REFERENCE: DEM93-341 Nationwide Permit Application to Install Temporary
Cofferdams at Pea Island NWR, Dare County, NC
Dear Sir:
The above referenced proposal is located in the Estuarine Waters AEC.
Therefore, as per conditions of the State position on consistency of the nationwide
permits with the North Carolina Coastal Management Program (NCCMP), an
individual determination that the proposed activity is consistent with the NCCMP is
necessary.
A consistency determination for the essentially the same proposal dated
7/07/80 was received in our office, and that proposal was also published as a US
Army Corps of Engineers Public Notice, number SAWCO-N-028-00025. The Division
of Coastal Management circulated the consistency determination to the appropriate
state review agencies for comment. Based upon that review, the State agreed, with
conditions and recommendations, that the proposal was consistent with the NCCMP
(see attached). Since the proposal described in the above referenced permit
application is not significantly changed from the proposal described in SAWCO-N-
028-00025, the proposal is consistent, with conditions and recommendations, with the
NCCMP.

September 5, 1990. Additional conditions are that 1) this
Certification shall expire in three years unless renewed by DEM
and 2) post dredging soundings shall be submitted to the
Washington Regional Office of DEM within 60 days of dredging.

This is a request to amend Water Quality Certification No. 2508,
issued September 5, 1990, as amended, for the disposal of dredged
material on the ocean shoreline of Pea Island National Wildlife Refuge
(PINWR) from 1,500 to 15,000 feet south of Oregon Inlet, Dare County,
North Carolina. The amendment would cover the disposal of dredged
material along the ocean shoreline of PINWR from 3 to 7 miles south
of Oregon Inlet for the purpose of protecting NC 12 from erosion.
Maintenance dredging of the Oregon Inlet Channel with an
ocean-certified hydraulic pipeline dredge with discharge of dredged
material on the ocean shoreline of PINWR between 1,500 to 15,000 feet
south of Oregon Inlet is covered under Section 401 (P.L. 95-217),
Water Quality Certificate No. 2508, issued September 5, 1990, by the
North Carolina Division of Environmental Management (NCDEM). The
NCDEM amended Water Quality Certificate No. 2508 on August 9, 1991,
to include the discharge of dredged material froii dredging of the
Ocean Bar Channel by'
y an ocean-certified pipeline dredge, or a hopper
dredge with direct pumpout of dredged material on the ocean beach of
PINWR.
The disposal of dredged material on PINWR between 1,500 to 15,000
feet south of the inlet from maintenance dredging of the Oregon Inlet
navigation channels is scheduled to start on or about July 1993.
Disposal of dredged material between 3 to 7 miles south of the Inlet
is scheduled to start after August 31, 1993, and is expected to take
approximately 90 days to complete.
An Environmental Assessment and Finding of No Significant Impact,
Manteo (Shallowbag) Bay, Protection of NC Highway 12, Pea Island,
N.C., Dare County, N.C., Evaluation Report, Section 933, PL 99-662,
February 1993 has been prepared pursuant to the National Environmental

Policy Act of 1969, as amended. The Environmental Assessment and
Finding of No Significant Impact is being circulated to Federal and
State agencies and the interested public. A public notice will also
be circulated prior to construction.

of No Significant Impact (EA/FONSI), Manteo
(Shallowbag) Bay, Protection of NC Highway 12 on Pea
Island, Dare County, North Carolina, SCH Project No.
93-0713.
The N. C. Wildlife Resources Commission (NCWRC) has
completed a review of the proposed project and possible impacts
on existing wildlife and fishery resources in the area. Our
comments are provided in accordance with provisions of the
National Environmental Policy Act (42 U.S.C. 4332 (2)(C)), and
the Fish and Wildlife Coordination Act (48 Stat. 401, as amended;
16 U.S.C. 661-667d).
The U. S. Army Corps of Engineers (COE) proposes to remove
200,000-350,000 cubic yards of coarse sand from the ocean bar
channel and 600,000-900,000 cubic yards of coarse to medium sand
from the channel widener near the Bonner Bridge at the north end
of Pea Island. Material will then be deposited by pipeline to
eroded beach areas as much as six miles south of Oregon Inlet.
No wetlands or inland waters will be affected by the project.
Wildlife resources concerns include disturbance of beach and dune
areas and possible long-term changes in composition and/or
compaction of beach sands, with resulting impacts on nesting
activities of sea turtles and shore birds.
The COE should insure that the restoration of natural beach
slopes and contours and the revegetation of disturbed dune areas
is accomplished immediately following completion of work in each
beach or dune area. Monitoring and relocation of sea turtle
nests should be closely coordinated with Pea Island National

Wildlife Refuge personnel as described in the document, and
success of the relocated nests should be determined.
Given that the proposed project does not involve wetlands or
inland waters, and that the impacts on wildlife resources in the
area will be continuously monitored and minimized to the extent
practicable, the NCWRC concurs with this EA/FONSI. The NCWRC
offers no further modification on previous State concurrence with
the attending consistency determination under the N. C. Coastal
Management Program.

Pollution Control Act of 1973. Temporary and permanent erosion

personnel to ensure compliance with the sedimentation Pollution

The above subject document has been reviewed by this office. The FONSI
addressed the deposition of approximately 1,000,000 cu yds of dredged material
from the bar channel and for the channel widening in Oregon Inlet. The
material is to be deposited onto the beaches within 1.0 to 3.0 miles from the
inlet. There is also an alternative proposal for placing the material on the
beaches as far as 6.0 miles south of the inlet with the use of booster pumps.
This office has no objections to the proposals. Existing Water Quality
Certification #2811 should, however, be modified to include any additional
areas not covered in the original proposal.

The Division supports the proposed project not only for the
shelter it will provide for Highway 12 but also for the
protection it will confer on the wildlife feeding ponds on the
Pea Island National Wildlife Refuge. These ponds have national
significance as a wintering ground for waterfowl and as a
stopover point for migrants for many other groups of birds,
including shorebirds, raptors, songbirds, and waders. Freshwater
pools are very sparse along the Outer Banks and the ponds located
on the refuge provide a key resource for many species.
Storm overwash has salinized these pools in the past, reducing
their value to birds and other wildlife. Beach renourishment and
dune building along the proposed disposal area should reduce the
frequency and magnitude of these overwash events. Although beach
disposal taking place during the summer months can adversely
affect sea turtle nesting, the provisions for daily monitoring,
relocation of nests, and the other measures specified appear
adequate to reduce these impacts.

control plan prior to beginning any land-disturbing activity if more
than one (1) acre will be disturbed.
If an environmental document is required to satisfy Environmental
Policy Act (SEPA) requirements, the document must be submitted as part
of the erosion and sedimentation control plan.
If any portion of the project is located within a High Quality Water
Zone (HQW), as classified by the Division of Environmental Management,
increased design standards for sediment and erosion control will apply.
The erosion and sedimentation control plan required for this project
should be prepared by the Department of Transportation under the
erosion control program delegation to the Division of Highways from the
North Carolina Sedimentation Control Commission.
