Street. Spoil will be contained on site by a constructed dike wall. The spoil site is approximately 2.4 acres in size. The intended use of this project is to serve the adjacent single family residence. ANTICIPATED IMPACTS The project as proposed meets the 1/3 rule, is 85' from the AIWW, totals less than 500 square feet in dock and deck space, and is 15' from each adjacent corridor. The project as proposed would shade approximately 150 square feet of Juncus roemerianus, and 3240 square feet of Spartina alterniflora. It would incorporate approximately 556 square feet of open water. PROTECT DESCRIPTION 4/2/93 The project area is a single-family residential lot (Lot 309), on River Road, in Lockwood Folly Subdivision, adjacent to the Lockwood Folly River, in Brunswick County. The lot is approximately 311 feet in depth, 125 feet wide adjacent the Lockwood Folly River, and 157 feet wide along River Road. The lot is currently vacant, wooded,primarily with live oak and pine, but the applicant is in the process of designing his private residence for subsequent construction on the lot. The highground area of the lot averages about 9.5 elevation M.S.L., and gradually slopes from the road toward the river. There is a low, wet area in the northeast corner of the lot that has been classified as federally regulated wetlands. This adjacent wetland pocket extends into the lot approximately 150 feet, and averages 50 feet in width. Coastal wetland plants, cat-tails (Tvnha spp.) and saw-grass (Cladium jamaicense) are evident throughout the water (east) side of the wetland area. There is a small isolated wetland pocket, (40 feet X 10 feet), located approximately 25 feet above, or northeast of the larger wetland area. The waterward side of the lot (east) transitions from highground to a 60-70 feet wide border of high coastal marsh. Vegetation species observed were; uncus roemarianus, Limonium spp., Salicornia spp., Distichlis s i? cata, Borrichia frutescena, SSpartina patens. and S_,.partina alterniflora. The frequency of smooth cordgrass (S. alterniflora) increases in a waterward direction, resulting in a border, 70-100 feet wide, comprised solely of smooth cordgrass, completing the waterward limits of coastal wetland vegetation prior to open water. The Lockwood Folly River is approximately 2600 feet wide in the project area, however there are extensive areas of smooth cordgrass marsh, numerous marsh islands, and shoals interspersed throughout the shallow river basin. The U. S. Army Corps of Engineers (U.S.A.C.O.E.) maintains a channel, 100 feet wide, along the southside (project side) of the river. The navigational easement for the project extends up river to the bridge on N. C. Hyw 211. The U.S.A.C.O.E. is currently in the process of completing a maintenance dredging project that will extend approximately two miles above Varnumtown, N.C. The waters in the project area are classified SA by the N.C. Division of Environmental Management, and are CLOSED to the taking of shellfish. The waters are not designated as primary nursery area. The applicant proposes to construct a pier from his property for water access to the Lockwood Folly River. The pier would be 136.14 feet long and 4 feet wide, and would terminate in a T-shaped platform at its waterward end. This platform would be 12 feet long and 12 feet wide. A boatlift (10' X 12') is proposed on the north side of the T-head platform. A floating dock (16' X 10') is proposed on the south side of the T-head. No roofing is proposed over any of the structure. The end of the pier would be located at elevation -4 N.G.V.D. or -2 feet at MLW. This would place the end of the structure 50.2 feet from the toe of the federally maintained channel. The construction of the pier may create localized, short-term turbidity increases during piling installation. This is the southernmost lot adjacent to the AIWW in Landfall, a development on Highway 74 in New Hanover County. The size of the lot is approximately .5 acre, and averages 27' above mean sea level. The lot is vegetated with typical high ground vegetation. This gives way to coastal marsh spanning approximately 565' to open water. The New Hanover County Land Use Plan classifies the area as Conservation. The waters of Banks Channel are classified SA by the Division of Environmental Management. The area is not designated as Primary Nursery by the Division of Marine Fisheries, and is closed to the taking of shellfish. The bottom in this area is sandy. A single family residence is currently under construction on the site. The applicant is proposing to construct a 6' wide pier across the marsh to open water. The structure would begin on high ground (at the 100 year flood elevation), crossing approximately 72' before encountering coastal marsh. The pier would then be elevated over approximately 25 linear feet of Juncus roemerianus, and 540 linear feet of Spartina alterniflora. The pier is proposed to extend another 18' into open water. The request is for a 16' x 16' gazebo at the waterward end of the structure, with a ramp connecting it to an 8' x 24' floating dock. There are to be four tie pilings associated with the floating dock to allow for the mooring of two boats. The mooring pilings will be placed a maximum of 14' from the floating dock in order to remain 15' from the adjacent corridors. The structure extends approximately 68' into open water, and terminates 85' short of the AIWW, at the -1.5' mean low water contour. In order to make this facility feasible for docking, the applicant proposes to dredge a 60' x 60' basin, with a 30' x 40' access channel to the AIWW. The bottom graduates to -7' mean low water at the waterward end of the proposed dredging. The basin would begin at the gazebo, and span 60' in both directions. The access channel would continue for 40' toward the AIWW, and would be 30' in width. The proposed depth is -6' mean low water. The dredging is to be accomplished by dragline onto a barge. The spoil will be transported by truck to a previously approved spoil site on Market Street. Spoil will be contained on site by a constructed dike wall. The spoil site is approximately 2.4 acres in size. The intended use of this project is to serve the adjacent single family residence. The applicant is restricted by subdivision covenant from having structures such as this on his lot. He is hoping that he will acquire this right after obtaining a State Permit. Rolf Sass Page 3 10. ANTICIPATED IMPACTS The project as proposed meets the 1/3 rule, is 85' from the AIWW, totals less than 500 square feet in dock and deck space, and is 15' from each adjacent corridor. This area has never been dredged, but is in close proximity to the AIWW, and is not a Primary Nursery Area. The project as proposed would shade approximately 150 square feet of Juncus roemerianus, and 3240 square feet of SSpartina alterniflora. It would incorporate approximately 556 square feet of open water. The pier would cross approximately 432 square feet of high ground, and the spoil would be placed on approximately 2.4 acres of high ground.
